states German police are missing forensic evidence- yes we know.
But that they have physical evidence MM is unalive- what is physical evidence but not forensic evidence- I assumed photos?

Which CB could say he acquired elsewhere.. hence the missing forensic evidence
To convict securely.
But acquiring photos would be enough for criminal conviction- even if to buy time.

I’m confused on what the definition of physical Evidence MM is unalive could be? Anyone know of another case this was stated?
No but it’s probably the same as “concrete” which covers written or taped confessions - digital or otherwise, witness statements etc.

Given the careful word choices of the prosecutor and lack of charges being laid it’s almost certain there is no hard evidence like photos or videos.

The 2020 appeal was to put meat on the bones of circumstantial evidence which seemed plausible but is looking increasingly unlikely given no hard evidence has come to light… probably less plausible today than five years ago but that’s just my opinion.

Wouldn't thay depend on what the photo showed ? Its not an offence to have a photo of MM - I've have several myself over the years.

This part is the bit that keeps me circling.
What (other) physical evidence could they have to prove MM is unalive, that isn’t photos or video.
Witness statement isn’t physical evidence.

It must be ‘evidence’ that *could* have been acquired elsewhere… emails? Letters? Digital footprints.

My question is what other examples could physical evidence classes as? If anyone knowa any threads this has been previously discussed and can direct me I’m happy to self research!

AI suggests this; which if true suggests it’s DNA or evidence they can submit to forensic anaylsis- that either hasn’t already been and failed to link (possible with previously tested items we don’t know of, which provide the physical evidence but no forensic link), or is new evidence piece that is able to be forensically tested- ie what they hope to find at current sites.

All this talk suggesting it might be they're looking for pyjamas or material / fibres from for instance , surely the most reliable method of disposal would be to burn anthing like that .

Yes. It’s possible that soil samples, fabrics & any objects removed for testing may take a while to get results back for.

It’s Interesting if they have protected 2 witnesses! It sounds like a measure to safeguard them for whatever the Germans predict will happen in the near to mid future.

If the searches fail I still have the impression there’ll be some action soon. If a witness has put him in the area that night then I think we’ll see charges in the coming months.

That would be a good legal solution, provided it was based on the report of more than one psychiatrist.

Yes - yet ‘second opinions’ rarely requested if one gets the news one wants. The damning assessment from the court psychiatrist feeds in to this 😉

I feel a bit for the residents of PDL - there has been a cloud of pressure on that area (even when searches aren’t being made) since 2007. Blame is extremely easy to attribute with the benefit hindsight but it doesn’t make things easier for those people now.

I don’t think forensics, or as CB puts it “traces”, will ever be found unless CB confesses. And at this current time that will only happen if he’s in for life. A successful appeal in one or the rape cases would be the only way to make this happen. But the prospect of either thread of the appeal being successful are low.

However, he’s a serial non preferential offender with a history of sex crimes spanning several years. As the court psychiatrist pointed out, the likelihood he’ll commit another sex crime is very high. When that happens, if they can get him behind bars in Germany then they’ll get that confession because they’ll leverage a better prison for a confession. CB would take that deal because it would be in his interest.

Eventually this will all happen, it’s just a matter of whether it’s soon or whether it’ll be years from now.

Understand and agree with your point, but curiously, if he, in fact, gets free, maybe his confession will arrive sooner...(?!)
Several will try, but there may be also a high risk of him being eliminated quickly.
