She hadn't been hit on by either of them by the time the strip poker was supposedly being played.

I understood that the passes were made and rejected prior to the card game.

I'm pretty sure they came about when everyone was out of clothes and SM suggested they could do "other things" when they lost a hand. That's when LM basically said, "I am in a committed relationship, so 'no' to kissing or watching you guys have sex."

He claims the defendant was infuriated that Lizzi refused both sexual requests... first to kiss Kat, and then to let him have sex with Kat in her presence. To jurors: "His actions were not a response, instinctual or an impulse, they were deliberate, he took the time to get the gloves, he took the time to select the rope… in that time he planned to kill and dominate Lizzi Marriott, that constitutes first degree murder.

Other than the strip poker part, the State's closing has been masterful. And there is more to come.

The strip poker is a little surprising, but heck, a friend caught her preteen daughter and little friends playing strip truth-or-dare in the basement during a slumber party. Even people who aren't that adventurous can do silly/titillating things at times. Maybe LM felt really comfortable with her body and didn't think it was a huge deal.

I did a really stupid stunt in college that involved nudity but no sex; however, there was alcohol on board, which makes me think the cider was spiked a bit. But then again, like you said, she could have just been really comfortable with her body/sexuality and didn't think it was a big deal.

Exactly -- they can't ignore it, and they can't say they don't buy it. They know they have got to sink or swim with it, so it's in.

On another note, during this amazing closing: I keep saying to myself, "Poor Lizzi, poor Lizzi." Oh, that poor young & special woman. She's gone forever at the hands of that slug. Grrrrrrrrr. That animal. He stole her life, her future, her hopes & her dreams, and destroyed those who love her. Life without parole. Life without parole. It must be; it must happen.

It's just difficult for me to believe in any innocence in strip-poker, that a person playing it would not consider it a prelude to sex, that someone who doesn't want to engage in sex would have the good judgement not to play. Maybe it's a generational way of thinking.

My understanding of kat's version is both hit on Lizzi and she turns them down but agrees to play strip poker. In kat's version she is naked and Lizzi is down to her panties and then they all watch a movie??? During which seth sends the painting text and the assault starts.

I don't buy kat's version.

Ward points out what the DNA evidence shows... he claims Seth wrote in his letter that he wore a condom with Lizzi but that it broke, to cover up her DNA on his underwear. But the condom that was recovered, did not have any of Lizzi's DNA on it.

I prefer dominoes. Everyone keeps their clothes on, no hazy misunderstandings, no hurt or angry feelings resulting from mixing nakedness with young people. I guess I am old school.

When I was in college, in the fraternities/sororities, there were some risqué co-ed drinking games that were not preludes to sex, nor did the women involved have any intention of engaging in sex. Maybe it wasn't smart... but that's a different issue.

Agree. Just like I don't have a death wish so you won't catch me playing Russian Roulette. Makes no sense to me.
