Child killer Rafferty's slow-mo appeal raises eyebrows

More than two years after a judge urged that school girl killer Michael Rafferty’s appeal of his murder conviction begin “as soon as possible,” lawyers have yet to file a single argument.

Not even the timetable for the exchange of documents, also requested by Ontario Court of Appeal Justice Marc Rosenberg, has been produced.

Rosenberg died in August 2015, but Calarco indicated that was not a factor in the length of time it is taking for the complex case to move to a hearing.

“We’re waiting for this last delay to know whether or not we have to endure going through hell and it seems to have just been forgotten about. No updates to let us know where things stand. It’s frustrating.”

The lawyer representing Rafferty, Paul Calarco, acknowledged the appeal process is taking a long time.

Trust me iam in no way for the guy but from what i have heard he can't get a lawyer to file his appeal no one will take the job...

The lawyer representing Rafferty, Paul Calarco, acknowledged the appeal process is taking a long time.

“Sometimes cases of this nature take longer than expected, but the matter is being pursued,” the affable but cautious Calarco said, declining to provide details.

“I cannot say when the matter will be heard. Cases of this nature will often take a significant amount of time.”

Not sure what he is actually trying to say in that quote though. The matter is being pursued? What matter? :waitasec:

Maybe his present lawyer is just biding time to make it look good; like he's doing the job, ;) He didn't want to rush back too soon to the 🤬🤬🤬 saying, "sorry dude you ain't got a hope in hell with your appeal." PC no doubt is not a stupid lawyer and would have a pretty good handle from the get go as to whether MR had any chance with his reasons for appeal. If he didn't have the knowledge, I'm certain there are numerous other lawyers he could look to for opinions and/or information.

I wonder how much he will end up billing taxpayers for when all is said and done? ;)

The laws regarding the search of phones and computers were in the process of changing at the time of MR's arrest. Separate search warrants for electronics was an emerging issue at the time, not standard practice. LE did not HAVE TO request warrants at that time, but it was starting to be considered. The JUDGE erred on the side of caution in not allowing that evidence because the laws had since change and didn't want to open the door to an appeal on those grounds.

LE did their gruesome, thankless job. As did the Judge. And that is why both MR and TLM are in prison and will remain there.

Supporters and loved ones plan to release purple balloons into the air on Friday evening at Museum Square in Woodstock at 6:30p.m to honour Tori’s life. Purple was the little girl’s favourite colour.

From the same article: His application has been before the courts for over three years, and there’s no guarantee a new trial will be granted.

MR does NOT deserve a new trial, nor do I believe he will get one. He's a monster who abducted, raped, tortured and murdered an innocent and precious little Tori . She is safe in the arms of our Heavenly Father. MOO.

ETA: Rafferty did not testify at trial, but argues in his appeal that he was "at most" an accessory after the fact to murder -- a concept the judge did not put to the jury.

His actions proven by evidence other than McClintic's testimony, such as cleaning the scene, destroying evidence and giving a false alibi, are "equally consistent with being an accessory," Calarco writes.

He says the case against Rafferty relied almost entirely on the word of McClintic -- "a person of unsavoury character, with a serious history of violence and lying."

I guess this 🤬🤬🤬 really is stupid to think anyone will accept his BS. There is so much evidence against him the Crown didn't need TLM's testimony to prove he was the instigator, master manipulator and the sexual deviant who found someone equally warped and evil as himself to help him carry out his sick plan and act against a sweet innocent little girl. He truly is a monster. MOO.

My thoughts and prayers are with Tori's loved ones the real victims, as this 🤬🤬🤬 continues to try and manipulate the system.
