Hi Natal,

Could you please clarify what you mean when you say

I took it to mean in your opinion you felt the evidence wasn't there to support sex abuse charges. However, it can be taken to mean you are saying child sex abuse charges are not all that serious. Would you please clarify for us?

Thank you,
Tricia

That was based on the original reports of when and why Venus returned to Michigan. It was supposedly because she had discovered that he was abusing one of the children and she filed a report once she returned. Apparently the prosecutor declined to press charges because of insufficient evidence. When she filed that report LE would have done an investigation, which would have included interviews and such with the children. Any evidence used in the current trial presumably would have come from those interviews. If there was enough evidence to press actual criminal charges they would have done so since that is a serious charge, but presumably either the nature of the accusation was marginal or accounts they got from the children were too vague. In a civil case the standard of proof is lower, so it is possible to make a finding when there is still significant doubt. A civil finding is inherently less serious than a criminal finding for that reason, it is not the same thing. The difference is "it did happen" versus "it might have happened".

The child protection services agent who appeared before the judge would have stated that the claim was substantiated, meaning that in his/her opinion there was some evidence to support the claim, and that allowed the civil case to go forward. However, presumably the evidence was not strong enough to support a criminal charge.

This would explain the earlier no new evidence comment.

That should be interesting. However, that would only break his alibi, it wouldn't place him at the scene. So unless this witness was privy to a plan it might not prove their case. And if the witness was privy to a plan, are they also going to be charged?

When they go to trial it is not going to matter where he wasn't, it is going to matter where he was.

I am going to speculate in addition to finding the 'imposter' some of the forensics will tie Doug to the scene as well. Particularly the tire marks and any evidence from MI that wouldn't be found if the truck was in VA. Of course speculation... but time will tell.

I'm so thankful to wake up to this news this morning. I hope she has been found so her family has answers and she can be laid to rest.

IMO they would not make an arrest without the evidence they need.

I think we've known since the first day this would happen.

It is sad the girls have lost both parents. It's sad DS made the choice to take actions to take both parents away. I'm so glad they have loving grandparents.

If DS really loved his girls, he would not have harmed their mother no matter how much he hated her.

They have lost their mother in a horrible way. I think it is best for them to never see or talk to DS again. He does not deserve the title "daddy".

Is there any word on how Venus' mom and dad are doing? The FB said mom was in the hospital, and articles said LE said dad wasn't feeling well.

ETA: I did check the FB but didn't see anything.

Confirmed -

Douglas H. Stewart, who was arrested Monday, is being held in connection with the abduction and suspected killing of his estranged wife, Venus Stewart, police confirmed this morning.

snip

Risko also said police now believe that Venus Stewart, who was abducted April 26 outside her parents’ Colon Township home, is dead and investigators strongly suspect that her body is located somewhere near the abduction scene.

My hope is now that he's been arrested on suspicion of kidnapping and murder that they will do at least have a localized search with HRD dogs in the area near Venus's home. (I mean since they believe that she's near the abduction site...)

Perhaps there was enough evidence to charge Doug criminally but why bother when they knew he would be charged for murder and kidnapping a few days later? Afterall, Venus disappeared shortly after notifying authorities about the sexual misconduct.
