I think Brennan may have confirmed Karen’s innocence using his own timeline, IMO. Brennan stated at the beginning of trial 2 that John O’Keefe’s phone disconnected from Karen Read’s vehicle at 12:30 a.m. Let’s walk through what that implies:

-12:21 a.m: Karen arrives at 34 Fairview. (As per Ian Whiffen, Waze time shows 12:24 a.m. with a 3-minute offset.)
-12:21–12:24 a.m: John’s Apple Health data logs three flights of stairs climbed. That strongly suggests he went inside the house. Cars don’t have stairs.The CW claimed that the Lexus going up and down hills could have accounted for the stairs, but I don’t buy that. Apple health is designed to NOT interpret driving at steps. Otherwise you’d have miles logged as ‘walked/climbed’ every day.
-12:23 a.m: The Nagel vehicle arrives. A “here” text was sent at this time. No one in that car saw John inside Karen’s vehicle or exiting it.
-12:30 a.m: John’s phone disconnects from Karen’s car. Bluetooth typically requires proximity within 30 feet (standard Bluetooth devices in cars operate on a Class 2 standard - typically around 10 meters/33 feet). So, by this time, John and his phone were well away from her vehicle.
-12:31–12:32 a.m: John’s phone logs movement of 25 meters (~80 feet). Again, far from the car.
-12:36 a.m: Karen’s phone connects to John’s home WiFi. The drive from 34 Fairview to John’s house takes ~6 minutes (at minimum when it’s snowing). That puts her departure right around 12:30 a.m., aligning with the Bluetooth disconnection.

IMO, this timeline supports Karen’s account. She waited outside for a short time, then left around 12:30. The Bluetooth drop and Apple Health data make it highly unlikely that John was struck by Karen’s vehicle at or before that time, especially since his phone was active and moving after her departure. And ESPECIALLY since neither her vehicle or his body show signs of a collision.

The lawn would not be hard enough to cause that damage to the back of his head IMO. Earth does not get hard like ice or concrete. I would never think the ground caused his head wound. And I'd also like to know why he was laying with his head closest to the curb like the female EMS testified to (Katie McLaughlin). If he fell backgrounds on the ground, coming from the curb, wouldn't his feet be closest to the curb and his head be further into the lawn.

Consider this - if you were to be dragged out of the house by your hands, you would probably have grass stains on the back of your jeans and you might get snagged on a rock or branch causing the back pocket to be torn. Also, dragging you down from the house would likely result in your head towards the street and your feet towards the house, because who would drag you out that way and then make a u turn, (known as a u-eee in MA) to switch the position of your unconscious body?

Much of it will be common cause because it's spat out by BERLA. The defence may have even done their own extraction or have no reason to bother. They really seem to be disputing only the methodology of the variance calculation, where Burgess has used the 3 point turn, and DiSorga used the 2 phones.

That is pretty much the heart of it. And those are not complex calculations. So while Alessi has made inroads on credibility - it does nothing to dislodge the actual extracted data.

As I've said since last week - DiSorga appears to agree with Burgess on everything except the variance methodology.

I think the fact that Alessi is slicing the sausage so finely on that, shows just how tight the timeline is this time compared to T1.

Ideas about 1162 being the tow truck loading are dead and buried.
