A Minnesota judge reinstated a third-degree murder charge against former officer Derek Chauvin in the May 2020 death of George Floyd.

Chauvin was already charged with second-degree murder and second-degree manslaughter

The defense asked the Minnesota Supreme Court to review but in a Wednesday afternoon denial, the state's high court indicated it would not take up the issue. Hennepin County District Judge Peter Cahill heard arguments on the charge Thursday morning before ruling that the third-degree murder charge should be reinstated. Since the defense did not appeal, jury selection will continue moving forward as scheduled.

We are live. (Off audio right now as one juror #31 wants to go to a "modified in-camera" as he states he thinks some answers may be sensitive information) What led to this request is he wants to change information on questionnaire, and believes the reason may reveal some sensitive information.

In-camera is a Latin term literally meaning "in chambers" but carrying the meaning "in private". This refers to portions of a case that are held in private before a judge. The press and the public are not allowed to take part.

ETA: He is excused for cause... back on to Juror #36

A third-degree murder charge has been reinstated against Chauvin in Floyd's death.

It carries a max penalty of up to 25 years and adds to the 2nd degree unintentional murder and the 2nd degree manslaughter charges he already faces.

A thought while watching the live stream: In this age of technology, it is interesting to note that "sidebars" don't need to take place at side of the bar.

Derek Chauvin Trial, Day 4 Live Updates: 6th Juror Seated

Potential juror No. 36 will be on the jury. He is the sixth juror to be seated.

He is a person of color and spoke with an accent. In his questionnaire, he wrote that he had a “very negative” impression of Derek Chauvin after watching the arrest video of George Floyd. He said that Floyd was “desperately screaming” while Chauvin was kneeling on his neck. Still, the juror said that he would be willing to hear all the evidence.

The juror described himself as a family man, a sports fan, a route driver, and a true crime podcast junkie. In his questionnaire, he said that Floyd would have lived if he complied with officers’ demands. He responded that he “somewhat disagrees” that the justice system is biased against minorities, adding that he thinks the media exaggerates such incidents.

Juror #38 up next on the witness stand. Moved to MN about 3 yrs ago. When he got his jury summons for #DerekChauvinTrial, he said "this is big" and joked "how did they find us again?" Apparently, he had done some jury duty before the move. Describes himself as a "stand-up guy"

Agree. Also agree with an earlier post of yours @dixiegirl1035 . This is an insightful and intelligent jury pool with impressive conversational skills, IMO. Judge recessing now for lunch.

Juror No. 38 has been dismissed. The state prosecution team has issued a peremptory challenge strike against him. They have five remaining. The defense has 10 left to use.
