Pontiac — Prosecutors will be allowed to introduce evidence from the Oxford High School shooter's journal and text messages to his friend during his father's trial, a judge ruled Thursday.

Oakland County Circuit Judge Cheryl Matthews also ruled that one injured Oxford High School student will be allowed to testify during James Crumbley's trial, which is set to begin Tuesday.

Mariell Lehman, Crumbley's attorney, sought to exclude the journal, in which the teen detailed his plans to "shoot up" Oxford High School. She also wanted to exclude texts and student testimony from the trial, arguing it would be unfair to allow the journal entries and texts into the trial if she is not allowed to cross-examine the shooter.

But since Ethan Crumbley is debating whether to file an appeal of his sentence and plea, he has said through his attorneys that if he is called to testify, he will assert his Fifth Amendment right to stay silent to avoid self incrimination. He also refused to waive privilege of his medical records and mental health information...

James Crumbley has pleaded not guilty to four counts of involuntary manslaughter.

Overall, the prosecution has accused James of “gross negligence” for giving a gun to his son, who was 15 at the time, failing to get the teen proper mental health treatment and failing to warn others of the risks despite warning signs.

James was the parent who physically purchased the Sig Sauer 9mm firearm for their son at a gun range, according to receipts. He also was more familiar with firearms and, according to his wife, was the parent in charge of securing the home’s three weapons.

Do you think that Shannon Smith tried to convince Jennifer not to testify? It certainly did not benefit Jennifer to take the stand in her own behalf.

When Jennifer Crumbley took the stand during her involuntary manslaughter trial in February, the mother of Michigan school shooter Ethan Crumbley suggested safe storage of the family's firearms was under the control of one person: her husband, James.

"It was more his thing," she testified, "so I let him handle that. I didn't feel comfortable putting the lock thing on it."

Despite her attempt to deflect fault onto him, as their son used a semi-automatic handgun bought by James Crumbley to kill four high school classmates in 2021, a jury ultimately found her guilty — the first time in the U.S. that a parent was held criminally responsible for a school shooting perpetrated by their child.

I don't think he'll take the stand. It didn't go so well with Jennifer, she made herself look worse and confirmed her indifference to her troubled son. Then again, like Jennifer, what can the defense present if he doesn't testify?

I think if he does testify, it will be to throw the blame on Jennifer; she ran the show, he just did what she told him.

OXFORD, Mich. – Jury selection will begin Tuesday for the involuntary manslaughter trial of James Crumbley, the father of the Oxford High School shooter.

Potential jurors will be brought into the Oakland County courtroom on Tuesday, March 5 to get questioned by attorneys and Judge Cheryl Matthews. The questioning is meant to determine if a potential juror is a good fit for the trial -- meaning they are willing and able to be impartial regarding this specific case.

The process of questioning and selecting jurors could take anywhere from one day to several days. James Crumbley’s trial will begin once all jurors, and jury alternates, have been selected.

As jury selection for this second trial looms, one of the most common questions I’ve received is, “Won’t this just be a repeat of what happened to his wife?”

I don’t necessarily think so.

Sure, there will be similarities. Prosecutors will jump through many of the same hoops to establish what happened during the school shooting, and we’ll probably see a lot of familiar evidence from the shooting range, the high school, and the Detroit building where the Crumbley parents were eventually arrested.

The prosecution’s plan worked last time. They got a guilty verdict. So many of those same tactics will come into play for James Crumbley.

But he’s got a different defense attorney, and she probably learned some lessons from what happened during the first trial...

Legal analysts who spoke to The Washington Post expect prosecutors to approach James Crumbley’s case much in the same way they did Jennifer Crumbley’s.

“This is going to resemble Jennifer Crumbley’s trial to a significant extent,” said Jessica Roth, a professor at Cardozo Law School at Yeshiva University who specializes in evidence and criminal law and who has followed the Crumbley cases. “A lot of the important evidence is going to be the same across the two trials, including the evidence that points to the parents’ awareness that their son posed a danger.”

Critically, jurors in James Crumbley’s case will hear about the text messages their son sent to a friend telling him that his parents refused or ignored his requests for mental health treatment, Roth said

After 300 potential jurors spent the morning filling out jury questionnaires, the first group of jurors have been brought into court for questioning. Likely openings Thursday. (It took two days to get jury for Jennifer's trial)

Some info on perspective jurors.

Of the 15 people questioned in the jury box Tuesday, six had guns in their homes, though one of those individuals was excused by the prosecution at the end of the day. He was a father of eight who said he was not sure he would want someone of his mindset sitting on a jury judging him or a loved one accused of a crime.

The pool of 15 also includes a mother who doesn’t own a TV and says she knows nothing about this case; a man whose cousin was murdered by her mentally ill son; and a 29-year-old man who once served as a juror in a homicide case and acquitted the defendant, concluding the killing was in self-defense.
