And in other cases where protocol is not followed and chain of custody is not documented and evidence is mishandled and/or unlawfully obtained, isn't that evidence considered invalid, unusable, corrupted, ie useless in court and is thus thrown out and ordered not to be considered valid evidence at trial?

Why this compromised and invalid data is still being considered legal evidence in this case, I can't understand. Seems against all legal conventions and judicial policies and standards and I believe unconstitutional.

I see it as helping the defense with more evidence showing the incompetence by Canon LE.
Since it's totally compromised can it even be used as actual evidence?
Then again it's Cannone who called the shots.
I don't know what the outcome with Gallagher's evidence collecting during the 1st. trial was.

So this "detective" used a leaf blower which he thought was the best tool available at that time to look for and find evidence and yet he DIDN'T UNCOVER ANY OF THE 40-SOMETHING PIECES OF TAIL LIGHT THAT WERE RECOVERED HOURS LATER?????!!!!!! Yes! When he first started talking to Brennan he was so self assured without arrogance. He appeared to be a long time cop who climbed the ranks and knew exactly how to do his job.

They said no. Regular small N>E> town, just were not experienced in doing this immediate scene capture, the correct way. I KNOWWW, BUT. I would think there would of been evidence bags is right though. Their issue is that it was in a snow blowing storm, windy.

It is not about the first trial anymore. This is a new trial and new witnesses and evidence hopefully. Too much imo is based on T1.

Lt. Gallagher appears to be a very competent witness. He seems honest and forthright. I do wonder, however, why there were no reports written... Seems absolutely incompetent to me that as he is using a snow blower to uncover evidence (but does not know that it is a crime scene at the time [baffled]) no reports are written or made. RA saw only KR in front seat, his girlfriend wasn’t sure but thought there was just a woman and Ricky the driver said he saw a man and woman in the car. RN mentioned the Lexus was about a car length in front of their truck, brake lights went on and off, tail light in tact.

Hey everyone! Just a Sunday night check-in after a long weekend! Over the past week or so I have randomly shown the picture of the wounds on JOKs arms to people who did NOT know anything about the KR trial or even who KR was. I asked them if it looked like the person was hit by a car and the pieces from the broken tail light scraped his arm up, or if it looked like he'd been attacked by a dog. Everyone, except for one guy, said the dog. Immediately. No question in their mind. The one that did say tail light did ultimately say that after looking more closely, it probably was a dog bit.

JMO and the O of MANY others....

Re: Gallagher, this guy comes off as likable, affable, even keeled. Hope the jury is paying attention to the content of his testimony- and not just his demeanor, which is not combative or defensive like many other witnesses.

I agree he is likable.
He either did not care about procedure or this was just biz as usual for him.
He was the boss, he did not write reports. Be clear on that.
The only video is of him snowblowing the area closeby to John's body bc after all this is a great freaking idea ! He used the snowblower bc he wanted to make sure not to miss anything. ( My head hurts listening to him bc the D is smiling ....he missed all those 47 or however many pieces of tail light - Glaring red tail light that would have stood out in the pristine white snow.)
He goes to HQ on the way to the scene to get his snow gear but does not think to bring an evidence kit ? Does not keep an evidence kit in his personal car - oh prob bc he's the boss. Sends one of the guys to get the snowblower but not the swabs or evidence bag etc.
I could go on and on and I am sure AJ will tomorrow. Likeable yes, a cop you want on your team ? No.
Canton c'mon. The world is watching this trial and besides it being a Huge embarrassment to the CW, the trial is calling out Canton as not a good place to settle down. I am glad my house is a few towns over as the Canton home values have to be tanking.

HM said when the black SUV made the right hand turn she saw a woman driver and a man in the passenger seat.
Then when they drove off from in front of the house and passed the SUV she only saw a woman at the wheel and no male,

I so agree with the lack of intellect but I have to think, sure he knows Proctor was the Lead. He just does not want to give that point to AJ because they are trying to downplay Proctor's role since his keister got FIRED for cause. But I may be gving the witness too much credit ...JMO
