Law enforcement agencies, fire departments and other first responders all along I-25 between Albuquerque and Las Cruces will join the escort, which is expected to leave Albuquerque [on Monday] at 2:00 p.m. The Las Cruces Police Department says the procession is likely to roll through Socorro about 3:00 p.m., through Truth or Consequences about 4:00 p.m., through Hatch about 4:40 p.m. and into Las Cruces around 5:00 p.m.

A public funeral for Officer Chavez is scheduled to take place at 3:00 p.m. Sunday, August 21 at the Pan American Center on the campus of New Mexico State University. Doors will open at 1:00 p.m.

A statement of facts obtained by the ABC-7 I-Team details the shooting of a Hatch police officer and the ensuing car chase, carjacking, and arrests.

The document states an FBI agent interviewed Jones, who said he was in the vehicle with Hanes and Nelson. Jones said he was asleep in the backseat and woke up when Chavez pulled them over. Jones told police he saw Hanes pull out a gun and shoot Chavez. While they were driving away from police, Hanes allegedly shot himself, Jones said.

Nelson told police he also fell asleep in the car and woke up when Chavez pulled them over. Nelson said Chavez asked for the vehicle's registration and for Hanes to exit the vehicle when Hanes pulled out a gun and shot the officer. Nelson said Hanes was wearing a red shirt at the time he shot the officer.

Both Hanes and Jones told investigators they exited the Lexus and were left behind. Police arrested Jones after a search of the suitcase he was carrying allegedly turned up methamphetamine. Nelson was arrested on a "fugitive from justice" charge on an outstanding warrant for a murder in Ohio.

The statement of facts also states paramedics who airlifted officer Chavez to University Medical Center in El Paso said he suffered a single gunshot wound in the upper chest/lower throat area just above his ballistic vest. Officer Chavez was conscious and breathing during transport to UMC. Hospital officials said surgeons performed emergency trauma surgery, but officer Chavez died at about 8 p.m. Friday.

James Nelson, 36, of Columbus, Ohio, and Tony Marcell Jones, 44, of Hannibal, Missouri, made their first court appearances before Judge Richard Jacquez via video from the Doña Ana County Detention Center.

Jones and Nelson also were formally charged on Monday, court records show. They are each facing drug charges. Neither are charged in Chavez's death.

But Chief Deputy District Attorney Gerald Byers asked for Jones’ bond to remain the same, saying that he is flight risk and a danger. Byers indicated that Jones may have been involved in other crimes with Hanes and Nelson, including bank robberies in several states.

Nelson, meanwhile, was charged late Monday afternoon with trafficking by possession with intent to distribute methamphetamine, a second-degree felony, and distribution of marijuana and possession of drug paraphernalia, a fourth-degree felony. He was initially charged only with being a fugitive from justice.

Jacquez said Nelson will be “held on the local charges” until they are resolved. After that, he will be extradited to Ohio to face the murder charge.

Federal prosecutors on Tuesday charged a suspect in the murder of 33-year-old Hatch police Officer Jose Chavez with federal firearms and carjacking offenses.

The state is charging Jesse Hanes, 38, with first-degree murder, willful and deliberate, according to court documents.

Federal prosecutors are now also charging Hanes with federal crimes including being a felon in possession of a firearm; carjacking resulting in serious bodily injury; and discharging a firearm during a crime of violence, according to the U.S. Attorney’s Office in New Mexico.

The case was investigated by the Las Cruces office of the FBI, Hatch Police Department, Doña Ana County Sheriff’s Office and New Mexico State Police, with assistance from the Third Judicial District Attorney’s Office. The following agencies also assisted in the investigation: Albuquerque and El Paso offices of the FBI, ATF, DEA, U.S. Marshals Service, Homeland Security Investigations, U.S. Border Patrol, Las Cruces Police Department, El Paso, Texas, County Sheriff’s Office and El Paso Police Department.

Assistant U.S. Attorneys Aaron O. Jordan and Marisa A. Ong of the U.S. Attorney’s Las Cruces Branch Office are prosecuting the case as part of a federal anti-violence initiative that targets “the worst of the worst” offenders for federal prosecution. Gov. Susana Martinez has ordered flags across the state to be lowered in an honor of a police officer killed last week in Hatch.

Martinez says the senseless killing of Officer Jose Chavez during a traffic stop Friday is a tragic reminder of the dangers law enforcement officers face every day.

Flags will be flown at half-staff on Wednesday.

Funeral services for Chavez, who was 33 and a father of two, are set for Sunday in Las Cruces, his hometown.

Authorities say he was a two-year veteran of the Hatch Police Department.

A wreath of white flowers in the shape of badge No. 105, American flags and blue bouquets decorated the stage at a funeral Sunday for fallen Hatch police officer Jose Ismael Chavez that drew thousands.

Originally from Mexico and a naturalized U.S. citizen, Chavez joined the tiny police department in the Village of Hatch two and a half years ago and displayed exactly the qualities Chief James “Trey” Gimler was looking for in a new officer: character, work ethic, honesty and commitment, he said in a letter read by Doña Ana County Sheriff’s spokeswoman Kelly Jameson, with Gimler at her side.

Gov. Susana Martinez spoke at the funeral, her voice breaking.

“He achieved the American dream of becoming a law enforcement officer and wore a uniform with amazing pride and purpose,” she said.

Then, addressing Chavez’s two girls, 6-year-old Aryam and 14-year-old Jannely, Martinez said through tears, “It’s never easy to lose a loved one… but you should know that your daddy will be walking alongside you for the rest of your life as your guardian angel. And his brothers and sisters in law enforcement will be there for you as well because they are your family.”

Jesse Hanes was indicted on Thursday for the murder of Officer Chavez.

The grand jury in the 3rd Judicial District returned an indictment on felony murder, drug and assault charges against 38-year-old Hanes: first-degree murder, willful and deliberate; trafficking methamphetamines; distribution of marijuana; possession of drug paraphernalia; aggravated fleeing a law enforcement officer; and two counts of aggravated assault with a deadly weapon.

“This is the most important case we have,” said District Attorney Mark D’Antonio. “It’s important for the process to move quickly. All suspects are innocent until proven guilty. But we are going to spend resources ensuring justice is done.”

The grand jury on Thursday also returned indictments on Nelson and Jones. Nelson faces drug trafficking, distribution and possession charges, and Jones faces a drug possession charge.

Regarding whether the state or federal government will proceed first in their cases against Hanes, D’Antonio said he is in communication with the Office of the U.S. Attorney in New Mexico and said, “There will be no squabbling.”

“We’re going to do whatever is best for the case,” he said.

Suspect in officer's slaying rejects plea deal
The Ohio man facing state and federal charges in New Mexico in connection to last year’s slaying of a Hatch police officer, in addition to aggravated murder charges out of Ohio, rejected a global plea agreement offered by federal prosecutors, the state of New Mexico and the state of Ohio.

He will now face trials in both states.

Jesse Denver Hanes, 39, of Columbus, Ohio, appeared in 3rd Judicial District Court and agreed to plead guilty to first-degree murder in a deal that saw the state dismiss*six other charges related to the Aug. 12, 2016 fatal shooting of Officer José Chavez.

Ramirez recalled the day she had received the picture from her son on Thursday, when she learned the fate of his convicted killer in a Las Cruces courtroom.

"He came to me real proud of himself and told me, 'Mother, I took a picture for you. Do you like it?'" she told the court, speaking through a translator. "I told him, 'It's wonderful.'"

She clutched the framed portrait tightly in her arms as Jesse Denver Hanes, the Ohio man who fatally shot her son in the line of duty last year, was sentenced to a mandatory term of life in prison without the possibility of release or parole.

In June, James D. Nelson pleaded guilty to one count of trafficking methamphetamine. During a search of the silver Lexus, officers discovered about 61 grams of methamphetamine and 30 grams of marijuana, according to court records.

Nelson was sentenced to nine years in prison, but six years were suspended, court records show. He also was sentenced to two years of parole and five years of probation.

In March, Tony Marcell Jones pleaded guilty to one count of possession of a controlled substance. He was sentenced to two years and six months in prison, but the term was suspended and he placed on supervised probation for 18 months, court records show.

The murder charges in Ohio are still pending.
