I wonder if there is any connection between the murder and the music recording studio recently set up in the McCutcheon home.

And more recently, he had set up a studio in the yellow house he shared with his wife on Tree Top Drive, where longtime friend and singer-songwriter Whittington last year recorded her first album, “Muse.”

I fear the person who committed his crime will get away with it. 6 weeks now and no arrest.

I don't agree. It just takes time. Have faith! They have to have enough evidence to convict in court. If they don't have any direct evidence, they'll take longer. Tick tock, IMO. That gun in the ivy between the houses is sure interesting. I'm dying to know what neighborhood surveillance cams show (or fail to show).

But how does one embezzle from his own practice? If he was proud to introduce the staff, he must have been the practice owner.

And why do they keep bringing up the name of his longtime friend and fellow musician? It's not like she's famous.

i believe Roxanna Whittington was just a friend and fellow musician. One of his employees said on another site that he was unaware of any outstanding taxes owed and had nothing to do with the financial part of the practice and that BM handled the finances in the practice. I wish I could find the link to that post.

If I found my husband had been shot while he slept on the couch, I would've been screaming for an ambulance to hurry! I also would've taken a few days to mourn and HAVE A FUNERAL before packing up the practice and our home.

There's absolute no mention on the local news or newspaper about this, so it looks as if LE has no suspect and has dropped the ball. Hopefully I'll be proved wrong!

I was thinking that there could be someone else who might have been utilizing the music studio in the house. That person might be familiar with house layout, behavioral habits, location of gun in home (if the gun found in the ivy was indeed owned by McCutcheon’s).

Real estate sale is still PENDING.
http://www.zillow.com/homedetails/43-Tree-Top-Dr-12-Arden-NC-28704/2097443880_zpid/

If the house sale is finalized, that would lead me to believe the investigation by NC Department of Revenue hasn’t yet resulted in something conclusive. I wonder if the house sale could be put ‘on hold’ because of an ongoing NC DOR investigation.

I found this information:
http://www.dor.state.nc.us/collect/jeopardy_faq.html
What is a Jeopardy Assessment?

NC Gen. Stat. §105-241.23 authorizes the NC Department of Revenue to immediately assess and collect any tax the Department finds is in jeopardy. In making a jeopardy collection, the Department may use any of the collection remedies in NC Gen. Stat. §105-242 and is not required to wait any period of time before using these remedies.

Why did I receive a jeopardy assessment?

You may receive a jeopardy assessment if you meet any of the following conditions:
1. The taxpayer is or appears to be planning to quickly leave the state or to hide in order to defeat a tax liability.
2. The taxpayer is or appears to be planning to quickly place property beyond the reach of the Department either by removing it from the state, concealing it, dissipating it, selling it or transferring it to other entities.
3. The taxpayer’s financial solvency appears to be imperiled.
4. The taxpayer’s financial solvency appears to be imperiled by continued business operations and refusal to pay collected trust taxes.
5. Past legal actions have not resulted in compliance.

Backstory:
http://www.foxcarolina.com/story/32...igated-as-murder-amid-embezzlement-suspicions
According to the warrant, McCutcheon's wife said she received a letter nine days earlier from the North Carolina Department of Revenue (NCDOR) asking for records pertaining to payroll reports and the couple's personal income tax records.
Detectives said NCDOR confirmed the documents were requested as part of a criminal investigation into the office and couple, concerning possible embezzlement and false pretense violations.

BBM

More than likely, imo, payroll taxes. They probably kept the money withheld from employees wages instead of sending it to the IRS and state dept of revenue.

IRS really hates when people do that.

I so wish I could find the site where one of the employees posted that Dr Mc had nothing to do with the finances of the practice and was blind sided by the tax investigation. Maybe the post was removed.

My opinions only.

Wife moved to Atoka TN?

Buncombe County tax bill records for the Arden NC property showa PO Box in Atoka TN.
That is near the AR border, about 490 miles W of Arden NC.

I think, eventually, both investigations will catch up with her.

Certainly the IRS has put a lien
on her house. And maybe their bank account? The IRS has incredible power to make sure they get their taxes. 25 years ago the IRS put a hold on my bank account for $325 they said I owed them. Had to pay an accountant $300 to figure out they were wrong. (That's when I was making $12,000 a year.) Scary stuff.

Yes, the IRS is powerful. I don’t recall reading that the IRS was pursuing F or B McCutcheon or the business. On Buncombe County records, I don’t find any liens recorded against their property. Was it reported that IRS is involved?

No, it sure doesn't. So sorry. My past experience with the IRS has skewed my sight and reason. 😲😓

It’s been two months since Frank McCutcheon was murdered in his home. It seems odd to have no update and no arrest.
Who was the owner of the gun found in the ivy?
Was that gun used to kill Frank McCutcheon?
Has LE solved the gun mystery but they are waiting for further forensic analysis of the crime scene?
