Finished watching the archives of the trial. If I was a juror I would think: that's all the def has, it makes him look pretty guilty. The def is under no obligation to present a case so IMO it would've been better to do nothing than these few witnesses.
There was testimony that his 2 cohorts would regularly smoke marijuana sprinkled with pcp but nothing was presented into evidence that AH did.

It seems like the gum DNA testimony helped the prosecution more than the def considering the gum and casing were both found in the car by the Enterprise employee. It puts AH, a casing that matches casings at the murder scene in the car he rented and is seen in multiple times on videos.

When everyone rested AH looked scared and angry. Like, 'this is all'. He obviously knew only 3 witnesses would be called but until he actually heard it and realized it's done and over.... It looked like reality finally set in.

In just a simple basic way, I feel like the State proved their case. I mean if you go with the legal definition that it does not matter which one shot the gun, but that being together as a murder happens is in fact GUILT for all.

They may try a HAIL MARY in closing, and say that AH was shocked to see his friend suddenly shoot Lloyd that night. But I don't think the jury is going to buy that at all.

I mean, if that happened to me, and one of my friends suddenly pulled out a gun and killed my friend, and I was there, I would be freaked out. I would not be seen on camera, coming home 45 min later, holding a gun, acting cool calm and collected, like nothing happened. And I wouldn't be all arrogant and detached in court. I would be on the stand pleading with the jury to understand what happened. His demeanor in court is not that of someone that was blindsided by a crazy friend and now he is trying to prove his innocence. :no:

I will sure not miss Garsh...a very unpleasant and rude judge...about one of the worst I have ever seen. That last confrontation was just too much...she did not want any rebuttal at all...is so rude to state and clearly hopes that ah is found not guilty. As she gets so angry she actually jumps up and down and seems rather unstable. I don't know how McCauley can stand even looking at her.

I don't know, it may be highly variable and unpredictable whether or not it's possible I can recall if Dr. PCP lent the defense an iota of aid in his testimony. :blushing:

I almost felt sorry for the guy, he really had few answers to questions posed in cross, except 'it's highly variable and unpredictable', 'I don't know' and 'I can't recall'. Good job by the prosecution though, zero sum gain for defense with this doc, and their rebuttal witness was very clear, concise and 'knew' what he was testifying about, nothing variable there.

the rebuttal guy was very good despite Garsh trying her best to send a message to the jury to just disregard him. i think the jury has to see how much Garsh favored the defense.

Agree, I'm rewatching that portion now and her attitude is rather one-sided, I wonder if her main problem is being worried about appeals issues, as she has consistently been 'overly fair' to the defense.

ETA: And her obvious dislike of the prosecutor.

Some judges, like JSS and Garsh loathe appeals. Others take an entirely different view. They run their court as they see fit and say...."Pffft, I'll deal with the matter at appeal."

Long time ago, I stopped feeling sorry for the expert witnesses that get beat up on cross. That's what they are there for: they testify to what their side wants, put on the spin and take the raking over the coals in stride. It is what the attorneys are paying them the big bucks for. All part of the job and the humiliation is over and forgotten when they sign that nice fat check.

What's everyone's best guess on a verdict? I think the DT's argument that there were two people involved who were more violent than AH due to PCP was surprisingly LAME. As for the possible cross contamination of the gum and the shell casing-well if there was nothing else pointing to AH they might have done some damage.

I think I expected more tbh.

My best guess is the jury will find AH guilty.

I didn't hear Judge Garsh announce start time for today. So, anyone's guess. Yes closings today. Everyone has rested their case..

Jury will be charged after closing. Judge reminds DT and PT that closing arguments must be reserved to facts brought into evidence.

DT and AH thanking the jury for their attention and their service. DT explaining that the jury stands between the government, the accuser, and the citizen, the accused. DT is discussing reasonable doubt and what that means.

DT starts on the accuracy of the evidence and whether prosecution began with the conclusion and retrofitted that evidence to fit that conclusion.

DT starts on the media and social media regarding AH-seems to be implying that the jury has been tainted by it.

DT states that the jury promised to be fair and unbiased, and that they could put all of that exposure aside.
