Misty's attorney feels new developments are "unfortunate"

I think this is what you're looking for, LFlorida

http://i2.cdn.turner.com/cnn/2009/images/10/16/marital.settlement.agreement.pdf
The marital settlement indicating Misty represented herself, and
http://www.cnn.com/2009/CRIME/10/06/haleigh.cummings.father.divorce/index.html
Fields saying he'd got the papers via e-mail.

If Misty was a paying client she'd be a good one. She's gone thru so much legal action in just a few short months. Divorces, restraining orders, robberies and road rage, arrests, bond hearings, lie detection tests and interrogations...

The first thing I thought hearing "it would really hurt her" was, is Fields admitting that Misty knows something that would hurt her if it came out in the open?

Another way it could hurt her is, maybe jail is the best place for her right now. What would she do with her life if she got bonded out? How would other people react? If she didn't get her act together she might end in other troubles.

Also, Fields might have thought of a defense strategy and maybe he feels that it might work if Misty can just work with his plan and keep from saying things that bust it, but since we know he's had trouble getting Misty to listen to him before he probably wouldn't welcome the interference and confusion LP might introduce if he got access to Misty.

Anyone curious as to who the "John" is that misty was referring to on the tape...the one she got the pills for?

Rc was married to the "enemy" for 9 months and still has not offered his opinion on what happened to Haleigh and he claims he never heard anything from misty. Misty is in jail and wants out but has not offered her opinion on what happened to Haleigh and has stated rc is NOT involved.

They are both protecting each other...I can't think of any other scenario. I know rc would give misty up in a heartbeat...not too sure about misty but she sounds desperate. Some may say they both are involved in Haleigh's demise.

misty's attorney has remained very low key and feels anything on the outside can "hurt her", which also tells me he suspects she is involved or has the kge of what happened. Neither of these two are going to answer any questions about Haleigh because they have lawyered up. Here's hoping they never adjust to prison life...

But in court, Misty was asked if she needed a lawyer, and she replied "I already have a lawyer" which says to me Mr Fields has been on retainer this whole time since her divorce, and not subject to funds in this PD office.

funny thing about this...Mark Garagos got public defender funds for SP. When SP's family ran out of money, he became indigent. Court ruled that it was too late for a new attorney and they gave MG public funds for the rest of the trial..

Unfortunate? Sorry but imo...'Unfortunate' is when you leave the house without an umberalla when the sky is clear, then find yourself getting saturated by rain when the conditions change.
'Unfortunate' is when you take your kid to the park, and they fall off the equipment injuring themselves, despite talking precautions.

Being busted by the popo for buying and selling large quantities of drugs is not 'unfortunate'- it is STUPID and arrogant when you are currently under investigation in a missing child case.
These people have zero impulse control.

I know it's a def atttys job to publicly minimise the seriousness of the matter, but nobody is falling for that.

Why couldn't he just come out and say it was a really stupid thing for his client to do, that he doesn't condone it, and that the drug charges, although very serious and life altering, are a taking the focus away from the most important matter...

FINDING HALIEGH.

It sickens me that she has been lost in this circus, and her own family don't seem to give a crap about finding her. But they do care about being deprived of their luxeries/drugs behind bars. They are all in CYA mode. They only care about themselves and are absolute leeches feeding off one another and anyone else who is gullible enough to be drawn into their dysfunction.
I think they all have dirt on each other and that is the only reason that nobody is telling the whole truth about anything.
'Unfortunate' - my azz.
Selfish, arrogant, self absorbed, heartless and dangerous to society (and children) are more appropriate words imo.
Keeping my fingers crossed that the agony of withdrwals will make the weakest one (MC) crack.
Why don't def attys ever seem to do the ethical thing these days, and encourage their clients to divulge the WHOLE truth, possibly in exchange for a lighter sentence. It's not about winning a case so the client walks free, but finding the truth and having a jury decide their guilt and punishment- It's called justice!
I hate that the message this sends is that killers/drug dealers are really not that bad they are just 'unfortunate'.

It would be my guess that Misty's attorney is encouraging her to come forward with any and all information about Haleigh. It seems to be her only option. She can give them tips about burglaries and drug buys all day long, but I don't think anything will help her like information on Haleigh.

I do have to disagree with Donjeta (sorry) about Misty being a good client. Even if she were a paying client, she doesn't follow her attorney's advice. A loose canon for a client is one huge headache and at some point, it's just not worth it for the attorney. He's already dropped her once for not following advice.

When did Misty originally hire her attorney? In the early days of Haleigh's disappearance? He's handled her PR, divorce and now criminal?

Yeah, that struck me too. Maybe he's someone the family knows rather well?
IF that's the case, my hinky meter is off the wall. Hope we're wrong on this.

My opinion only

I believe there was reference to "John and Linda"?

You don't have to apologize for disagreeing with me. I'm a big girl now and I can take it. Besides, you've got a point :)

I don't think we know the exact date of Misty getting a lawyer. The rumors about her having one were around for a while before Mr. Fields was ever mentioned by name in the media. In March Misty said, "lawyers are for guilty people" so it appears she had not hired Mr. Fields at that point yet. http://www.artharris.com/2009/03/17...e-for-guilty-people-misty-cummings-exclusive/

Searching WS, the earliest mention I could find of him was in August.

Nothing good has come of anybody getting involved in the media in this case. The less guilty have been left for dead on the side of the road as the bus keeps moving down the road, and whoever's driving ain't looking for little girls.

Bus, hell - train is a more apt description.

I totally lost the post I just wrote within WS cyberland. No telling where it might show up. Donjeta, thank you for the information on Mr. Frields.

I wonder what prompted Misty to hire him around August?

I wonder how long Fields will stay with Misty. He can't be happy about her talking behind bars. Maybe he'll quit and she'll get a public defender.

Whisperer, this might be off topic for this thread, but I was curious about your opinion about the latest that we heard about the night Haleigh disappeared. The story that Misty did not want to babysit that evening and TN talked her into it, even offering to pay her. (if that is true). If you've posted on this subject, I didn't see it. Can you comment now?

Az, I'm not whisperer, but that tidbit of info has been revealed by Lindsey per AH... As I understand it she was asked on Sunday refused , and TN called her on Monday and offered to pay her if she would babysit.. Misty told her she didn't have to pay her if it was ok with Ronald that she babysit....

Sure puts a hole in TN's story about how they stayed up all night on Sunday night working things out....I think TN lied...JMO

TN, lied? Surely you jest, Em. lol
Hey, I'm with you. I believe TN is in this up to her eyebrows. MOO is that she has been covering from day one - for her son and what really happened and the whereabouts of her granddaughter.
My hope is that LE somehow pulls her into the investigation for obstructing justice once more light is shed on this case. I'm sure you feel the same way.

I think it was the UC's undercover name. I'm not sure why this question wasn't asked on the jailhouse tapes thread, though? Am I missing something?

State of Florida, public defender fund, I imagine.

At the arraignment when the Judge asked if she had an attorney she sopke up clearly...Yes. So I do not think it is a public defender...I have never been in a situation like this where I needed an atty so I do not know. JMO

That was my first thought Kim. Then I see people discussing a John and Linda, which I know nothing about.

However: I do have a John that either lives with or is associated with Katrina. She used his last name for awhile...
....she's used many last names.
