After a recess, the court said the jury is being dismissed for the day and will be returning on Tuesday. According to the court, the juror who had the emergency has not been dismissed and they expect her to be back on Tuesday.

The court said the alternates were not given instruction to not watch anything after being released, but now the full jurors, including alternates, are being asked not to view or discuss anything about the case.

Probably the cleanest option.

Agreed. Best practice, original juror remains seated. Hopefully the medical emergency is resolved.

A mistrial won't change his guilt but it will delay justice.

Hoping we can proceed without further issue.

Adrian — Jury deliberations in the murder trial involving a woman whose body was discovered in a resealed fertilizer tank were abruptly postponed Friday until Tuesday.

The jury had barely begun weighing the fate of prominent Tecumseh farmer Dale Warner on Friday when one of the jurors told the court he or she had an unspecified emergency, according to the judge.

Lenawee County Circuit Judge Michael Olsaver considered replacing the juror with one of the alternate jurors, who were dismissed on Thursday. After the alternates were asked if they had viewed media coverage of the case, it was decided to retain the original juror.

The jury began deliberations on Thursday but went home after 80 minutes. The panel didn’t meet on Friday...

I just hope the jury are able to begin deliberating on Tuesday and they are able to reach a verdict, more concerning to me is that the alternates who were told they could go were also told not to discuss case or watch media but 3 of the 4 immediately went home and discussed case and some watched media, this put the whole trial in jeopardy as they now need to wait for a juror to resolve their issue and hope nothing else prevents any of the other jurors from deliberating,
It will be a travesty if their is a mistrial due to not enough jurors to deliberate, I doubt the judge will release the alternates so hastily in the future

IME alternates have had to sit in another room with nothing to do until the selected jurors reach a verdict. For this very reason, they may need to be called up to deliberate.

I hope the juror with the medical event is able to come back.

If not, even thought a unanimous guilty verdict is all but secured, the Defense would use the mild conversations the released jurors had to push for a mistrial. Reject all three, and there aren't enough jurors left to deliberate.

Agreed. They should have had to report to court every day, under the same admonition as the 12, and roomed away from them and each other. In case they might be called up.

Below 12 will be an automatic mistrial, if I'm not mistaken.

Even if all 12 plus the three alternates would have voted guilty.

What a waste of everyone's time, if they have to retry this case.

That said, he won't be less guilty no matter how many times they try him.

LENAWEE COUNTY, Mich. (WXYZ) — Jury deliberations are set to resume on Tuesday in the trial of Dale Warner, the man charged with murdering his wife Dee in Lenawee County.

The deliberations started last week, but were previously put on hold due to one of the jurors having a medical issue.

After the court learned of that issue, the judge proceeded to call in three alternates who had been in attendance for the entirety of the trial, to question them after they were dismissed on Thursday, after closing arguments, to learn if they had seen any news reports or social media posts about the trial, or spoken about it with anyone. All alternate jurors had discussed the case; one had seen a nightly news report about it, and another had seen a social media post.

As this is a Michigan case, I would ordinarily have continued to follow it, but I've had so much going on since this case started that it's impossible to keep up with it. Even if I was not posting, I did read this thread regularly to keep abreast of any developments in the case. Many thanks to those of you who followed it closely and posted updates.

Longer than I thought it would. It's only their first full day of deliberating, but I expected a fairly quick turnaround.

I suppose so, I thought this would be a matter of a few hours, not a few days.

The delay doesn't give me insight into the strength of the State's case; it gives me concern about the character of the jury.

It only takes one juror, sympathetic to the defense/man/DaleW and/or one, unable to understand the principle of reasonable doubt, to upend a unanimous verdict.

I hope that this delay is a reflection of due diligence and not a confused juror.
