Judge allows public viewing of previous George Floyd arrest video | kare11.com

In a brief hearing Thursday, a Hennepin County judge denied a state motion to block public access to police body-worn camera video of a previous George Floyd arrest, after the judge said he does not see the video as prejudicial.

"It is one small piece of evidence that shows us what everybody already knows: George Floyd was arrested on another occasion," Judge Peter Cahill said in a hearing Thursday.

The court released the video Thursday afternoon. The judge indicated he will take the video under consideration as part of a defense motion to dismiss charges; however, Thursday's decision does not necessarily mean the video can be used as evidence for any jury trial.

Additional written rulings were possible in the case Thursday, after the judge previously set a self-imposed Oct. 15 deadline to decide on several motions, including a change of venue; however no rulings had been issued as of 5 p.m.

9/11/20 Update: Summary of hearing: Hennepin County Judge Peter Cahill disqualified Hennepin County Attorney Mike Freeman & three other attorneys in his office from participating in the George Floyd case at a motions hearing Friday. Judge Cahill barred Freeman, Senior Hennepin County Attorney Amy Sweasy, Assistant Hennepin County Attorney Patrick Lofton & Deputy Hennepin County Attorney Andy LeFevour from participating in the prosecution of the case for what he described as “sloppy” work while interviewing a witness, Hennepin County Medical Examiner Dr. Andrew Baker, prior to filing murder charges. Baker performed Floyd’s autopsy. The prosecution asked the judge to consider his order barring the four attorneys from the case. Judge Cahill granted the reconsideration motion. No dates for the motion have been set.
Jury selection will be one by one, on the witness stand. The judge said he anticipates the jurors will complete questionnaires ahead of time. COVID-19 restrictions are expected to be in place during the trial, and there will be overflow rooms for family and press. There is expected to be a two-week jury selection and a four-week trial. Another agenda item under discussion is whether to sequester the jury. The judge thinks, "it would be almost cruel to keep them on weeks at a time" and suggested they be "semi-sequestered." That would involve jurors driving to court each day, being escorted by deputies from their vehicles and up a secure elevator, having lunch brought in to them, then having them escorted back to their vehicles at the end of the day. The judge said he believes there will be "significant" attempts to influence the jury if it is not anonymous. The judge cites receiving a "barrage of calls" from members of the public giving him advice about this motion's hearing.
Documents covering two prior incidents—one at Hennepin County Medical Center (HCMC) and another in Harris County, Texas—involving George Floyd have been brought forward for consideration. The judge has denied the request to consider the Harris County incident, citing irrelevance to this case. He has also denied the request to consider the HCMC incident, but it could come up at a later date.
The latest agenda item was discussion about a potential change of venue. The judge said there is no deadline for this motion. Meanwhile the judge suggested sending a questionnaire to potential jurors to address prtrial publicity. The judge said if information from Hennepin County jurors is obtained first, they can determine whether pre-trial publicity has influenced the pool. If it hasn't, he says they don't need to look elsewhere.
Attorney Earl Gray, who is representing former officer Thomas Lane, is disagreeing with the state's argument that jurors could be prejudiced if there are separate trials. Gray said if former officer Derek Chauvin is tried first and acquitted, the other officers likely wouldn't go to trial. The judge is taking the rejoinder motion under advisement. The judge has 90 days to make ruling in the case, but said in writing he hopes to have most of his decision made by Oct. 15.

10/7/20 Update: Chauvin has been released from jail after posting a non-cash $1 million bond signed by A-Affordable Bail Bonds of Brainerd, Minnesota. In an amended set of conditions of release, a Hennepin County Judge ordered that Chauvin must establish a residency & obtain a working cell phone. Once finding a home in Minnesota or a "contiguous state," Chauvin is required to share his location with the Minnesota Dept. of Corrections, according to court records. The former officer is also required to own a cell phone & must maintain cellular service at all times. He must also surrender his passport. Judge amended his bond so he can live out of state for safety reasons.

Chauvin is being represented by the same defense attorney in his tax and his murder defense case. His wife is not in custody in connection to the tax case.

George Floyd Trial: The Key Decisions Judge Cahill Could Make This Week

A judge could decide on several key motions this week in the trial of George Floyd’s death.

Hennepin County Judge Peter Cahill is still deciding whether the jury should be anonymous; if the trial should happen in Hennepin County; and whether the officers involved should have separate trials.

Cahill has given himself a goal of releasing his decisions by mid-October, but he still has several weeks before his final deadline to do so.

Lawyers in court to argue adding evidence to George Floyd trial | kare11.com

Earl Gray, the attorney for former Minneapolis Police officer Thomas Lane, wants video of a May 2019 arrest of George Floyd to be allowed as evidence in Lane's motion to dismiss the charges against him.

Gray argues Floyd's behavior in the 2019 video is similar to his behavior in the May 2020 incident that left him dead.

According to Gray's court filing, in the prior arrest Floyd doesn't immediately show his hands, he swallows drugs and he cries.

Gray argues the state's case is a false narrative and the similarities in the prior case prove that.

The video is filed in court, but not yet available to the public. It will be argued in a Thursday hearing. Prosecutors want to keep the video out.

Meantime, the prosecution wants the judge to allow details from 18 past incidents involving the four former officers into the trial, arguing these cases are relevant to the George Floyd case because they demonstrate former Minneapolis police officer Derek Chauvin's M.O., or pattern of behavior.

Judge In George Floyd Case Allows Video Of Prior Arrest To Be Made Public


A Minnesota judge in the case of four ex-Minneapolis police officers charged in the killing of George Floyd ruled in favor of defense attorneys to allow video and transcripts of a previous police encounter with Floyd to be made public.

The judge declined to further delay the release of court filings, the newspaper notes, but said he will not allow audio, video or photos to be attached to future filings.

The office of Minnesota Attorney General Keith Ellison, which is prosecuting the case, tried to put a delay of two business days on making new information public to give counsel on both sides time to deliberate, reports Minnesota Public Radio.

Last time they had the "supposed" hearing on 10/15 - they posted on that day.... I shall correct my notes! :)

Judge Denies Use Of 2019 George Floyd Arrest Video At Trial

A Hennepin County judge has denied the use of body camera footage from a 2019 arrest of George Floyd to be used as evidence in the trial of the former Minneapolis police officers accused in his death.

Judge Peter Cahill denied attorney Earl Gray’s request to use the body camera footage as evidence in court, according to documents filed late Friday. However, the judge says that a transcript of the video may be presented. Earlier last week, Cahill ruled that the 2019 arrest video could be made public.

Other key motions that Cahill may soon decide on include whether or not the jury should be anonymous and whether the officers should stand trial separately or together. Currently, the officers are scheduled to go on trial in the spring.

Cornell University Changes Name of English Department in Response to George Floyd Death, "Resurgence" of Black Lives Matter

The faculty at Cornell University’s English Department has voted to change the department’s name in an effort to avoid the perception of ‘English as a nationality’ and stand in solidarity with the Black Lives Matter movement, "felt a sense of obligation” to do something following George Floyd’s death and the “resurgence” of Black Lives Matter.

Thus, Cornell University’s English Department shall now be known as the “The Department of Literatures in English.”

The third-degree murder charge against former Minneapolis police officer Derek Chauvin in the death of George Floyd has been dropped, although the higher second-degree charge remains.

Three other former officers, Tou Thao, Thomas Lane and J. Alexander Kueng, are charged with aiding and abetting second-degree murder. All three had requested to have charges against them dismissed, but Judge Peter Cahill on Thursday ruled against that request.

Cahill has yet to rule on a possible change of venue, and whether the four trials will be joined or held separately. At this time they are scheduled to begin in March in Hennepin County. KARE 11 reporter Lou Raguse will be reporting developments live from his Twitter account.
