The federal probation office will conduct a pre-sentence investigation, which involves interviewing defendants and gathering investigative materials from the government, said John Marti, a former federal prosecutor.

The defendants' histories, educations, criminal records, financial histories and family situations are among the factors that will be considered, Marti said. Probation officials will then look at federal guidelines to make preliminary determinations about potential sentences.

Defense lawyers and prosecutors can object, and if there are factual disputes, the judge will hold an evidentiary hearing. He'll ultimately make the final decision on guidelines and the sentence.

The process can take months. Chauvin pleaded guilty in mid-December and no sentencing date has been set. In one recent Minnesota case involving a defendant convicted in a mosque bombing, the sentencing happened nine months later.

Three Ex-Cops Convicted of Violating George Floyd's Rights Claim Prosecutors' 'Repeated and Intentional' Misconduct Calls for New Trial

The three former Minneapolis police officers who were convicted in late February of depriving George Floyd of his constitutional rights are demanding a new trial. In essence, the men convicted of violating Floyd’s rights are now saying prosecutors violated theirs.

A three-count indictment dated May 7, 2021, accused Tou Thao, J. Alexander Kueng, and Thomas Kiernan Lane of “deprivation of rights under color of law” under the U.S. Constitution by way of causes of action enshrined in 18 U.S.C. § 242 and 18 U.S.C. § 2. Lane faced one count; Thao and Kueng faced two. Convicted murderer Derek Chauvin was also named in the same charging instrument but pleaded guilty in late December.

“The Government’s actions during this lawsuit stripped Mr. Thao of his constitutionally protected right to a fair and impartial trial due to repeated breaches of this Court’s pretrial orders, questions and arguments that violated rules of criminal procedure and evidence, and unprofessionalism in front of the jury,” wrote attorneys Robert M. Paule and Natalie R. Paule for Thao in a document which spring-boarded off of prior arguments by Kueng and Lane and which was subsequently joined by Kueng.

Chauvin & his ex-wife, Kellie Chauvin are accused of under reporting their income by a total of $464,433 between 2014 & 2019, according to the complaint. That includes an alleged failure to report more than $95K over several years from Mr. Chauvin’s employment as a security guard at a bar. They owe a total of $37,868 in back taxes & penalties, according to a criminal complaint filed by the Washington County attorney’s office. Both Chauvin & his ex-wife each face nine felony charges, which each carry a maximum of five years in prison & a $10K fine.

Prosecution asks to keep cameras in court for trial of ex-officers charged in George Floyd’s death

(KSTP) - The murder trial of former Minneapolis police officer Derek Chauvin was the first case in Minnesota to allow cameras in the courtroom. Hennepin County Judge Peter Cahill cited coronavirus concerns and the case’s high public interest when allowing televised coverage for that trial.

Now, state prosecutors are seeking the exact same trial conditions for J. Alexander Kueng, Thomas Lane and Tou Thao, the other three ex-officers charged in George Floyd’s death. They’re each charged with aiding and abetting second-degree murder and aiding and abetting second-degree manslaughter.

“In short, what the Court did the first time worked,” a memo filed Thursday states, “and this Court should continue to use the same proven procedures in the second trial.”

The prosecution also argued that COVID-19 remains a threat to the proceedings, and allowing a publicly available live feed will minimize the number of people present in the courtroom and reduce the risk of transmitting the virus.

The defense has previously asked Judge Cahill to deny the use of cameras during the trial, and so far he has struck down those requests. However, Cahill’s last ruling on televising the trial came before he delayed proceedings to accommodate the ex-officers’ federal civil rights trial.

Judge Cahill is expected to decide on the trial parameters Monday evening.

In addition to its support for allowing live camera coverage, the prosecution team wants to only partially sequester the jury, as was done in the Chauvin trial, to “avoid creating unnecessary burdens for Minnesotans who seek to perform their civic duty.”

9/2/21 Update: During Thursday's hearing, Gray dropped his earlier request that the state provide all use-of-force reports since July 2016 in which another officer intervened in force used by a colleague, because he is pursuing information from the city himself. An officer’s duty to intervene came up often during testimony in Chauvin’s trial. Judge Cahill also denied a defense request to issue a factual finding that a potential expert witness for the state coerced Hennepin County Medical Examiner Dr. Andrew Baker to change his findings by noting that neck compression was a factor in Floyd's death. Paule said Thursday that he wasn't accusing the state of using former Washington, D.C., medical examiner Dr. Roger Mitchell to coerce Baker, but that the state failed to take action after prosecutors learned Mitchell threatened to write an op-ed critical of Baker's findings. The state ultimately did not call Mitchell as a witness in Chauvin's case. Judge Cahill also denied a defense request to sanction the state over a New York Times report based on leaked information about how Chauvin had been prepared to plead guilty days after Floyd's death. Numerous lawyers from the attorney general's office & the Hennepin County attorney's office have filed affidavits stating that they weren't the source of the leaked information & Judge Cahill said Thursday that he doesn't believe the State was the leak's source. 2/24/22 Thursday, Trial Day 20/Deliberations Day 2: Jurors continue deliberations. Deliberated: ~6hours. Former Minneapolis police officer Tou Thao was convicted of violating Floyd's constitutional right to be free from unreasonable seizure by failing to stop Chauvin's unreasonable force. Also find Thao guilty of failing to render aid. Former Minneapolis police officer Thomas Lane convicted of failing to render aid to Floyd. Former Minneapolis police officer J. Alexander Kueng convicted of failing to intervene. Kueng also convicted of failing to render aid. All three former Minneapolis police officers convicted of violating George Floyd's constitutional rights. The three men remain free on bond & are expected to start pre-sentencing proceedings next week. Will take a few months for sentencing hearing date.

Plea deal rejected by 3 ex-officers in George Floyd's death

MINNEAPOLIS – Prosecutors revealed Monday evening that they offered plea deals to three former Minneapolis police officers charged with aiding and abetting the murder of George Floyd, but said at a hearing that the defendants rejected them.

Hennepin County Judge Peter Cahill held the hearing mostly to consider whether he has the authority to allow live video coverage of the upcoming trial set to begin in June for former Officers Tou Thao, Thomas Lane and J. Alexander Kueng. They're charged with aiding and abetting both manslaughter and murder when former officer Derek Chauvin used his knee to pin Floyd, a Black man, to the pavement for 9 1/2 minutes on May 25, 2020. Kueng knelt on Floyd’s back, Lane held his legs and Thao kept bystanders back.

Lead prosecutor Matthew Frank did not disclose details of the plea offers in open court but said they were identical and were made March 22 after a jury convicted the three in a separate trial in February on federal civil rights charges stemming from Floyd’s death, according to pool reports from inside the courtroom.

Lane’s attorney, Earl Gray, said it was hard for the defense to negotiate when the three still don’t know what their federal sentences will be. The judge in that case has not set a sentencing date, and all three remain free on bail.

Cahill told Frank to file the offers for the record after the jury is seated for the upcoming trial, which is expected to take around eight weeks, including three for jury selection.

1/7/22 Update: Attorneys for the defense & prosecution are asking a Hennepin County judge to delay the March trial date for three former Minneapolis police officers in order to allow a federal trial to run its course first. Motion filed on 1/7/22. A federal judge this week formally scheduled jury selection for the civil rights trial of Thao, Kueng & Lane to begin 1/20/22 in St. Paul. The state's trial against the former officers is currently set to begin 3/7/22. Since it is unknown how long the federal trial will take, "a continuance should be granted in the interest of justice" per a letter to Judge Peter Cahill that was signed by Assistant Attorney General Matthew Frank & defense lawyers for the former officers.
1/10/22: Judge Peter Cahill denied a motion from the three other former police officers charged in Floyd’s murder to limit live streaming of the trial. He that the pandemic-related health conditions that led the court in November of 2020 to order audio & video livestreaming of the trial remain the same. The only difference now, he wrote, is that the Omicron variant of COVID-19 is even more contagious now than previous versions of the virus. They are slated to stand trial for the Federal charges on 1/20/22. That trial will not be live streamed. The State trial for the three former officers is scheduled for 3/7/22.
1/12/22 Update: Hennepin County District Court Judge Peter A. Cahill has approved requests from the prosecution & defense to delay the March 7 trial. In granting the order, Cahill instructed both sides to meet by Saturday 1/15/22 to decide & agree upon a new trial date. He also ordered them to expect to set aside three weeks for jury selection & five weeks for the rest of the trial. Cahill said he would allow any trial date between March 14, 2022 & Jan. 9, 2023. If the parties could not agree, he said, the original trial date would remain & proceedings would be pushed back on a day-by-day basis as needed.

4/7/22 Update: Hennepin County Judge Peter Cahill cited coronavirus concerns & the case’s high public interest when allowing televised coverage for that trial. State prosecutors are seeking the exact same trial conditions for Kueng, Lane & Thao, the other three ex-officers charged in George Floyd’s death. The defense has previously asked Judge Cahill to deny the use of cameras during the trial & so far he has struck down those requests. However, Cahill’s last ruling on televising the trial came before he delayed proceedings to accommodate the ex-officers’ federal civil rights trial. Judge Cahill is expected to decide on the trial parameters Monday evening. In addition to its support for allowing live camera coverage, the prosecution team wants to only partially sequester the jury, as was done in the Chauvin trial, to “avoid creating unnecessary burdens for Minnesotans who seek to perform their civic duty.” The memo also asks Cahill not to extend the trial’s expert disclosure deadline & to limit the defense’s expert medical testimony. Jury selection for the trial of Kueng, Lane & Thao is scheduled to begin 6/13/22.

*Federal Grand Jury indicted & charged (5/7/21) Tou Thao (34/now 36) & J. Alexander Kueng (26/now 28) for violated Floyd’s civil rights. Charged (5/7/21) & arraigned (7/14/21) with violating Floyd's right to be free from unreasonable seizure, alleging they willfully failed to intervene to stop Chauvin’s unreasonable force, resulting in bodily injury to & the death of Mr. Floyd & failure to provide Floyd with medical care. Thomas Kiernan Lane (37/now 39) is charged with failure to provide Floyd with medical care. All released on $25K unsecured bond. All plead not guilty on 9/14/21.
Trial began on 1/20/22 with jury selection. Jurors were selected. 12 jurors: 5 men & 7 women & alternates: 3 men & 3 women. Trial began on 1/24/22 with opening statements. Prosecutors rested their case on 2/15/22. Juror #47 (man) was excused (2/8/22) for medical reasons. Replaced by man. 12 Jurors: 5 men & 7 women & alternates: 2 men & 3 women. Another juror is excused. No mention of # of women & men. 12 jurors & 4 alternates. Another juror is excused re family commitment. Now: 12 jurors & 3 alternates (4 men & 8 women). Jury Deliberations: Day 1 (2/23/22) ~7 hours. Day 2 (2/24/22) ~6 hours. Total deliberations: ~13 hours.

2/24/22 Thursday, Trial Day 20/Deliberations Day 2: Jurors continue deliberations. Deliberated: ~6hours. Former Minneapolis police officer Tou Thao was convicted of violating Floyd's constitutional right to be free from unreasonable seizure by failing to stop Chauvin's unreasonable force. Also find Thao guilty of failing to render aid. Former Minneapolis police officer Thomas Lane convicted of failing to render aid to Floyd. Former Minneapolis police officer J. Alexander Kueng convicted of failing to intervene. Kueng also convicted of failing to render aid. All three former Minneapolis police officers convicted of violating George Floyd's constitutional rights. The three men remain free on bond & are expected to start pre-sentencing proceedings next week. Will take a few months for sentencing hearing date.
*Derek Michael Chauvin (44) - Federal grand jury indicts (5/7/21) for violating Floyd’s civil rights & 14 yr, old boy. Plead guilty to all charges on 12/15/21. Sentenced to 25 years in prison.

I just realized I'm going to miss out on watching this Trial in June.

TRIAL HIGHLIGHTS: MPD-3 trial starts 6/13. Jury selection on the 14th. Opening statements locked in for July 5. Jury partially sequestered during trial, but will go home at night. Overflow rooms set up in courthouse for trial viewing on closed circuit TV.

Many wondered if Derek Chauvin was "coached" for the 2017 case in which he struck a 14 year old over the head with a flashlight simply because he didn't stand up. A case Chauvin pleaded guilty to in federal court this year.

It's actually worse than that. The Human Rights report finds an MPD supervisor reviewed Chauvin's use of force in that case and "approved" it. BTW - the reports from that case show Chauvin was acting as another officer's FTO at the time.
