How would it have CERTAINLY slammed it's head on the ground? It could have been flung back and landed knees first, hands first, hands and knees first, feet first, back first. There's about 20 different options that wouldn't include "slamming the head on the ground"

ETA: None of these options matter because he wasn't hit by a car. JMO
MO, if the dummy wasn't suspended it would have been propelled outwardly from the force of the contact. It was only the tether that kept it from doing so. That test was a big eye-opener for the jury into what actually happened to JO. AJMO

The defense wants the jury to know exactly what just happened, the judge is inclined to do that...

he is making his argument for mistrial with prejudice now...

(but we know she will never grant that.. for any reason)

IF the defense is allowed to make this clear what just happened with the sweatshirt... wow.. doesn't that just make the CW look really really really BAD????

The judge loathes Alessi.
He is saying there are no holes in the back of the sweat shirt - the only thing is the cuttting from
the med techs and hospital - and that Mr Brennan knows that
JMO
And defense ALWAYS so police to this judge!

I'd really like to see more lawyers comment on the bias shown by this judge. Including her sound effects.

it should be noted... that the Judge AGREED with Alessi at first glance of the photos.

They are now looking at all the photos together with the judge.
This has to be absolutely unbiased as far as judge in this moment. The jury is watching. No more big sighs to Alessi please. B's sleezy moves keep piling up and plain stupid arrogance. How does he plan to get out of this. IMO

So Brennan 100% knew the source of the cuts. There’s a chain of custody that describes them.

Asking if Wolfe has ever done this before... Wolfe making it clear that he has never tested an arm hitting a tail light before.

I don't imagine this comes up often and most of these companies are always doing testing on unique circumstances in each case IMO That is kind of what they do LOL
Wolfe tried to tell Brennen that this was not his expertise and that Dr R would address that as it is his specialty. They work together.

Betcha when Dr R gets crossed Brennen will twist Dr W words.

Alessi: ‘What could be more egregious, what could be more misleading, than that?’

On a superficial level, yes, the video of Test E looks very similar to what the CW have described happening in the pedestrian strike. Almost chillingly so.

But with a proper analysis of the damage the test shows very different damage to the interior of the taillight which doesn't match KR's Lexus and also no damage to the sweater, which the CW are claiming was pierced by taillight shards.

JMO
The weigh of Rescue Randy and JO varys close to 40 pounds. It's very odd a 50% crash dummy was used when a 95% (which is what JO was calculated to be) was available to use for the test, but wasn't. JMO

we've come to the manufacture of evidence.... according to Alessi...

I would agree. JMO

Alessi says the CW is trying to create ‘specters’ of evidence where facts don’t support it, and now the CW has fully manufactured evidence with this hoodie fiasco.

could you explain to me why Dr. Welcher used the same 50 percentile dummy in his testing?

Well, that’s fine, because *checks notes* he was a CW witness!

Some day I'll have a disappearing hairline/ Some day I'll wear pyjamas in the daytime!
I am there right now!! Why change from a t-shirt and knit bottoms to another t shirt and knit bottoms????

Does Brennan want a ms

So far she is listening politely to Alessi -

Alessi starting from the criminolgist and the hoody
Criminologist cuts the holes
Brennan knew that
Brennan leading the jury to believe tha those holes were from road rash
Hugely misleading to witnesses
its intentional
And goes to the key issue of if there was a collision
Comes days after Commonwealth raised the dna on the sweatshirt
Why is this occuring
CW has no case
CW is desperate and manufacturing evidence
Inferring Wolfe did not do his job
Irrefutable evidence ( and none of the exhibits are in evidence by CW that go to this topic)
How do you remedy this in front of the jury
MS Read entitled to a fair trial
antithesis of a fair trial

all per ALessi
