Misspoke ? You are wrong because your ‘work’ is sloppy.
In my real life, I inherently distrust people who frequently say something is a ‘misunderstanding’ or ‘I just misspoke’. Like Alessi, I think words are important. I don’t trust anyone willing to devalue their own prior statements to try to avoid taking responsibility. It’s a slimy quality IMO.

Ok, Alessi is explaining this more. So once the timeline crosses into midnight, it’s 1/30/22, not 1/29/22. So the five timelines as Burgess testified to them yesterday are not accurate to the second, because Burgess got the date wrong.

So, he's failed the kind of time and date knowledge you get taught as an eight year old.

Who doesn't know the date changes at midnight and account for it? Especially when your job (YOU HAD ONE JOB) is to create an accurate timeline?

Bottomline, I don't think they are experts. I think they come up with gobblily goo to help their clients. Opinion for hire. I wonder if Aperture will get sued. If they were involved in a case denying insurance coverage or any other case, a civil lawsuit might be coming their way. And a deeper look at who insurance companies and prosecutors hire is necessary. imo

If Burgess is going to misrepresent his degree and whether he graduated (pick any of 3 years) or not (what he told the DA?) why not at least do so consistently?

This suggests that not only is he deliberately misrepresenting his credentials but he also cannnot even maintain consistency in his false statements. This suggests potential issues with integrity AND competence. The worst traits possible for an expert! His attempts to explain this will be fascinating.

His testimony wasn't damning to the defendant today.

It wasn't clear and concise evidence.


He had no business testifying as an expert. He is a fraud.

When a so-called expert lies about their education and uses that lie to testify under oath before a jury, it is absolutely fraud. It's counterfeit.

And under oath, he sat in a chair, banking on these forgery qualifications and testified. That’s perjury!

And I will add @arielilane , he accepted money based on fake credentials, well that's civil theft. That’s illegal in every state. It’s not just unethical—it’s a crime.

If insurance companies used his reports to deny claims… And he wasn’t qualified to issue those opinions, well that’s grounds for a class action by affected policyholders. 😡😡😡

Alessi is saying despite his 1/30/25 report claiming to identify discrepancies, Burgess did NOT compare the time of the 3 point turn between Karen’s infotainment system and John’s phone. Instead, he identified ‘potential variance’ when he easily could have compared the times. I wonder if this is more of his non-peer reviewed methodology he invented for this trial… MOO

The CW is painting in negative space in this trial. It’s absolutely wild to see.

So Burgess failed to apply the variances HE listed (The offset times between the Infotainment system and John’s phone) to the infotainment time on the Lexus associated with tech stream event 1162(2). What on earth.

Burgess says the clock variances don’t apply to that time frame. Oh, convenient that they only apply in certain times… MOO

Just had a thought …. As a juror, I am watching CW’s witnesses lie, act evasive, and stretch the truth. Further, the judges attitude attitude is largely apathetic towards this as she allows these witnesses to ramble on and continues to admonish the defense for objecting. This would lead me to believe that ‘telling the whole truth’ is merely a suggestion — and I’d be tempted to take her ‘5 questions’ as such.
Speaking of looking things up ,can jurors look up GENERAL trial court stuff like ‘common objections when questioning a witness’? It would be helpful to know what HB and D are objecting to and whether it is overruled and WHY since no one is articulating these important rulings l. This ‘I’ll give him that’ instead of overruled/reason is pretty bush league.
