Crown asks about Rufolo's methodology for studying the photographs. He gives a lengthy response of his process.

Crown asks for his notes. She says she was given three pages written on a hotel notepad.

Rufolo says he didn't bring his notes. They're in Ottawa, he didn't know he had to bring them to court.

Our first nomination for a WS field trip - the magical forest! Pity no one ever figured out exactly where it is located. Hmmmmm.
I think it's through the wardrobe in the Chronicles of Narnia.

Crown is checking Rufalo's notes. Wants to know the size of a human humerus female. Rufalo says he'd have to consult the research. He estimates 45-55mm. "I would think in that range." His estimates were "very broad" he says. #LauraBabcock

What were his estimates based on? There was no beer bottle in the photo as a reference.

Although I have a tiny beer bottle I use for my fish catch photos. :happydance:

This courtroom sucks. Too small. I went there to watch a week ago. They barely let people in. Maybe 15 or so. And there are always line ups. Too bad. I want to go again but it's a huge gamble.

  • #169
Well so far the crown has made this guy look utterly useless and unprepared. No notes, an expert in his field with more than 40 yrs experience in his field couldn't identify them, made it appear DM as shopping around to get an answer he wanted to hear, and his estimates are very broad by his own account.

"Let's talk about bone "A" for a minute," Cameron says, bringing the image to screens. "Appears to be the distal end of a tibia, correct?" That's the first step in the analysis? If you don't know, why continue & do the comparison? Process helps narrow down assessment, he says.

Crown in Millard now cross examining Dr Rufolo about his methodology for bone identification.
Crown:Your telling this jury that you can tell there is some kind of depression there?"
Dr: No, pic too grainy.

Cameron is taking Rufalo back to the apparent bone that Dr Rogers identified but he ignored in his original report. He agrees you can see a depression. Crown shows deer vs human tibia. That's your evidence? Yes, he says the ridge is more shallow in human tibia. #LauraBabcock

"In human tibia you would not see so much shadow," but the image is blurry and he's only making a suggestion. #LauraBabcock

He went to court to defend an accused killer but didn't bring his notes?? I wonder what DM's reaction was when he said that.

If you don't see the full side, how do you know there's a depression on the other side? "Knowing the anatomy of the bone itself," he says. "If this is even a tibia," Cameron says. He agrees. He looked at other long bones too. #LauraBabcock

You're saying it could be a human radius? It is possible, yes, Rufalo tells crown. Is he aware of the effect of burning on human bones? Yes. They can warp or twist, he agrees. Can't tell from image how much alteration has taken place. #LauraBabcock

Cameron now pulls up one of the photos we saw earlier this morning and she's asking specifics about his observations.

She's pointing out a depression in the bone. She has pulled up two photos of a deer tibia and a human tibia, side by side, and again asks, if he's certain he can tell the burning objects in the court exhibits are deer bone.

Rufolo, "It's a poor quality image, it is just a suggestive feature. I did not make a positive identification."

Cameron, "If it's even a Tibia?" He agrees. He can't say that for sure either.

Could the differences that make these look more like deer bones be caused by burning? Rufalo pauses, but agrees, to some extent. He agrees he can't say with confidence that the bone is a tibia. "So the rest of your analysis isn't worth anything is it?" #LauraBabcock

Is it normal to use the term "long bones"?

If he's wrong about the tibia, the rest of his analysis is wrong, he agrees. He has a question mark next to tibia in his notes. Also noted could be human femur, based on Dr. Rogers report. He can't be certain. (Nor could Dr. Rogers) #LauraBabcock

He was asked if any bones "could be a deer bone," initially, so his opinion is that if that bone in the picture is a tibia it could be a deer tibia. That was the basis of his examination. Was not directly asked if the pic showed human bones. #LauraBabcock

Yes, I think that refers to tibia, fibula, radius, ulna, femur, etc. As opposed to the rest of the shorter, smaller bones in the body.

So there you have it - set up to give a biased finding. Next?
