Now the judge is saying she is going to throw out all of the child's testimony because she has no recall...:furious:

sigh. That is my fear. She is dragged into court before her father and the world. Made to testify. Put in this untenable position. And her testimony won't even count for anything as it was compromised and therefore useless to the prosecution's case.

The state is fighting hard...but looks like she is getting screwed over by the judge and the defense right now...

The defense asked her some tiny excerpts from a long interview in the attempt to make it look like she saw the baby alive that morning...but they are leaving out all of the staementts where she said she never saw the baby alive...

So now the jury is back and the state is going to try to 'rehabilitate' the witness..

So the state is showing a video excerpt:
" she was asleep so I couldnt talk to her that morning.."

" I heard my daddy yelling..telling at her to go use the bathroom"

Did u see her when she woke up?

[I am not sure that the DT cross did much good. I think the playing of the video which was on the day the baby went missing is very damning to the defense.]

Now they jury is watching ther crocodile tears of the poor Daddy after he watchwes his 8 yr old leave...he is wiping his eyes with his hankie and being hugged by his atty;;;

state: did she ever sustain any injuries during that time?

Yes, it was under her tongue in her mouth...I received a phone call from the school...

Did you ask what happened?

"He said that he asked her to smell her underwear and if she peed on herself..

but he didnt know how she got injured..."

state: was your daughter emotional about it/

"She didnt really want to talk about it...

judge: was her father with you when you discussed this/

" yes, the first time.."

"She said Daddy stuffed my underwear in my mouth.."

state: didu see that sore in her mouth?

" Yes, it was like ripped under her tongue.."

Judge: what did the father say about this?

" Not much..."

Judge: so after she told u that he put her panties in her mouth, you allowed her to stay
with him?

Yes...

state: on dec 3rd were u contacted by the authorities?

Yes, I went to the school to see what was going on...

do u recall a conversation with the defendent on that day...?

did u tell the defendent that u loved him on that day and did he say he loved u...

and did he say he wanted A to come and spend time with him before trial?

yes...

sounds pretty damning to me. What innocent victim of carjacking and kidnapping of one of his children needs to worry about what his other children might say about him that may be "bad."

He seems to be promising Shalay he will get back with her if he gets out...and he says tell A that I love her and miss her and not to be afraid...

and she complains that the state isnt giving her enough money to travel to the state for the girls testimony...and she needs $ for counseling for the girl. saying she needs therapy...
