MINNEAPOLIS (FOX 9) - Attorneys for the two remaining former Minneapolis police officers facing aiding and abetting murder charges in the death of George Floyd are again asking for the trial to be moved out of Minneapolis.


Due to the widespread attention the case has drawn, the attorneys for J. Alexander Kueng and Tou Thao say their clients can't get a fair trial in Hennepin County. They are asking the case be moved to another county. .....

In its response, the state points out this is Kueng's fourth request to get a venue change, calling it "a last-ditch attempt [by Kueng] to evade judgment"

The state says the new request offers little new evidence from previous attempts which have been denied by Judge Peter Cahill. Last year, Cahill denied a motion for a venue change for Chauvin's trial. Chauvin's attorney has cited that decision in Chauvin's appeal for a new trial, among a list of other claims.

Judge Peter Cahill's order comes a week before the trial was to begin and leaves many more months for a possible guilty plea from either defendant.

The state trial of two fired Minneapolis police officers charged in connection with the death of George Floyd two years ago has been delayed from next week until January.

The cases against Tou Thao and J. Alexander Kueng have been rescheduled for a joint trial on Jan. 5, with jury selection set for Jan. 9 and opening statements on Jan. 30, Hennepin County District Judge Peter Cahill ruled Monday. Jury selection in the case was set to begin June 14. Opening statements were slated for July 5.

A defense request for a change of venue for the trial because of pretrial publicity was denied. Cahill wrote that Floyd's death and subsequent events "have had saturation news coverage" in the state and nationally, and the defendants "have not developed ... any firm basis upon which this court might conclude there exist other counties in this state that have been less impacted by the pervasive, saturation publicity George Floyd's death on May 25, 2020, and these cases have received."

Kueng, Lane and Thao were convicted in federal court in February of violating Floyd's civil rights and causing his death. They have not yet been sentenced for that conviction. In court last Tuesday, the defense attorneys say they believe the sentencing won't take place until late summer — after the state's trial is wrapped.

Cahill's order nodded to the pending sentences in federal court and left many months of time for either of them to plead guilty. The judge said he will accept no plea agreements reached by the County Attorney's Office and either defendant until after their federal court sentencings, which have yet to be scheduled.

The terms of the federal sentencings could affect the thinking of prosecutors or the defense about whether to reach a plea agreement in state court.

Former Minneapolis police officer Tou Thao was convicted of violating Floyd's constitutional right to be free from unreasonable seizure by failing to stop Chauvin's unreasonable force. Also find Thao guilty of failing to render aid. Former Minneapolis police officer Thomas Lane convicted of failing to render aid to Floyd. Former Minneapolis police officer J. Alexander Kueng convicted of failing to intervene. Kueng also convicted of failing to render aid. All three former Minneapolis police officers convicted of violating George Floyd's constitutional rights. The three men remain free on bond & are expected to start pre-sentencing proceedings next week. Will take a few months for hearing date.
5/11/22 Update: Judge Paul Magnuson has denied motions for acquittals & a mistrial from the three former Minneapolis police officers convicted of federal civil rights charges in George Floyd’s killing. All moved for acquittals & asked for a mistrial based on “prosecutorial misconduct.

The White House announced Wednesday that President Biden is nominating Derek Chauvin prosecutor Jerry Blackwell to be a federal district court judge for the District of Minnesota.

Blackwell was part of the legal team that successfully secured a guilty verdict against Chauvin for the 2020 murder of George Floyd. He is one of seven new judicial picks the president named, and the White House specifically mentioned diversity in its press release.

The state trial of Tou Thao and J. Alexander Kueng, who are charged with aiding and abetting second-degree murder and aiding and abetting manslaughter in Floyd’s May 2020 death, was recently pushed back to Jan. 9, 2023. Their trial was supposed to start on June 13 after being postponed from March of this year.

The State of Minnesota, on behalf of Floyd’s family, filed a motion on June 17 demanding a “speedy trial,” citing the Victim Rights Act. And in response to this, Kueng’s attorney filed a motion for a continuance, seeking to push the start of his trial back to after April 3, 2023, citing Kueng being unavailable from January-March 2023 “due a scheduling conflict of a personal nature.”

The pair has a motion hearing scheduled for 8:30 a.m. Tuesday with Hennepin County Judge Peter Cahill.

6/17/22 Update: The revised schedule that Judge Cahill laid out calls for hearing pretrial motions Jan 5-6, with jury selection beginning Jan. 9. Questionnaires will be mailed to a new pool of “several hundred” potential jurors around Sept. 1. Opening statements are set for Jan. 30.
Judge Cahill’s order said he won’t entertain any potential plea agreements from Thao or Kueng until 15 days after their federal sentencings. They rejected plea deals from prosecutors earlier. U.S. District Judge Paul Magnuson has not set dates for sentencing Chauvin, Thao, Kueng & Lane on their federal civil rights convictions. Defense attorneys said during a hearing before Judge Cahill last week that they were expecting the sentencings sometime in September.

6/20/22 Update: Prosecutors are asking that the trial of Thao & Kueng to begin months earlier than currently scheduled. Assistant Minnesota Attorney General Matthew Frank wrote Friday to Hennepin County District Judge Peter Cahill that the filing was being made "on behalf of the family of George Floyd," who died on May 25, 2020, while under the knee of another fired officer, Derek Chauvin. Frank cited the "speedy trial" provision under the state's court rules of criminal procedure in making his request. The one-page document offered no further elaboration. Kueng's defense attorney filed a response over the weekend that not only seeks to have the trial pushed even further out by at least three months from its current Jan. 5 start, but he also disclosed that there have been at least two meetings in Cahill's chambers, where plea negotiations were discussed. The first meeting occurred on March 9, followed by another on May 27, nine days after fellow fired officer Thomas Lane pleaded guilty for his role in Floyd's death while in police custody. Cahill has scheduled a hearing on the matter for 8:30 a.m. Tuesday, 6/21/22, when attorneys on both sides will be heard. If the speedy trial request is granted, the trial could start in mid-August.

Chauvin still awaits sentencing for the federal conviction. He is currently serving 22 ½ years in prison for murder & manslaughter convictions in State court for Floyd's killing. The government is recommending a 25-year sentence for Chauvin. He would serve the sentence concurrently with his state sentence, and in a federal prison, under recommendations in the plea agreement. No sentencing date yet.

6/17/22 Update: The revised schedule that Judge Cahill laid out calls for hearing pretrial motions Jan 5-6, with jury selection beginning Jan. 9. Questionnaires will be mailed to a new pool of “several hundred” potential jurors around Sept. 1. Opening statements are set for Jan. 30.
Judge Cahill’s order said he won’t entertain any potential plea agreements from Thao or Kueng until 15 days after their federal sentencings. They rejected plea deals from prosecutors earlier. U.S. District Judge Paul Magnuson has not set dates for sentencing Chauvin, Thao, Kueng & Lane on their federal civil rights convictions. Defense attorneys said during a hearing before Judge Cahill last week that they were expecting the sentencings sometime in September.

6/20/22 Update: Prosecutors are asking that the trial of Thao & Kueng to begin months earlier than currently scheduled. Assistant Minnesota Attorney General Matthew Frank wrote Friday to Hennepin County District Judge Peter Cahill that the filing was being made "on behalf of the family of George Floyd," who died on May 25, 2020, while under the knee of another fired officer, Derek Chauvin. Frank cited the "speedy trial" provision under the state's court rules of criminal procedure in making his request. The one-page document offered no further elaboration. Kueng's defense attorney filed a response over the weekend that not only seeks to have the trial pushed even further out by at least three months from its current Jan. 5 start, but he also disclosed that there have been at least two meetings in Cahill's chambers, where plea negotiations were discussed. The first meeting occurred on March 9, followed by another on May 27, nine days after fellow fired officer Thomas Lane pleaded guilty for his role in Floyd's death while in police custody. Cahill has scheduled a hearing on the matter for 8:30 a.m. Tuesday, 6/21/22, when attorneys on both sides will be heard. If the speedy trial request is granted, the trial could start in mid-August.

judge on Tuesday rescheduled the state trial for two former Minneapolis police officers in George Floyd's killing to Oct. 24 to resolve dueling requests for a new trial date after the state sought to start it as soon as this summer while a defense lawyer asked to delay it to next spring.

Attorneys for all sides told Cahill they agreed to the Oct. 24 start date for jury selection. The judge also scheduled a hearing on pretrial motions for Sept. 26-27.

June 23 (Reuters) - Federal prosecutors requested a 25-year prison sentence for former Minneapolis police officer Derek Chauvin for violating George Floyd's civil rights during his arrest and murder, online court records showed.

In a motion filed on Wednesday in the District Court of Minnesota, U.S. Department of Justice attorneys said Chauvin abused his authority as a police officer and damaged public trust in law enforcement and the criminal justice system.

They recommended a 25-year prison sentence as part of a plea agreement between prosecutors and Chauvin, who pleaded guilty to violating Floyd's civil rights in December. Chauvin faced the risk of life in prison if he went to trial.

District Judge Paul Magnuson has yet to set a date for the sentencing hearing.

A state judge sentenced Chauvin to 22-1/2 years in prison in June 2021 after a jury convicted him of the 2020 murder of Floyd.

In the motion on Wednesday, federal prosecutors asked for the federal sentence to run concurrently with the state sentence.

MINNEAPOLIS (AP) — Federal prosecutors asked a judge Wednesday to sentence one of the four former Minneapolis police officers convicted of civil rights violations in George Floyd’s killing to as many as 6 1/2 years in prison but to impose significantly stiffer yet unspecified sentences on two others.

They urged U.S. District Judge Paul Magnuson to follow the nonbinding federal sentencing guidelines for former Officer Thomas Lane and impose a penalty between 5 1/4 and 6 1/2 years on prison.

Prosecutors also said former Officer J. Alexander Kueng deserves a “substantially higher” sentence than Lane’s, but less than the 20 to 25 years Derek Chauvin is expected to get. And they said they’ll seek a ”comparable” sentence to Kueng’s for former Officer Tou Thao.

Magnuson has not set sentencing dates for the four former officers. The federal civil rights cases were separate from the state murder and manslaughter charges against them.
