Sounds like the defence want to abandon the cellar theory in favour of the garage - and thus John going up and down cellar stairs because the jury was never going to believe it was consistent with the phone location and battery temp data.

That would also appear to concede that the defence also believe the last 36 steps are John's final steps - which means he was with Karen in the car until 12.31 approx.

I guess the theory is John leaves the car and goes in the garage while Karen reverses at 24mph. This is of course inconsistent with Karen saying on video she saw John go in the house.

Shows how much pressure Brennan has applied.

Is prosecution's last try to convict be with screwed up jury instructions? I did not pay attention when they debated them. But, can judge change them now?

All these calculations are being done to show that Brennan saying everything was 26% more on Friday was wrong.

Brennan back... he asked if he spoke with the defense over the weekend. He told them he was going home for the weekend, let them know last night he was back.

IMO it’s becoming increasingly hard to ignore how uneven this trial has become. Defense witnesses are subjected to voir dire, with their testimony limited or scrutinized in ways we haven’t seen applied to the Commonwealth’s witnesses. Meanwhile, rebuttals are being allowed for the prosecution. even when the related defense testimony was objected to and struck from the record. Just bizarre. Take Brennan’s rebuttal on ARCCA. The defense wasn’t allowed to explore Dr. Welcher’s methods in detail, and yet the prosecution will be given the chance to discuss testimony the jury was told to disregard. There’s a difference between fair trial procedure and putting a finger on the scale of justice. This isn’t about which side you believe, it’s about whether both sides are being given the same chance to present their case. And right now, it doesn’t look that way, at least not to me.

The actual weight of JO's arm is an estimation as it was never actually weighed so all estimates are just approximate.

I could be wrong... but I thought that in Trial 1 .. the 11.8 came from ARCCA's testimony about his weight and percentage of his body weight of what the arm is going to be? anyone else remember?

How do you square her reversing at 12:31 a.m. with BA testifying (in T 1) that BH didn't leave until around 1:30 a.m. and BH testifying he parked his Jeep near the mailbox?

The CW are under no obligation to disprove every piece of speculation the defence can come up with. The data shows the high speed reverse and the defence agree its proximity in time (and thus place) to within seconds. The only person who can confirm exactly where the reversing started from and finished is the defendant - but she is falsely claiming on video that she did not reverse.

I also note that BA and BH have not testified in this trial.

Brennan is nitpicking mass calculation. Dr Wolfe points out Welcher made the same mass calculations.

Brennan keeps asking if he has a study or paper that supports using the crash test dummy.

It was Rescue Randy who had his arm stuck out straight like a hitchhiker:

Also the Lexus did not drive straight in reverse. There was a slight leftwards steer.

There was a 4 degree turn in steering. That’s nearly straight. Yes, taken from Welcher’s slide.
