I don't know Mr. J. , There is 3,000 page FBI report that was sent to the defense to open this door. While we aren't privy too everything in it, let's see if AJ can bring some light or if "that so called door can be opened."

All the exculpatory stuff in there AJ had already and used for trial 1.

There have been some small differences. e.g he chose to ask Jen about her FBI interview whereas he did not do so last time.

I don't think there is any game changer in there.

Waiting to see if more is revealed from that report and if the defense can reveal it when they present their case.

DiCicco watched the ring videos, made notes, and now footage can’t be found. Those notes never made it into Proctor’s report and the video is missing. That’s not a conspiracy the defense created. It actually happened.

I don’t know how the pieces of tail light found by SERT got there. But I do know it is beyond plausible that Trooper Proctor found additional pieces over several weeks, including one big old piece when he just happened to be driving by alone. The snow had melted in prior searches. These weren’t hidden in a snow bank.
I wonder how Bukhen is feeling about now......

New -- Commonwealth wants evidence of Aruba "incident" now part of trial, by questioning new witnesses not previously planned. Prosecutors say defense opened the door to this when they had Bukhenik read Higgins-Read texts about JOK's alleged cheating.

Looks like Hank's wants to bring the Aruba girls back for round 2 after specifically saying he wasn't going to bring them back. Hank's in panic mode IMO!

Sheesh he's already unable to just say yes or no. Always rewording and stating what he wants to state vs just agreeing or disagreeing with what is being said.

So are you saying DiCicco made up the notes? He made notes with time stamps as he was the person tasked with watching videos. Now there’s no video. And those notes never made Proctor’s report. These are facts. It’s not a conspiracy pushed by the defense as your post stated.

I disagree with the interpretation, as we know the defendant did not arrive at 12.41, same as how the library footage (12:37 and 12:39) is not missing for this. Rather there should be Ring footage for 12.36 arrival.

I agree Lally did a poor job of this part of the presentation - i suspect Brennan will address it.

I never stated Proctor planted the pieces found by SERT. I actually don’t believe he did. I believe those small pieces came from Karen’s driveway. Not sure who planted them. But I do believe they were picked up and added to the crime scene by someone.

I've also been of the view that AJ might have to argue this in the alternative. But you have to agree it's now highly speculative that "someone" planted them, and not something actually in evidence.

I'd also note, that AJ has basically argued for over a year that Proctor did smash out the tail light at the Sallyport - but we can see the timing for it doesn't work - so for me that calls in to question the whole enterprise - he can't just change horses to some other mysterious villain.

My speculation only.

Like the texts that AJ had YB read last week, which some parts could look bad for Karen, the testimony of those sisters might make KR look poorly, but the situation is one which still shows how JOK was again acting like a lush in their relationship (falling down drunk) and could have been trying to kiss the sister no matter what she says (like drunk men often do to young women). It's a nothing burger really in relation to Karen's guilt or innocence. I also suspect they will change their story to make it seem even worse, and AJ will put them in their place.

I think he is answering more directly today. Some has been about wording... movement of the Ford Edge vs the Ford Edge just being parked in front of the house... probably good for him to correct that, but he is answering with more yes and no's lol

things get kind of murky because...they want to use the angry version of Karen to prove murder, so the most aggregating issue is that she was angry when she backed up her car and sped off. But it doesn't prove the accident happened because she was angry.

they can't seem prove she intentionally hit him. or even that she did hit him ( because of the odd autopsy results).

I believe she is guilty of vehicular manslaughter, I don't think they can prove homicide. I do believe she hit him and this whole idiotic case should have been settled eons ago. And if the other cops did something..framed her in a cover up?

well, sometimes the bad guys win. but they should be investigated and punished for drunk driving and embarrassing their office. If everyone thinks he died in the house..well there is plenty of motive to cover it up.

Nothingburger to me. If I was on vacation with my partner and drunkenly saw her making out with some dude, I'd probably be not happy, even dare say, angry. Doesn't mean I'm a murderer. JMO

That would PMO to know end if I was on the jury, and a cop played obtuse in that specific line of questioning. Be honest it would go further, "Proctor was a jerk and a bad cop, what he did was inappropriate" but playing dumb like you don't know what nudes are is just disrespectful.

Regarding the vacation incident and the angry texts and voice mails: this line reminds me of trope-heavy crime TV shows where the accused says something to the effect of "I'm going to KILL you" and the person ends up dead.
