2. Two witnesses heard a woman scream before shots were fired.
3. Two other witnesses heard shots and then a woman scream, followed by more shots.
4. Pistorius's online activity at home undermines the picture of a loving couple spending time together. On Valentine's Day.
5. The number of shots, their grouping and their trajectory indicate Pistoritus intended to kill the person behind the closed bathroom door.
6. The position and condition of the gun in the bathroom.
7. Pistorius got a gun and shot through the closed door without finding out who was behind it or whether or not he was in danger.
8. Steenkamp was clothed when she was shot.
9. Steenkamp was standing upright facing the door when she was shot.
10. Steenkamp had something to eat hours before she was killed.
11. The presence of the cellphones in the bathroom militates against a version that Steenkamp innocently went to the toilet at the time.
12. The fact and the way in which Pistorius broke down the toilet door.
13. Pistorius's version 'is not reasonably possibly true and it is our case that if rejected by the court the objective facts will prove the murder with direct intent of the deceased'.”

Pistorius’s version of events is not reasonably true and if rejected by the court, the objective facts will prove the murder with direct intent of the deceased.

Gunshot while RS standing upright, fully clothed and facing toilet door

Several more shots were fired at a distance greater than 60cm from the door – a figure closer than the 1.5m originally estimated by police.
Intention to kill was amount, grouping and trajectory of shots fired at door.
Security on the estate called OP to check on his safety to which OP allegedly replied everything was fine
OP he did not report the shooting.

*Testimony of Hilton Botha was now irrelevant as prosecutors would rely on forensic and ballistic evidence.

*During OP’s bail application, the State alleged he had put on his prosthetics believed OP was in fact on his stumps when he fired the shots. Associate professor from Wits Law Clinic, Stephen Tuson, said he did not want to speculate on the document before it had been formally submitted. He said the defence could question why prosecutors had changed their version of whether he was on his stumps. He said the State then could argue that their investigation had not been completed at the time they submitted their version during bail application.

1. Scottish-born businessman and former Rangers football club director Dave King, who risked jail for ignoring the country's biggest-ever tax bill of R2.3 billion and faced a lengthy jail term. After a 13-year court battle, the case ended in what some observers described as an anti-climax, with the court ordering King to pay the far smaller amount of R700 million in revenue owed.
King co-operated with the SA Revenue Service, escaped jail and maintained that profits he had made on selling shares were perfectly legal and of a capital, not a revenue, nature. The case potentially had vast implications for the rest of South Africa's rich if the question of capital and revenue profits went all the way to the Constitutional Court, but the settlement Roux negotiated meant it never landed there.

2. Former JCI chairman Roger Kebble on charges of tax evasion, which were withdrawn in 2007 because the State lacked evidence.

3. General Lothar Neethling, who sued Die Vrye Weekblad newspaper over claims he had supplied former police captain Dirk Coetzee with poison used against anti-apartheid activists. Neethling failed in the high court, but the appeal court overturned Judge Johann Kriegler's decision and ordered the paper to pay R90,000 plus costs. The damage order and the cost of a five-year legal battle finally forced the newspaper to close.

We had already observed that Sam Greyvenstein was on the Prosecution's list of witnesses last year and some of us had thought that she had given a too-glowing report of Reeva and Oscar's relationship to help to get him off on bail. Now she has changed sides but she must have done that last year IMO. I had been hoping that both Sam and Divaris would come clean and tell the truth at the trial.

REEVA'S MODEL CHUM CHANGES TUNE

A South African model could become one of the major players in the Oscar Pistorius murder trial.

The TV channel said Pistorius’s prosecution had evidence that would help prove premeditation in the murder of RS.

Apparently, she could have changed her mind about him.

At the bail hearing, she said OP had “treated Reeva like gold” and that she had confided she would probably have accepted had he proposed. But the channel claims to have proof she was now feeling very differently.

They also claimed the State had evidence that OP’s actions had shown:

*aggression
*reckless use of firearms
*extreme possessiveness of RS
*he kept his IPad and cellphone close, even when he went to bed.

I am so pleased that Sam has a conscience and has decided to tell the truth at last as she introduced RS to OP in the first place so she would know a lot about their relationship.

I wonder why she lied at the bail hearing? Obligation due to Divaris?

The Sunday Times reported that through data retrieved from Pistorius's cellphone, which was found on the scene, the State discovered the athlete was browsing 🤬🤬🤬🤬🤬🤬🤬🤬🤬🤬🤬 and used-car websites. This would form part of the State's evidence, according to the report.

The newspaper reported that in a reply to the defence, the NPA said in court papers: "The accused's website activities from the time they arrived home at 6.10pm is in direct contrast to that of a loving couple spending time together."

WHO LEAKED THE PROSECUTION'S CASE?

The NPA's case was leaked to sections of the media this week, and questions were raised over which side stood to benefit from the revelations.

NPA spokesman Nathi Mncube denied emphatically that the leak came from the prosecuting body.

He said he could not speculate on whether this would have any effect on the trial.

A top lawyer, who does not want to be identified, said both sides could have benefited from the leaks : "For the state, the leaking of it could take the sting out of some of its shortcomings in its case . . . let the public know now what they don't have.

"And if it was the defence [who leaked it], it could put pressure on the prosecution and even witnesses at this stage to remind them their every move and action will come under scrutiny."

Oscar Pistorius team sets up Twitter account

A Twitter account called @OscarHardTruth has been set up by the media management team of murder accused Paralympian Oscar Pistorius.

“This platform, along with the website, will become the key outlet for information,” spokesperson Anneliese Burgess said today.

The account was linked to Pistorius’s official website, oscarpistorius.com

“It’s intended to be a factual sharing platform,” she added.

She said the Twitter page would be linked to certain media coverage and would deal with issues that needed clarifying during the star athlete’s murder trial

Here are the 21 questions that need to be answered during the trial.

1. Why did Steenkamp decide that evening not to go out with her friends?

2. What did Steenkamp give Pistorius for Valentine’s Day?

3. What were the death threats that, according to Pistorius's statement, he received?

4. What violence and break-ins had he been a victim of and why did he not, according to the State, report these incidents?

5. Why did Pistorius not realise Steenkamp was not next to him in bed? He slept next to her and walked past the bed again to get his handgun.

6. Had it never happened before that he woke in the middle of the night with Steenkamp or one of his former girlfriends using the bathroom?

7. If he believed that he and Steenkamp were in grave danger with at least one robber in the toilet, why did he not tell her to flee or go downstairs before he confronted the danger?

8. If Pistorius was as scared of intruders as he said in his statement, why did he confront them instead of fleeing?

9. After he had fired the shots and saw Steenkamp was not in the bed, he bashed open the door with a cricket bat. Why did he suddenly know Steenkamp was behind the door, while a minute earlier he was convinced it was at least one robber? Why did he not look to see if she was somewhere else in the house before he broke down the door, behind which there could still have been robbers, according to his version of the events?

10. Why did he at no stage call the police or the estate’s security services?

11. The estate’s security guards called him after the shooting to ask if all was in order. Why did he tell them, according to the State, that everything was “fine”?

12. What is Pistorius's relationship with Johan Stander, the man he called first?

13. Why did Pistorius take the time to go downstairs and open the front door while Steenkamp was dying upstairs?

14. If he was convinced that there were intruders behind the toilet door, why did he drop his handgun? The State says it was found on the floor near the shower.

15. Why did Steenkamp take her cellphone to the bathroom? Why was the cellphone outside the toilet and she inside?

16. Why was the toilet door locked?

17. Why did Steenkamp, according to the State, stand fully clad behind the locked bathroom door?

18. If Pistorius’s version is true, why did Steenkamp not answer when he yelled at her to call the police? Why did she not scream after the first shot?

19. The State referred in court papers to Pistorius's internet activities on the night of 13 February and said these conflicted with the idea of a couple who spent the night together. What did Pistorius do on the internet? The Sunday Times reported he visited several pornographic websites on his phone while Steenkamp was with him.

20. If Pistorius's version is true, what were the screaming and sounds of fighting that the neighbours reported hearing?

21. What had happened in Pistorius and Samantha Taylor’s relationship? They went out for a year and six months, and Taylor had plans to tell Rapport what Pistorius had subjected her to, but she then decided against this. What will she testify about Pistorius?

Beeld on Monday quoted experienced criminal procedure attorney Marius du Toit as saying that he doesn't believe OP will have a choice. Only OP can say exactly what happened that night, and it is up to him to explain why he thinks his actions were not illegal. The State already has prima facie evidence, and if the defence does not offer any other evidence, it will be a proven case.

However, Du Toit predicted that OP's defence lawyers will probably only decide on whether he will testify after the State has presented all its evidence and has closed its case.

Oscar Pistorius doesn’t deserve privacy from the media, writes Chris Moerdyk

Oscar Pistorius made a fortune out of sponsorship exclusively on the basis that he was able, through his status as a sports star, to influence the public.

Guilty or not, the fact that he is now up the creek without a paddle does not mean that he can demand privacy.

One cannot switch celebrity status on and off like a tap. Once it is turned on, it stays on. That’s the way life works.

Then, of course, there is the argument of public interest. Is live media coverage of the Pistorius trial in the public interest

I have had another look at bail hearing notes when tracing the spent cartridge in the hall statement.

The following are a few notes from the bail hearing, one of which I don't recall hearing before, ie that Reeva was shot 5 times. How could I have missed that. Is this just bad reportage?

WO Botha said the shots were fired from 1.5 metres, and that police found three spent cartridges in the bathroom and one in the hallway connecting the bathroom to the bedroom.

Police also found two iPhones in the bathroom and two BlackBerrys in the bedroom, WO Botha said, adding that none had been used to phone for help. Pistorius had said that he called the manager of his guarded and gated housing complex and a private paramedic service.

Mr Roux said Pistorius did make calls, including to the guards of the housing estate.

WO Botha laid bare the facts of the post-mortem carried out on Steenkamp's body. The model suffered five gunshot wounds to her head and neck.
