Cannone is giving humane practice instruction to the jury.
YB is going over the conversation he had with Karen, in the presence of Karen’s parents and Proctor.

Is this the first we've heard about Karen saying JOK bumped his head two days previously? I don't recall that from T1.

It's obvious to most here, that Brennan ( and Bukhenic) are being overly careful and determined to minimize the " Proctor Factor" by continuously calling him ' Mr Proctor'. Just wait until AJ starts with the " Former Trooper Michael Proctor" label. Things are going to get interesting...

I don’t either.

Maybe because it never happened??

The verbiage is interesting. Also notice he’s saying it’s a whole team effort. Not a single investigator. Requires a team of individuals. Definitely trying to dilute former trooper Proctor.

Also, in Trial 1, didn’t the CW say they didn’t know who Kerry gave the phone to or where it was for a period of time? But now in Trial 2, Bukhenik suddenly remembers that Goode handed it to him that morning at Canton PD???

Ok yeah, looking back at Kerry Roberts t1 testimony - she said she picked up John’s phone and gave it to an unidentified first responder. She didn’t know if it was a paramedic, police officer, or firefighter.

Gallagher, in order to minimize his incompetence IMO, said they would never take pictures of a man laying on the ground like JOK was, to protect his dignity essentially. However, they still could have marked it off around his body to illustrate where he was laying. I also think IMO they were trying really hard to minimize the fact that JOK was drunk and that he was on the lawn of another cop, trying to protect their own. I think the pics came after he was declared dead.
MOO

Since when do you not photograph the entire scene including the decedent in the condition, location, and position he was found?

I know they clearly struggled with taking pictures but this one part doesn’t make any sense.

Ah, a cop is dead, let’s protect his dignity by deviating from SOP and potentially causing major hurdles down the line should this go to court one day..

Disgraced, fired former trooper Michael Proctor

His smiling about his crappy actions really isn't helping the CW right here. Even he is laughing at how pathetic he is.

It really does rub me the wrong way with the excuse of ‘He was an officer,’ but they all refer to him as Mr. O’Keefe, not Officer O’Keefe. It reads to me that they’re using their ‘respect’ for him to cover for some gaps in their investigation.

Ok.. what just happened there? wrong shoe?

ETA: Whatever it is.. prosecution and defense is going to meet together with Bukhenik.

Is he human being masquerading as a judge seem a little more amiable towards the Defense today or am I imagining things?

It is so strange to me that they don’t wear body cams. I assumed that had become pretty standard. Certainly would’ve been helpful here to have some footage of JOK still at the scene.
It’s always interesting when departments resist using body cams, especially when the tech is widely available, and it could easily exonerate officers from false accusations. MOO.

YB is saying "We" a lot in his testimony, more than what would be expected IMO, as if he can't distinguish who did what when. Maybe he was more involved in MP's actions than we thought! He also seems angry over the outcome for MP and is standing up for him with the inflection of the words he chooses.

Seems like it’s the same shoe as yesterday (found at 34F). Where is the other shoe that was on JO’s foot when found in snow and probably discarded by medical staff at the hospital?

I agree. It doesn't matter when that search was made because the CW must prove JOK was hit by a car, and hit by Karen's car too, since that is what these charges are based upon.

I would also like to add that we can see clearly how the defense believed there was involvement of other players in the death of JOK from the shady evidence uncovered early on that was from their investigative means.
  • Yannetti getting a tip early on from someone giving his wrong name to check out the Alberts
  • Finding the 02:27 "hos long to die" search on JMc phone
  • Brian and Nicole Albert never coming outside during the first responders
  • Not one person mentioning CA being present that night
There's so much more.

MOO
In the first trial BA's mental gymnastics were a humiliating failure when trying to explain to AJ that he did not call Brian Higgins and did not speak to BH when BH immediately returned the 2am+ call and that during that timeline he and wife were being intimate.
Meanwhile phone data shows that someone did pick-up the call which lasted a few secs and records show no "missed call".
So his locked phone made a butt call and was also courteous enough to answer when BH called back..I want one of those Canton upgrades. lol

The first call BA made the morning of JOK's body being discovered was around 7am and ironically was to Brian Higgins.
He also testified that both he and NA sleep in their bed with their cell phones between them along with BA's glasses.
It's the never ending story of lies and deceptions with an enabling LE and hopefully the jury will put an end to the corrupt madness.
IMO
