The case of the two people allegedly involved the murder of Bella Bond, the toddler found on Deer Island and initially called "Baby Doe," is back in court on Tuesday.

Their cases are being tried separately. The trial of Rachelle Bond is scheduled for December 2016. McCarthy's trial remains unscheduled.

Bond's attorney Janice Bassil said in court documents that she may present a defense based on McCarthy's behavior towards Bond, "compounded by her own mental health issues."

"In my meetings with the defendant she is deeply concerned that her life, her past and her history has been open to public view," Bassil wrote in one filing.

Bella Bond’s mother plans to testify against boyfriend

Defense lawyer Jonathan Shapiro, who represents McCarthy, said the prosecution is relying on Bond’s account of how her daughter died and needs her testimony.

"Frankly, that’s all this case depends on as far as the Commonwealth is concerned: What she says,” Shapiro told reporters after the hearing. “She’s going to have to testify. And if she doesn’t testify, the Commonwealth has no case.”

Bassil wants to keep Bond’s records out of Shapiro’s hands, saying they’re irrelevant.

She said she plans to ask a judge to dismiss the case against Bond in time for the next court hearing, which is set for November 10.

I re read the "before she was baby doe" article int eh globe again. she removed all of bella's things from her apt after she died. that screams guilt to me.

If Bond was not hands on in Bella's death, why not go the police right away? The fact that she had opportunity to go smoke and go get drugs, etc. proves that McCarthy was not keeping her captive. It just makes her look more culpable in my opinion.

yes. she sat by while her "awesome azz husband" brutally beat her newborn 7 week old baby to death then fled w him. she killed herself in jail.

I will never understand women like Rachelle and Kristen B and the hundreds of others. It is beyond comprehensible and I have zero sympathy for them. The thing about Rachelle is she had 2 children she lost custody of and then Bella was just lost in the paperwork. It's almost like Bella never existed. Oooh! It makes me sick to my stomach.!

Chance Walsh's case (Kristen Bury's son)n would make you sick as well. she too lost an older child and had a baby die of supposedly an acute kidney infection a year before she had Chance. she had Chance to replace Dewayne then regretted it telling ppl she hated Chance because he wasn't Dewayne.

SHe was also heavily on drugs although I think it was meth not heroin.

IMO she was the controller. He is a stupid sap who would do anything for a fix. Her history with family and men shows that she is the one who calls the shots. The "father" came back to town and sat with her at the waterfront bemoaning Bella's death and did nothing. No he was not in control. He did what she wanted.

I just can't understand why the state is going with him as the murderer. Maybe they are hoping the defense will point to her? It's still a he said - she said case, IMO
