For the fourth time: the evidence used in ex-gf's daughter trial did not come from the factory batch.

This is correct. The timeline makes it almost impossible. However, there were (I think) 129 images on the Casio Elixim camera used in that trial - Magdeburg. if the box factory USBs also contained these images, it may be possible legally to argue the evidence has previously been used.

Please take another look at the image. Are they stockings? Could they be male underwear? Is the image cropped? If not cropped, why is the frame specifically used to emphasise the scar? It’s very difficult to say but it’s definitely not clear-cut that he was cross-dressing.

It’s straightforward why they didn’t get a conviction; there is no direct evidence. Scar or no scar, HaB wasn’t certain what it was. Ultimately, the case was built solely on HaB’s account of an attack the occurred in the dark 20 years ago. Doubt without any certainty to support it.

Perhaps instead of - cropping, underwear style, whether they are stockings, male/female underwear, whether he was crossdressing, why they zoomed in, the darkness of the room & the year it happened - that actually it’s the simple answer & the victim is right - he has a mark where she said he had a mark?

Then remember that the judge made this evidence inadmissible.

He was cross-dressing alright! According to reports from the box factory where he was shown in sexual acts on his own. The cropping is from the Sun to emphasise the scar.

I’m not arguing, it’s my point that the medical report was inadmissible due to it being compiled and used in evidence at the 2016 Magdeburg trial - this makes sense.

re. issue of Law saying evidence cannot be used more than once ..
Perhaps that was put in place for a good reason .. but .. is it always a good thing , that is in public’s interest ?
If that’s the law .. maybe the law needs updated .. made more flexible in certain cases.
I recently watched the series “ I Fought the Law “ in UK , about Ann Ming getting Double Jeopardy law updated in the UK , connected to her daughter’s murder .
Despite many telling her this and that would not be possible , her tenacity led to a major change in UK Law .
Perhaps something like that needs to happen with this “ can’t use same evidence again “ rule .. am sure there are many cases where it would be a perfectly sensible idea to use damning evidence more than once .. imo

We went through this in 2020 when the information first came to light. I can understand challenging evidence but it’s accepted by most of us in here that CB wore stockings in some of those pics, especially when it was stated on a Spiegel docu back in 2020.

I get what you mean, but for me, having already been made aware in 2020 that he wore fishnet stocking's, the Sun docu corroborated this with the pic.

Eta: according to this document: most of the files showing child, infant, adolescent sexual abuse are known to the police.
Also, some of these files are metadata from the casio exilim EX-Z850, already secured by Braunschweig.

These are about the 8000 files stored in the usb sticks found under the dog.

Thanks to the sun though we know they have much more from the box factory - including a laptop/hard disc.

Thanks. I was just struck by the volume of different counter arguments you raised. I don’t understand why people believe inadmissibility proves a witness wrong or that it invalidates the fact that CB has a scar in the area the victim described.

The box factory evidence which proves HeB's account was rendered inadmissible.
How can the prosecution trust that the evidence they have will not be thrown out of the court??
That is why the MET can hopefully step in.

Yes - the judges decision to not allow that evidence was absolutely appalling.

Some on this thread have been favourable to CB speaking to the press. Although I think he’ll only ever want to talk about himself, this man has no impulse control. So, I hope that he does talk & is press by an interviewer.
