The state rested their case.....
Has there been any mention to the Jury the reason before or during the trial to explain the absence of the victim's family? Has anyone been there for him, any friends, etc?

NOT just yet. Judge is reviewing jury instructions with Attorneys.
They still haven't made closing arguments.
Trial is not over yet.

No,. not yet........we still have closing arguments, but that was a fast trial...

Yeah, that was fast... I am surprised that the defense presented nothing. Wonder if that was the defendant's decision.

Well, what could they possibly present, if you think about it...there is nothing..
Now, this is what you call a slam dunk case. JMO

ETA....I just wish this was a DP case.....

Def. objects to the addition of "Acting in Concert" to the charges vis a vis Phillip Maybrey. Shields says what she usually sees is that a 2nd person charged in the crime for Acting in Concert. (This is b.s., IMO) For better or worse, "in Concert" was used in the Jason Young trial and there was no 2nd person charged at all. Shields has nothing to cite for her argument at this time, but will research over the w/end. Judge says he has seen A.i.Concert used many times where there is no named 2nd defendant. This is held to dicuss Monday.

No one asked for "lesser included charges" -- quite often, in many M1 cases, the judge will include it so that not having it will not be grounds for an appeal. We'll see how that goes during the charge to the jury. Not in this one -- no M2 to be included.

The judge checked with a deputy(?) re the writ for for Steven (Stephen) Oates appearing in court, & deputy says he was able to cancel or reverse it.

So Mr. Oates will not be taking a bus ride to Durham, I guess.

  • So it's 9:00amEDT on Monday for the principals & 10:00am for the jury.
  • Closing arguments -- def will go last & have the final word since they did not present a case (in all other cases, the State has the option to go last, which they always choose).
  • Then the charge to the jury/jury instructions on the law to weigh & decide the verdict.
  • Then deliberation, then verdict.

When will we have a verdict?

I just got home and finished reading the thread from when I left. It seems a lot happened since then, I am in shock that the trial is over already.

I am going to see if someone has the archive for this afternoons portion. So the defense didn't put on a case, well they shot their-selves in the foot all during the trial. imo

My bet is a verdict by the end of the day on Monday!

I am now listening to the cross from the defense of Sgt Lehew. Is the defense attorney trying to help or hurt is client the defendant LL?

I have a feeling he isn't helping LL at all. Sgt Lehew is not the right witness for him to asking all of these questions. imho

Thanks Borndem. I was just fortunate enough to be paying attention Wednesday when defense presented the argument to disallow the eve carson evidence as prejudicial. I was almost expecting Judge to rule in defense's favor and was delighted and a bit surprised when he allowed EVERYTHING! Did a little happy dance. :happy dance:

"It is clear, it is relevant. It is necessary, and the probative value does not substantially outweigh the danger of prejudice," Durham County Assistant District Attorney Storm Ellis told Hardin.
