MINNEAPOLIS (AP) — Federal prosecutors asked a judge Wednesday to sentence one of the four former Minneapolis police officers convicted of civil rights violations in George Floyd’s killing to as many as 6 1/2 years in prison but to impose significantly stiffer yet unspecified sentences on two others.

They urged U.S. District Judge Paul Magnuson to follow the nonbinding federal sentencing guidelines for former Officer Thomas Lane and impose a penalty between 5 1/4 and 6 1/2 years on prison.

Prosecutors also said former Officer J. Alexander Kueng deserves a “substantially higher” sentence than Lane’s, but less than the 20 to 25 years Derek Chauvin is expected to get. And they said they’ll seek a ”comparable” sentence to Kueng’s for former Officer Tou Thao.

Magnuson has not set sentencing dates for the four former officers. The federal civil rights cases were separate from the state murder and manslaughter charges against them.

I wonder after all this time,if this case has positively affected junior, or subordinate police officers to stand up to a senior officer when they experience situations that are contrary to their training. I hope this case gives them the security (and reality) to do the right thing and report the bad cops who deserve to be fired.

Chauvin's plea agreement calls for a sentence of 20 to 25 years in prison. Federal prosecutors last month asked for 25 years, on the high end of that range, saying his actions were cold-blooded and needless. The defense's sentencing position remains sealed.

Former Minneapolis police officer Derek Chauvin will be sentenced to between 20 and 25 years in federal prison Thursday. He pleaded guilty late last year to federal charges that he violated George Floyd’s civil rights when he took Floyd’s life in May 2020.

Chauvin is currently serving a 22 and a half-year sentence for his conviction on state murder and manslaughter charges at the Minnesota Correctional Facility in Oak Park Heights. As part of his federal plea agreement, Chauvin will serve his state and federal sentences at the same time in federal prison.

*Sentencing Hearing (@ 2pm CT) - *Federal Grand Jury indicted & charged (5/7/21) Derek Michael Chauvin (44/now 45) for violated Floyd’s civil rights. Charged with violating Floyd's right to be free from unreasonable seizure, unreasonable force by a police officer & for failure to provide Floyd with medical care. Also indicted & charged (5/7/21) in a second indictment (stemming from the arrest & neck restraint of a 14-year-old boy in 2017) with Count 1 without legal justification held the teenager by the throat & struck the teenager multiple times in the head with a flashlight. Alleges that this offense included the use of a dangerous weapon-a flashlight & resulted in bodily injury to teenager. Count 2 charges that Chauvin held his knee on the neck & the upper back of teenager even after the teenager was lying prone, handcuffed & unresisting, also resulting in bodily injury.

6/4/21 Update: Magistrate Judge Tony Leung said the four men would be arraigned Sept. 14, subject to any further orders from the court. A date for trial has not been set. 12/15/21 Update: Changed plea to guilty to all charges, will be sentenced later.
5/4/22 Update: U.S. District Court Judge Paul Magnuson as accepted Chauvin's plea deal & will sentence him to 20 to 25 years in prison. That sentencing range was laid out in the plea agreement filed months ago, which also mentioned Chauvin would be expected to serve between 17 & a little over 21 years, "assuming all good-time credit." At the federal level, Chauvin pleaded guilty in December, 2021 to violating Floyd's civil rights after months earlier pleading not guilty. The maximum sentence is life in prison. The judge had put off accepting Chauvin's plea agreement while a preliminary presentence investigation report was done. Based on the plea agreement filed, the federal sentence would be served concurrently with the 22.5-year sentence tied to his murder conviction at the state level. Lane is also due to be sentenced on Sept. 21 after pleading guilty in state court to aiding and abetting second-degree manslaughter. Thao and Kueng turned down plea deals and are due to be tried in state court Oct. 24 on aiding and abetting charges.

Just an FYI - for State charges: Thao & Kueng have a pretrial motions hearing on 9/26 & 9/27/22 & then a Motion in Limine hearing on 10/6 & 10/7/22.
No sentencing date yet - :rolleyes:

I wanted to comment on a few things. Just my opinion.

-"During the sentencing, U.S. District Judge Paul Magnuson said that Chauvin "must be held responsible" for his actions, including destroying the lives of the other three officers involved in Floyd's death."

Good for the judge acknowledging the reality that Chauvin, as the senior police officer at the scene, wielded the (perceived) authority over the other officers. This has been a tragic lesson for all officers at the scene who caved under his directions, regardless of their training. The judge's comment (imo) is a warning to police forces to weed out rogue, brutal cops, and a warning to junior officers to follow their training and resist and report bad cops.

-"I really don't know why you did what you did," the judge said. "To put your knee on a person's neck until they expired is simply wrong. … Your conduct is wrong and it is offensive."

George didn't deserve to be murdered, and the court trial has proven that. I would like to correct Judge Magnuson's sentiments on this, that putting one's knee on a person's neck until they die is "wrong" and "offensive". No Judge, it is cruel and murderous. Farting in an elevator is wrong and offensive.

Prior to his sentencing Thursday, Chauvin wished Floyd's children "all the best in their lives" and that they have "excellent guidance in becoming good adults," CBS Minnesota reports.

With no apology, I take Chauvin's statement as a backhand insult to George. Eg his message is I hope you kids don't turn out to be a bad adult like your dad.

ST. PAUL, Minn. (AP) — A former Minneapolis police officer who is one of four ex-officers convicted of violating George Floyd’s civil rights is scheduled to be sentenced this week.

Prosecutors have asked a federal judge to sentence Thomas Lane to between 5 1/4 to 6 1/2 years in prison on Thursday, [7/21/22] for his role in the restraint that killed Floyd on May 25, 2020. His attorney is seeking 27 months.

Judge Paul Magnuson, who presided at the three officers’ trial, also scheduled a hearing Friday [7/22/22] on objections by Kueng and Thao to how recommended sentences under the federal sentencing guidelines were calculated in their presentence reports.

Thao’s attorney, Robert Paule, is seeking a sentence of two years. The recommendation from Kueng’s attorney, Thomas Plunkett, remains sealed.

Lane’s attorney, Earl Gray, has asked for 27 months, which if granted would let Lane go free after two years. That’s about when Lane would become eligible for release on his recommended state sentence in a plea agreement on a state charge of aiding and abetting manslaughter. Sentencing in that case is set for Sept. 21.

Alexander Kueng (26/now 28) for violated Floyd’s civil rights. Charged with violating Floyd's right to be free from unreasonable seizure, alleging they willfully failed to intervene to stop Chauvin’s unreasonable force, resulting in bodily injury to & the death of Mr. Floyd & failure to provide Floyd with medical care.
Only for Thomas Kiernan Lane (37/now 39) is charged with failure to provide Floyd with medical care. All released on $25K unsecured bonds. All plead not guilty on 9/14/21.
Trial began on 1/20/22 with jury selection. Jurors were selected. 12 jurors: 5 men & 7 women & alternates: 3 men & 3 women. Trial began on 1/24/22 with opening statements. Former Minneapolis police officer Tou Thao was convicted of violating Floyd's constitutional right to be free from unreasonable seizure by failing to stop Chauvin's unreasonable force. Also find Thao guilty of failing to render aid. Former Minneapolis police officer Thomas Lane convicted of failing to render aid to Floyd. Former Minneapolis police officer J. Alexander Kueng convicted of failing to intervene. Kueng also convicted of failing to render aid. Magnuson said he would urge the federal Bureau of Prisons to send the ex-officer to a facility in Duluth, nothing that he did not believe Lane warranted being incarcerated at a higher-security prison. Magnuson set 10/4/22 self-surrender date for Lane, explaining that it would follow his 9/21/22 State court sentencing.

4/4/22 Update: Motions hearing on 4/11/22. 5/18/22: Hearing on 5/18/22. Lane plead guilty to a state charge of aiding & abetting second-degree manslaughter. As part of Wednesday’s plea deal, Thomas Lane will have a count of aiding & abetting 2nd degree unintentional murder dismissed & will be sentenced on 9/21/22. Kueng & Thao: Next pretrial motions hearings on 9/26/22 & 9/27/22. Motions in Limine hearing on 10/6/22 & 10/7/22 @ 9am each day by Zoom.

Only he showed some remorse and pled guilty (plea deal).
Only his mugshot showed emotions, shame and despair.
And only he went in ambulance and tried CPR.

A federal judge will sentence the remaining two former Minneapolis police officers convicted of violating George Floyd's civil rights during his 2020 killing in back-to-back hearings next week in St. Paul.
J. Alexander Kueng and Tou Thao will be sentenced Wednesday [7/27/22] for a pair of convictions handed down by a federal jury earlier this year. Kueng and Thao are still awaiting an Oct. 24 trial in Hennepin County on state charges of aiding and abetting second-degree murder and manslaughter, but their federal sentencings will bring to a close the Justice Department's criminal civil rights prosecutions stemming from Floyd's murder.

After a half-hour hearing Friday to dispute sentencing guideline calculations, Kueng and Thao now also stand to receive lesser sentences than they might otherwise have received. Magnuson sided, in part, with arguments raised by attorneys for the two ex-officers by finding that involuntary manslaughter and not second-degree murder should be used to calculate the offense levels in their cases.

Magnuson found that those facts precluded the element of "malice aforethought" necessary to prove second-degree murder.

Magnuson rejected a motion from the defense attorneys not to enhance the penalty based on the two men acting under "color of law," arguing that their position as law enforcement officers was already addressed in the criminal conviction.

Kueng and Thao also asked for a reduction in the calculation for "mitigating roles" in the crime. But Magnuson wrote that because the "mitigating-role determination is unique to each Defendant and dependent on the facts of each case, the Court will rule on these requests at sentencing."

A federal judge has sided with two former Minneapolis police officers convicted of violating George Floyd’s civil rights, saying the guidelines for their sentences will be calculated in a way that could mean substantially less prison time for them. U.S. District Judge Paul Magnuson handed J. Alexander Kueng and Tou Thao a victory on Friday when he ruled that the complex formulas for calculating their sentences will be based on involuntary manslaughter, rather than murder, as a starting point.
