MN - George Floyd, 46, unarmed, killed in police custody, Minneapolis, 25 May 2020 *arrests* #3
10/12/20: In a motion filed Monday, prosecutors say an upward departure from sentencing guidelines is warranted for four former police officers charged in the killing of Floyd. They argue that Floyd was vulnerable as he was detained during the Memorial Day incident & that the men abused their authority as police officers in the commission of a crime. They point out that Floyd was cuffed & pinned to the street for nearly nine minutes. Next motions hearing on 10/15/20.
10/15/20: Defendants waived their right to appear. Media coalition's opposition to State's Motion to restrict access to defendant Lane's October 12 filings & State's motion for a "temporary" protective order. (Proposed) Order on Sate's motion to restrict access-denied & will be immediately made available for viewing & copying by the press & public. The judge indicated he will take the video under consideration as part of a defense motion to dismiss charges; however, Thursday's decision does not necessarily mean the video can be used as evidence for any jury trial.
10/16/20: Kueng: Order: Defendant's motion for leave to file video exhibits is denied. Motion & Memo of Law to allow video exhibits. Thao: Order: Denying defense leave to file video underlying proposed Exh. 7 to defense Notice of Intent to use Spreigl evidence (re video recording relating to Defense Exh. 5). Exhibits 2 thru 7 filed. Notice of Intent to use Spreigl evidence. Motion to leave to supplement the Spreigl Motion with additional video exhibit. Hearing on 10/15/20 was moved to 10/22/20.
10/19/20: Hennepin County Judge Peter Cahill has denied the use of body camera footage from a 2019 arrest of Floyd to be used as evidence in the trial He denied attorney Earl Gray’s request to use the body camera footage as evidence in court. However, the judge says that a transcript of the video may be presented. Earlier last week, Cahill ruled that the 2019 arrest video could be made public.
10/20/20: Kueng: Defendant's 2nd supplemental memo in support of Motion to Change Venue.
