You notice the difference in Alessi's argument this morning when he had time to prepare? I thought it was top notch and it should have been the winning argument. Instead - Brennan comes and says they can't use Trooper Paul against us and the judge agrees.Bad call - but I don't think it will end up being material because I think (and hope) they fully dive into it with ARCCA and most appellate courts will consider it cured.

There's such a discrepancy to watch the quality of witnesses the defense brings to testify compared to who the CW has brought forth. The two we saw from ARCCA are top-notch professionals. They didn't get defensive or abrasive while defending their science and results. They know their results first hand and can testify to the validity of their analysis. True professionals.
Now, scan to Welcher, Burgess, Buchenik and so on. It's like night and day how the different sides present. How many millions of $$$ has the prosecution paid out to date on these two trials for rubbish witnesses who have no dog in the fight. Abrasive.

IMO. He didn't know what to expect yesterday. I mean who could know or predict how Welcher's personality defects would affect his testifying? Alessi was likely caught off guard by such a terribly arrogant witness, constantly busting boundaries unchecked by the judge.

Alessi is a fast learner and has adapted in order to get what he can from him. He isn't hampered by the rigidity that restricts Brennan from easily thinking on his feet. Plus I really think at this point this witness is his own worst enemy, he simply cannot control himself. I can't imagine the jury not being over him and his rudeness. Jmo

Impossible to know what they are shaking their heads at or laughing at, etc. BUT.. I think it is great that we have reporters giving us these reactions.

From past trials, the jurors usually stop taking notes during cross, or less notes. It doesn't sound like this jury is like that, but that is JMO from reading Sue's daily updates. When we are bored, they seem to be attentive or taking notes, but everything they are hearing is "new" to them, or should be.

Also if they wanted to show a demonstration of the two SUVs and see directly the heights and where they could have collided, why not do the tests with the actual cars?

Why spend thousands of dollars creating false and inaccurate images ?

Welcher had 0 alternative hypotheses in mind. Started with a solution and worked backwards. He can’t show one piece of evidence that he pursued any alternate hypotheses.

Alessi is bringing up what I said yesterday - the importance of ‘showing the math’ (I called it a proof) associated with the application of various hypotheses.

Wasn’t that what voir dire was about this morning? Hank didn’t want it discussed. He said it’s irrelevant because trooper Paul isn’t a witness in T2… even though Welcher basically recycled major parts of Paul’s report.

It's clear that Welcher didn't do much of what he is testifying to and that others did the actual work while he is trying to put it all together. That's why he insists on looking at his computer all the time, which would have his notes. This is why he's having such a hard time as an "Expert". He's lost without his notes on his computer files.
