Hard to reconcile this decision with the idea the Judge is biased or corrupt.

She could easily have kept these out, but did not because she made the decision on the merits as she sees them. Brennan could be justifiably miffed with the decision.

Absolutely key decision for the defence as it seems they are scared to call Proctor for some reason.

Let’s not pretend this one decision suddenly makes Judge Cannone a pillar of fairness. The only reason Proctor’s “no nudes yet” text got in is because the defense pushed hard and public pressure made it impossible to keep ignoring. She didn’t do it out of principle, she did it because she had no other option without looking completely compromised.

I don’t know if I would say the defense is ‘scared’ to call Proctor, as much as they have a strategy to address his behavior without opening him up to cross. If you’ve already shown the jury that the lead investigator was perving through the defendant’s phone and joking about it while her boyfriend was dead (on the taxpayer’s dime I might add) why waste time putting him on the stand and giving him a platform to spin it? MOO

Proctor himself is definitely NOT the cornerstone of the def -- the def is based on the fact that an expert examination (by ARCCA, elite in the field) clearly proves the damage to the car/tail light are NOT possible via JOK at all, and the damage to JOK is not from a vehicle.

The presence of the tail light pieces must be due to someone tampering with the scene. They don't need Proctor himself - and in fact, he'd just deny it and make excuses - for the rampant sloppiness and inadequacy in investigating, in securing the scene from tampering, in keeping collected evidence properly where it can't be messed with or contaminated, and so on. They've already obtained lots and lots of testimony about all that.

Proctor testifying puts a face to the monster. Without that, its left to the jury's imagination. It's impossible to say who that helps.

They'll still flesh out his incredibly bad texts via those he texted with, showing extreme bias and a primary central investigator out to get KR, making it clear that IF he didnt do it personally, he would very likely have looked the other way to let others do so.

Personally, I've thought that the failure to call Proctor was a mistake by the cw. Without him they have no actual explainer for his misdeeds that were significant enough to get him fired. And the def can (and has, and will continue to) otherwise get his misdeeds into the jury's presence, with the jury left aware that the cw is hiding him even though he built THEIR case. Not good.

Kelly worked for CPD as sworn LE. She was a patrol officer.

AJ bringing up the ‘separate’ law enforcement agency contacting Kelly on Aug 9 2023. I hope the jury is taking note of the multiple times this mystery agency has been mentioned..,

And if she rules for the CW is because she is biased and or corrupt?

Isn't it more likely she's just ruling on the merits as she sees them? The Judge has significant latitude on these decisions and certainly does not care what Court TV or Twitter thinks.

One of her main objectives is to avoid any appealable error, which is, I am sure, one significant factor in why she ruled this way. Ditto why she kept out the FBI expert - there is no authority to allow it, and the Judge isn't going to make a novel decision at trial court level in this case.

Proctor is a vile and disgusting man. It is inhumane to make fun of KRs colostomy bag and to refer to her basically as a piece of meat. I hope he never serves the public again by wearing the uniform. I hope his life is a living hell until the day he croaks.moo

Since yb had already brought the texts to light and even read some of them how could she rule to keep them out. They were already in. She gets no credit from me. JMOO

Her attitude is NOT good. She is a BPD officer, have a bit of respect for the process. No idea what she is there to say at this point, but wow, if she "denies" something was said or done, who will believe her?

Very confused with all that’s going on so far as I’m just watching now. Did those texts from proctor get read? Or only some? I thought his friends would have to read them or something
