Opening statements just wrapped up. The State’s Atty walked jurors through the case, calling this “a mother’s worst nightmare.” She says Rachel Morin went to the Ma and Pa trail around 6:58 and she stopped responding to texts from family members shortly after that.

They said data from her watch and phone show sometime between 7:04 pm and 7:10 pm that night she was killed. Her body was later found brutally beaten in a storm drain.

Cause of death was from strangulation and blunt force trauma. Extremely severe head wounds. The Sheriffs’ 10-month investigation later led them to Victor Martinez-Hernandez. The SA says there is evidence he was living in Maryland at the time of the murder.

They were able to track down DNA evidence from clothes and other belongings from family members he lived with for a period of time in PG county. That DNA according to the prosecutor matched what they found on Morin.

After Victor was tracked down, he was later arrested in Tula, OK. The SA says investigators found photos of Morin and web searches related to her and her death on his phone. They said he claimed he was “never in Maryland.”

However, they said they got more DNA from him which matched.

Next up: the Defense. Victor’s defense atty spent a lot of time talking to jurors about being fair and impartial. He said Victor was not the man who committed the offense.


At one point the defense mentioned that Morin “attracted male attention,” sometimes unwanted. He said she met her boyfriend on the trail and the news of the two dating was unwanted news to others.


The Defense atty poses several questions: What is the motive (says this was a crime of passion), asks where the connection between Victor and Morin, and where is Richard Tobin’s DNA (Morin’s BF) who they say admitted to having sex with her the day she died.

We will hear testimony when this recess ends.

We just took a break for lunch but we heard from Morin’s daughter. Had very emotional testimony crying on the stand when recounting the events of the day her mom went missing.

We also just heard from her boyfriend Rich Tobin. He said when Rachel stopped responding to texts she got worried, went over to her house and then went looking for her on the trail and nearby restaurants. He called 911 when he couldn’t find her.

He said he talked with police that night, even went to the police station to talk with them after trying to search the trail. When he later found out Morin died, he said he “freaked out” and “screamed,” and “cried.” He said he provided police with his phone and DNA when asked

Morin’s family was in the packed courtroom today. Court will be back in session at 2:15.

Since Martinez-Hernandez had photos and did web searches related to Rachel on his phone, I wonder if LE found any web searches related to the CA incident on his phone.

It's no doubt the searches were done to see what information LE may have had on a suspect in Rachel's murder. It would be reasonable to think he would have also done searches to see if a suspect was named in the CA case.

Witness No. 5: Evan Knapp, who took part in the search for Morin on Aug. 6, 2023, and found her body.“I feel like time froze for a second,” Knapp said. “It’s just kind of hard to really know what I was feeling.”He said he felt stuck, adding that he was in shock.

Morin’s cellphone had been smashed. Her Apple Watch had also been destroyed, Healey said.

Martinez-Hernandez’s family members provided detectives a photo of him, a Facebook profile and a phone number that he’d used to contact them, Healey said. They reported that he’d suddenly taken off and left behind some of his belongings.

DNA recovered off his socks was consistent with genetic material found on Morin’s body, Healey said.

Investigators swabbed the inside of his cheek for DNA. It matched genetic material recovered off Morin’s body, Healey said.

Healey said the evidence includes photos of a 150-foot blood trail through thorn bushes, bloody rocks used to bash the victim's head, a bloody outline of the victim's body on the wall of a culvert where she was "left to die" after the defendant raped her between 7:04 and 7:10 p.m.

Healey said a timeline was formulated from heart rate and other data recovered from Morin's cellphone, AirPod and Apple Watch.

At the beginning of the day, the judge dismissed the first alternate juror for unknown reasons. There were also other discussions with two other jurors, though it's unclear why.

Five alternate jurors remain.

Court resumes Monday morning at 9:30 a.m.

Harford County State's Attorney Healey has been calling for the maximum sentence if Martinez-Hernandez is convicted, according to a court filing in July 2024.

The maximum penalty is life without the possibility of parole.

"Since Maryland doesn't have the death penalty anymore, life without parole is the most serious consequence you can face in the criminal justice system," Morin Family Attorney Randolph Rice said.

IIRC, Genealogy DNA led investigators to his family. The family then gave them clothing from him which positively matched DNA found at the crime scene.
Investigators traveled to El Salvador, found family there, who pointed them back to the home in Bel Air where he had been living. Correct? Now I need to go back and verify that.

The defense’s opening statement was kinda silly I thought, especially the part where it is implied that the defendant could not be guilty since there was no evidence he and RM knew each other.
Yea, because women are never attacked by strangers, raped and murdered.

Clearly the defense doesn’t have much to work with. Further he just highlighted the very reason his client is guilty. How did his DNA end up at the murder scene? Can’t wait to hear the explanation …

DNA and serology experts Tiffany Keener and Carley Chwal are among the nearly 70 people on the state's witness list slated to testify.

Also expected to take the stand this week is digital forensic expert with the Harford County Sheriff's Office Megan Waltimyer.

Doctor Zabiullah Ali, who has performed more than 9,000 autopsies in his career, and Dr. Roa Alqabbani with the Office of the Chief Medical Examiner will also provide testimony about Morin's severe head and neck injuries from strangulation, that ultimately led to her death.

Also potential witnesses include Patty Morin, Rachel Morin's mother, and Tania Hernandez, the defendant's cousin.

Both the state and the defense agreed the photos should be shielded from public view. The judge is making a decision on the matter. Randolph Rice, an attorney representing Morin's mother, Patty Morin, said seeing the evidence provides some closure, of sorts, for the relatives.

"I just noticed they were crying a little bit, and they certainly, some of them, it's tough for them. Some of them, they can't look at (the evidence). The others want to see because they want to get through this part of the grieving process of seeing how bad it was, and now they have some, I guess, security or knowing in their mind exactly what happened so they can move past it,"

Wilsynski explained that a vast amount of evidence found inside the tunnel near Morin's body included an Apple AirPod, a cellphone, and a lot of blood.

Photos of Morin's battered body shocked the courtroom, even leaving members of the jury wide-eyed.

Defendant Martinez-Hernandez remained stone-faced as Det Wilsynski explained the bruises, bloody face, drag marks, and fly eggs already found on Morin's body.

According to Cecilia's testimony, she and Evan veered off the main path. They found a bloody rock and got closer to the tunnel when Evan went closer and saw Morin. Cecilia says Evan was “distraught,” “in shock,” and “quiet” following the discovery.

She and Evan helped direct police, later giving their statements and even bringing deputies their shoes.

On a 911 call played in court Monday morning, Occorso was hysterical, breathing heavy, weeping and frantic. She said she almost threw up and passed out. Jurors sat wide-eyed and motionless as they listened to the call, and family and friends of Morin wiped tears from their eyes. A woman behind Patty Morin, Rachel Morin’s mother, put her hand on her shoulder to comfort her.

The defense appears to be trying to suggest that Morin’s boyfriend could have been involved, pointing to her smashed phone and suggesting it was evidence of a crime of passion.

Rice said the attempt is likely to fall flat based on a lack of supporting evidence.

There was no DNA left behind from the boyfriend, who she’d been with earlier that day,” he said.
