MOO If prosecution has evidence and that evidence is lost by them, then the evidence of its loss should be entered into evidence and taken into the light most positive to the defendant. Otherwise, police/prosecution will just lose exculpatory evidence.
I don't think it has been established that MSP ever had the missing videos. My understanding is that there were gaps in the video recordings collected from that night. If you can point me to a source, I'd appreciate it.

Depends on how you define missing videos. It sounds like LE (and by extension the prosecution) had evidence of videos, data etc. that somehow became deleted or missing. 🙄

Green testified Karen’s GPS data was deleted from her phone in April 2022, in Proctor’s custody. Library video, Ring video, Sallyport video, Karen’s GPS - all deleted.

Dever's shift ended at 3:45. She wasn't there when the tow truck with Read's vehicle arrived.
I wonder if anyone ever stays late or works overtime at Canton PD?
Tbh that seems a lot more likely than she lied to the FBI because she had a false memory. Jmo

I disagree and probably should have added a disclaimer to my earlier post where I linked LT Gallagher's testimony from the first trial regarding control of the CPD Sally Port doors by the dispatch center/computer. I apologize for this.

First, I believe without a doubt that Officer Dever saw what she recalled in vivid detail and reported to the FBI under oath! She did not misremember anything.

Instead, I believe it was the timeline by the defense (that Dever later compared against her testimony to the FBI) that was in error! In other words, this is why the defense did not further challenge Dever. Dever took advantage of an injustice on the defense... and in my opinion, karma has a long memory.

To be clear, in addition to the inverted Sally Port videos the CW produced for the first time in the middle of the first trial, the defense timeline error was also the result of a gross discovery violation by the CW where the Court failed to remedy the situation -- ruling the CW had no duty to preserve the evidence in secure form (no meta-data, no secure file, etc) and where the defense used unreliable information they could not verify to create a timeline, and Dever took advantage of the defense's error. The Jury instructions to explain the CW discovery violation are yet to be seen.

TBH, I have little confidence this will happen after the Court failed to allow a Motions hearing on the matter pretrial. I had to walk from this case in advance of trial 2.0. The rulings by this Court pretrial were beyond anything I'd ever seen before, and were just too much for me! :eek:
Thank you @Seattle1. I had forgotten this gross and unremedied discovery violation by the CW. And what you suggest here makes sense. Truly the CW's case cannot be trusted in any particular and I agree that Dever's memory was accurate. Smh.

The sallyport is a high traffic area where apprehended people are brought into police custody. I would be incredulous that there are not continuous recording going on, to cover the department from claims for mistreatment and/or injuries that may occur.
Sorry but with the loss/misplacement of evidence, poor handling of evidence. I do not have faith in CPD produced evidence. The reversing of video and sudden jumps of people in videos gives my no confidence.

I read a comment somewhere, that made me go look at the videos that Brennan showed Lucky... it has a different view from a police dash cam that I had not watched before... the comment said you can see where Lucky had to go around a vehicle to plow... I have watched it a few times now and can't unsee it... so... looking to see what you all see....

And a link to when the Brennan starts showing him the videos, I don't see it right away, it's when the LE car backs up that I can see it. And surely the other vehicles are not parked on the grass.

Exactly, it doesn't mean that's when she left the building.

As for Dever claiming she wss threatened with perjury by the defense, well, Jackson quickly put that to bed, along with confirming she had no report to show as proof. Anyways, it shows that what she perceived as a threat is most likely the same warning that anyone else would get.

The bottom line? Her testimony helped the defense because she mentioned several things that the lawyers couldn't. She mentioned the fbi by name, and she kept mentioning the first trial. Now, the jury is full aware of both.

Her last comment about how everything rides on how she testifies. Well... that was a coup de grace. Yes a finishing stroke. Any reasonable person would conclude she meant that she'd lose everything if she didn't play ball with the CW.

In my opinion a total win for the defense.

My question is how the prosecutor has video of various snowplows that morning around 34 Fairview Rd but they did not find a single video of KR car traversing from there to Meadows?

All of those videos Brennan showed came from the dash camera of a cop car sitting in front of 34 Fairview that morning.
I’m sure if there was camera footage of anything in that yard someone would have found it by now.

Family and friends of JOK have obviously suffered greatly over the last 3+ years. It could be devastating to them to see a NG verdict - especially if deliberations are quick.
That being said, I wonder what they’re currently thinking about the case after the past few weeks. They must have doubts. I would at least think that his friends that appeared in the documentary must be having second thoughts.

Exactly, in the minded of JOK’s family a NG verdict for KR would not be justice.
I wonder how the testimony of KK fell on them.
I’m a mom of a son who thinks he has met the love of his life, he is working hard to make a life with her. He think she completes him, and all that. It would take convincing to imagine he is wrong and this women is the devil incarnate- responsible for harming him on purpose.
KK’s testimony to me reminded the world that JOK and KR are regular people enjoying their lives, having drinks, making friends, relaxing- with no idea what was in store in the next five hours.


What has happened that has turned all of JOK’s family against KR?
I saw a clip of JOK’s brother equating Guilty as Justice.
How did you get there? If you know JOK loved her?

I have not been following this case in any detail except for the past two weeks- what am I missing?

I don’t know much about how far snow plows are above the road surface, or how typical it is to plow a street three times in a single night,
I don’t know much about snow scenes period…
so what info is this giving you?

Are you saying someone shoudl be looking for a Ford Edge? I think so too!

- this is after first responders have left and they are investigating?
- it is dark
- it is cold
- there is snow accumulating, but guessing 4-6 inches or is this 6-10 inches?
- the yard is not as massive as it looks in some pics
- whoever parked the two cars there didn’t seem to realize a car had been there for the snow plow tracks to have to go around

Where are the first responder tracks- could those be them?

You have been listening to Brennan for too long and eating the crap he is dishing out. It is very, very standard for an attorney to meet with a witness prior to testimony. It is also very, very standard for an attorney to meet with an expert before trial. One thing that is usually discussed is court protocol. They talk to and instruct the witness to answer yes or no, do not expound. They also go over questions likely to be asked; one reason is so that the attorney isn't surprised by the answer given.
Respectfully, we don't agree. IMO, there's a fine line between meeting with a witness and talking or manufacturing what the witness says on direct to your questions. Using a highlighter to mark a witness's work to make it known what the witness should testify seems very suspect, IMO.

As far as Dr Russell, IMO she was more of an expounder than just a yes or no witness. The way the defense questioned her too, it didn't seem she was told yes or no was what they wanted either, MO. I think Mr Brennan just let her talk as much as she wanted because she wound up giving many inaccurate or contradictory answers and he called her on then all. AJMO

She wrote the report. Everything was her work. Doesn't matter at all that he helped her to move things around and highlight to make it easier and more cohesive to read

She left hours before the Lexus arrived at the Sally port, she couldn't have seen B &H in there spending time with the vehicle, like the defense wanted to insinuate, IMO. The defense never once challenged Officer Dever about it. It stands as an impossibility that she was there when the Lexus was brought in. She was mistaken, as humans can be, and when she realized it she reported it. AJMO

Do you find it strangely odd that the only missing time from videos appears to be times when one might have seen, or not seen, evidence of what actually happened? One missing video, say, of KR passing the library, sure. Things happen. Systems glitch. Sally port missing video? Neighbor retired officer erased video? How many odd coincidences does it take to really wonder what’s actually happening here?

It’s wild to assume she actually left when she “clocked out”. Let’s say she did indeed clock out at the time she says she did (did they present any actual evidence of this? or are we taking her word for it?). Do we have any proof that she actually LEFT the police station when she clocked out? Do we have proof she didn’t return at some point to see what she says she saw?

What is a logical explanation for her “misremembering” IN VIVID DETAIL what she originally told the FBI?
