If he will get the ankle tag, he will be wearing it only to September 17 when his sentence ends. After that he will be a free man and tagging him will be illegal.
So he'll be on a kind of probation, we never get the full facts.

Is there really nothing legal they can do to try to protect the public? I thought there was something in Germany for offenders who are considered unusually dangerous. Or would that have required a new conviction?

Wondering the same thing ...

Is he unusually dangerous, or is that media hype ?
I feel there must be hundreds, maybe thousands of similar men moving about freely.

Quite, he's only known because of his alleged link to the MM case.

Braunschweig public prosecutor's office applies for an ankle bracelet for Christian B.

Christian B. is expected to be released from the Oldenburg correctional facility on September 17th. If the public prosecutor has his way, he should then be placed under management supervision.

Christian B., suspect in the Madeleine McCann missing persons case, is said by the Braunschweig public prosecutor's office to wear an electronic ankle bracelet if he is expected to be released from prison on September 17th. According to SPIEGEL information, the investigating authority has submitted a corresponding application for supervisory supervision, which the Hildesheim Penal Enforcement Chamber is scheduled to decide on on August 29th.

Christian B. is currently serving a seven-year prison sentence in the Oldenburg correctional facility, including for raping someone 72 year old American in Portugal. As the public prosecutor's office confirmed upon request, after his release he should also be obliged to choose a permanent place of residence and not to leave Germany without the consent of the management supervisory authority.

Hearing in Hildesheim

According to the public prosecutor's office, before the chamber decides on the application for supervisory supervision, Christian B. should be heard before the chamber in Hildesheim.

The Braunschweig authorities accuse the sex offender of being three years old Madeleine McCann Kidnapped and murdered in Portugal in 2007, which he denies. The investigation is ongoing. Last year, Christian B. was on trial for several sexual offenses. He was acquitted.

As part of the management supervision, Christian B. should not be allowed to stay in »certain places« after his release that could »offer him the opportunity or incentive to commit further crimes«, according to the two-page application from the public prosecutor's office dated August 5th, which is available to SPIEGEL. He should also have to report to the management supervisory authority or probation service at certain times. According to the application, he should immediately report any change of place of residence or job to the supervisory authority.

One point in the paper is surprising: the Braunschweig investigative authority wants that Christian B. is obliged »not to enter the circular prohibition zone around the place of residence of the injured party«. The authorities do not write who this means. The American Diana M, whom he raped in her apartment in the Portuguese Algarve in 2005, cannot be. The then 72-year-old victim has since died. »This requirement therefore makes no sense at all«, says Kiel lawyer Friedrich Fülscher, who represents Christian B.

Former BKA employee paid fine

The expected release of the suspect in the McCann missing person case on September 17th is possible because a former BKA employee has transferred a fine of 1,447 euros to the public prosecutor's office. B. himself couldn't raise the money. It comes from previous convictions for, among other things, bodily harm and forgery of documents and was commuted to a substitute prison sentence of 111 days.

The criminalist who was involved in wiretapping technology at the BKA contacted Christian B.'s lawyer and told him about surveillance of B's cell, which in her opinion was unlawful. Regarding the payment of the fine, she told SPIEGEL: »I assumed that it was about insulting law enforcement employees, which I didn't think was justified.« She later demanded her money back from the public prosecutor. It was a misunderstanding, she told SPIEGEL.

But she has now also revised this statement. »In the meantime, the woman has announced that everything should stay as it is. This means that she now wants the money to be used as punishment for forging documents«, said the Braunschweig public prosecutor's office. This means that the fine has been settled and release from prison could be considered on September 17th.

that the Prosecutors are applying for an ankle tag suggests that they are not intending to charge him with anything in the near future.
Nor do they expect him to stay in prison beyond his release date as a result of their trial appeal.

I do hope the court proceeding are reported without the usual media hype.

Is the Braunschweig Prosecutor Office feeling all right? They have absolutely no legal basis for their requests.

Personally I think they are reduced to trying anything

You believe there are hundreds, or maybe even thousands, residing in Germany, who have actually committed the level of violence he was convicted of? (Victim first initial D. case.)

Germany has a population of over 83 million, so why should it be surprising if they have many hundred violent criminals who are not currently in prison ?

You sure ? according to the BZ below, bit pointless tagging someone if they are allowed to leave the country.

Briefly explained: This is how electronic ankle bracelets work

Electronic ankle bracelets transmit the position of the carrier and are used to monitor the stay by authorities. Their use as part of so-called management supervision has been possible in Germany since 2011 if, in the opinion of the judiciary, there is a risk that legally convicted perpetrators could commit further serious crimes after being released from prison.

No mention of trying to keep him under surveillance whilst awaiting the outcome of the alleged appeal, was it ever launched, Or pending charges in the MM case.

The tag would provide a degree of surveillance as to where he was, provided he was momitored in real time. Anything else would be pointless.

Doesn't exactly say when it's to be shown.

Madeleine McCann suspect Christian Brueckner focus of chilling new ITV documentary

Madeleine McCann: The Search for a Suspectwill ultimately pose the question: ‘What does justice look like when the threshold for criminal charges isn’t met, but evidence against a suspect remains potentially damning?’

An ITV documentary will profile Madeleine McCann suspect Christian Brueckne, as his potential release from prison nears.

I hope it is presented in a balanced way and the issues dicussed sensibly

Not all convicted of it, though, and he was. I maintain he is known to be unusually dangerous and should continue to be held or at least monitored.

How would you know ?

At least come the middle of September we'll know what the situation is.

They actually sound a bit bonkers and as if they've lost the plot. I very much doubt the court will give their 'concerns' time of day.

They had every opportunity to charge CB and put their money where their mouths are. They failed to do this and now seem to be failing to grasp that a completed prison term - we're not talking about early parole here where conditions could be applied - grants CB the same rights as any other 'full-term' prisoner upon completion of their sentence.
