I would think they could plead guilty but they never do of course.

A jury would have to be impaneled for the penalty phase as I believe a single Judge cannot pass a sentence of death that it must be done by a jury of 12. (rather new law) ruled on by the Supreme Court. (going from memory lol) I believe it was a ruling handed down last year.

They will hold out for trial though hoping for that one lone wolf that cant vote for death. These two will not find such "wolf". IMO.

I'm not 100% sure of the details but I seem to remember it that way. I just tried searching for more information on whether or not the death penalty can be imposed without a trial but can't seem to locate anything on that specific question.
 
They were just reporting on the local news here that they have now confessed to another womans murder, not releasing any names yet. I don't think anybody is surprised to know there are others and I will not be surprised to hear there are more yet to come out.

I'm pretty sure that even if the death penalty requires a jury, that doesn't preclude a guilty plea to the charges, then a separate penalty portion of the trial with a jury.

I just hope that even if they confess to a multitude of murders that the fact that they did this weighs on the outcome. People like them don't need to be supported on the taxpayers dollar. There should never be a deal to spare their lives when the same option was ever given to the victims.

So Michelle Huff is Michelle Ricci? Maybe they had just started their killing spree and two women were the only ones murdered.

I wonder if there will be more women that will come forward though saying they were tied up and viciously raped by this duo.

Richard D. Davis, 41, and Dena D. Riley, 39, were charged with one count each of kidnapping. If convicted, they could face from 20 years to life in prison.

The girl was "seriously injured during a sexual assault" after Riley and Davis took her from her home in Arcadia, U.S. Attorney Eric Melgren said. No charges were filed in the alleged sexual assault.

The couple already face charges of murder, assault, kidnapping, rape and sodomy in Jackson County, Mo., in the death of 41-year-old Marsha Spicer. Her body was found May 15 in a shallow grave in Bates City, Mo., east of Kansas City.

I feel so sorry for that little girl, I hope she is able to heal from her experience, it's taken me many years. This duo of pigs is just like Leonard Lake & Charles Ng, and James Daveggio & Michelle Michaud here in California! Nothing but sexual predators, torturers, and murderers! :waitasec: Why would they not have filed charges in the alleged sexual assault? Is there something they're waiting for before doing so?

Many times the prosecution will try defendants on the most serious crime when multiple crimes are commited. That way they have a backup if they are unable to get a conviction. That would be my guess.

Makes sense; I just thought that they'd look for justice for this child. But then again, maybe sparing her the retelling of her ordeal at her young age is a better idea. I'm not sure what would be required of a 5 year-old if a trial were to be held for a sexual assault against her.

In a deal with prosecutors that allowed her to avoid the death penalty, Dena Riley, 42, pleaded guilty to first-degree murder in the May 2006 death of Marsha Spicer, who was suffocated during sex at an Independence apartment that Riley shared with her boyfriend.
Riley also pleaded guilty to kidnapping, sodomy and sex abuse in the videotaped attack on Spicer, 41, of Independence, and to kidnapping, sodomy, sex abuse and assault in a separate videotaped attack on Michelle Huff-Ricci, 36, of Kansas City. Riley sobbed throughout the hearing as she answered each question from the judge, prosecutor and defense attorney with a simple "yes" or "no."
Huff-Ricci's remains were found in nearby Clay County, where Riley and her boyfriend, Richard Davis, are charged with capital murder

You know, there needs to be something worse than life in prison or the death penalty for people like this woman and her boyfriend. I'm an impatient person I don't want to wait for judgement day for them to get theirs.

Not only do I feel bad for the victims, their families, but the jury also. They had to sit and watch the videos.
