Former Minneapolis police officer Tou Thao, seen keeping back bystanders on the sidewalk outside Cup Foods was convicted of violating George Floyd's constitutional right to be free from unreasonable seizure by failing to stop Chauvin's unreasonable force. Also find Thao guilty of failing to render aid.

I feel sorry for Lane and Kueng. Literally, first day on the job, they end up with Chauvin as a "trainer".

What were they supposed to do? I am not disagreeing with the jury verdict.

My personal opinion is that the real criminals were Chauvin's supervisors, who knew he was aggressive, and let it pass.

With regard to sentencing, theoretically it could go all the way to life in prison or the death penalty, but sentences for civil rights violations are based on the underlying offense.

Chauvin for example pleaded guilty to his own federal civil rights charges in exchange for a sentence of around 20-25 years, which fits his underlying offense of second degree murder (see also the Walter Scott shooting for a similar case).

In this case the three officers are charged with violating Floyd's rights by failure to intervene and failure to render aid (Lane only the second). I'm not sure what federal statute would be the exact underlying offense (dereliction of duty? Involuntary manslaughter?), but their sentences will undoubtedly be much lower than Chauvin's.

EDIT: Did a quick back-of-the envelope calculation for Lane based on the Federal Sentencing Guidelines:

Giving Lane zero breaks I come up with a maximum score of 28 points, which corresponds with 78-97 months. The actual sentence could actually be much lower, but is unlikely to be higher than this.

What were they suppose to do? As in--I don't want to piss off the senior officer here because it will affect my job? Chauvin was not their "trainer", he was a cop who they knew had more experience than them.

They were suppose to rely on their training that GF should be turned on his side, and demand that Chauvin do it when he ignored it. Was there a moment, during nine minutes of Chauvin's knee on GF's neck, that their career mattered less than preventing his death? No.

When they knew GF had no pulse, did they demand that Chauvin get off his neck so they could administer CPR? No.

Hopefully this case will give junior officers the moral strength to do the right thing and challenge superiors without fear of the backlash that would affect their career. Hopefully it will help weed out the bad cops.

I am relieved that they have been found guilty.

They participated in a man's senseless death---nay, murder when they refused to act. I concede that they were in a bind. If they went against the neck kneeling murderer then they might face ostracizing from the blue wall or disciplinary action from their superiors if there was any other issue with Mr. Floyd. They were in a horrible position. But, that said, by not choosing Mr. Floyd's life over their career they have convicted themselves in the court of law, court of public opinion and ended any career that they would have been able to work toward.

The blue wall of silence is real. Cops who hang their own out to dry is real. Reform is needed. Training is needed. The old paradigm of cops being able to do what they wish not matter how far it skirts the law are over. JMHO.

The defendants' histories, educations, criminal records, financial histories and family situations are among the factors that will be considered, Marti said. Probation officials will then look at federal guidelines to make preliminary determinations about potential sentences.

Defense lawyers and prosecutors can object, and if there are factual disputes, the judge will hold an evidentiary hearing. He'll ultimately make the final decision on guidelines and the sentence.

The process can take months. Chauvin pleaded guilty in mid-December and no sentencing date has been set. In one recent Minnesota case involving a defendant convicted in a mosque bombing, the sentencing happened nine months later.
