She is the only one who testified to an intentional killing and she is the only one who has anything to gain by him being convicted of M1.

True. His conviction or not is of no consequence to Kat's sentence.!!!

The third charge is 2nd degree murder... that Seth Mazzaglia recklessly caused the death of Elizabeth Marriott, showing an extreme indifference to life by strangling her. The judge explains that they must first consider the two alternative first degree murder charges... and decide those beyond a reasonable doubt. Only then would the move to the second degree charge. They cannot find him guilty of both a first and second degree charge.

The fourth charge the judge explains... CONSPIRACY TO COMMIT TAMPERING WITH WITNESSES OR IFORMANTS. The judge lists 13 different overt acts under this charge... each of which constitutes an agreement between Mazzaglia and one other person... such as concocting a false alibi with Kat McDonough.

This is the best charging I've ever heard! Know some said upstream too verbose, but for myself, it laid it alllllllllllllllllllllll out! Great follow up summary of the prosecutions closing statements, even better! And it's in PRINT for the jurors to read?

ETA: But would y'all not agree this is best that it's being done in the am :giggle: vs. after a lunch break or late at the end of the day. GREAT that they didn't do this yesterday at EOD!
