I would think they would be considered accomplices after the fact or accessories to the crime or to the cover-up. This isn't like driving down the street and seeing someone rob a bank. They were invited into a murder scene and touched the body and discussed disposing the body. Then left and said nothing. How long they were there, what they really know and how involved they were are all speculations based on the tales of the four people that were in that apartment who all seem to have different tales.
If you wrote this story out as a fiction, no one would think it believable.
