Jury sent home in Dale Warner murder trial, to return on Tuesday
Dale Warner, 58, is charged with murder and tampering with evidence in the death of his wife, Dee, in Lenawee County.www.wtol.com

After a recess, the court said the jury is being dismissed for the day and will be returning on Tuesday. According to the court, the juror who had the emergency has not been dismissed and they expect her to be back on Tuesday.
The court said the alternates were not given instruction to not watch anything after being released, but now the full jurors, including alternates, are being asked not to view or discuss anything about the case.
Probably the cleanest option.
I just hope the jury are able to begin deliberating on Tuesday and they are able to reach a verdict, more concerning to me is that the alternates who were told they could go were also told not to discuss case or watch media but 3 of the 4 immediately went home and discussed case and some watched media, this put the whole trial in jeopardy as they now need to wait for a juror to resolve their issue and hope nothing else prevents any of the other jurors from deliberating,
It will be a travesty if their is a mistrial due to not enough jurors to deliberate, I doubt the judge will release the alternates so hastily in the future
they were told that, so when the seated juror wasn't available to deliberate the judge called the dismissed alternates back, 3 turned up and they found out that they had not heeded the judges rules and therefore could not be seated, not only does it hold up deliberations for the 11 other jurors it has inconvenienced them, they have to wait till Tuesday to return to begin deliberations,Were they told that? IME alternates have had to sit in another room with nothing to do until the selected jurors reach a verdict. For this very reason, they may need to be called up to deliberate.
I hope the juror with the medical event is able to come back.
If not, even thought a unanimous guilty verdict is all but secured, the Defense would use the mild conversations the released jurors had to push for a mistrial. Reject all three, and there aren't enough jurors left to deliberate.

and I do think a mistrial needs to be declared if the 12 seated jurors cannot deliberate, we have no idea what the dismissed jurors have discussed, what they have researched, if they have seen the clip of the defense arguing for involuntary manslaughter as a charge, as that there is tantamount to an admission of his guilt, and no juror should see that before they deliberate,

The court said last week's issue with a juror emergency has been resolved and the jury resumed deliberations around 9:20 a.m.

What is taking them so long? Do they have to decide upon the degree of premeditation involved?
