I kindly disagree and I am not trying to argue in anyway and I respect your opinion completely. The PT was not perfect and I have know way really to judge them because it is not like I know their record of wins or the law and for me watching I have to recognize it is not an episode of Law and Order and the state had a lot of restrictions put on them during the pre trial and I am sure that was a blow. IMO the judge has a full docket and he is getting farther and father behind... courts are so overwhelmed. I am not making excuses but it does sound like it. I am just thinking what is the judge's motive but of course I do not know. LC and the defense had enough rope to hang themselves. I am prepared to be disappointed I always do that for trials but I think the PT overall got the job done. Maybe I have not agreed or liked their style all of the time. I think the jury will come back with a guilty. That is just me though and I don't know of course.

Hey, no prob CJ, I didn't know anything about this case beforehand so I just let the proceedings sway me one way or the other. I'm not sure the PT put the gun in LC's hand to a certainty greater than reasonable doubt.

I know the PT didn't get the cooperation from APD like they probably do on most other cases, but I still think they conceeded too much, all the way to the end. Serna trying to exclude the line about jurors giving the evidence the weight they think it deserves just shows how far he thinks he can get with the judge.

Just moo :)

All rise for the judge.....camera picture jury coming in!

Joseph Cordova on the stand. Lady prosecutor at the podium.

# 221 through #225 Mr. Cordova looking over the papers.

Yes maam. A court order for.....Serna jumps in!......wants evidence by number! Prosecutor reading off what the papers are and their numbers.

Witness reconizes the documents.....do they accurately reflect the guardianship papers....yes!

Prosecutor asking why they applied for guardianship......daughter was a minor who was covered under parents insurance....met with Levi Chavez and his family.....wanted the Chevaz family to help with insurance for the baby....but the Chavez family could not help so Cordova applied for guardianship so the baby would be covered on his insurance.......papers drawn up by Cordovas attorney.....so did Chavezs. All parties knew exactly what the guardianship papers were about.

Approach.....Serna has a question!

Prosecutor: Mr. Cordova....called him Mr. Chavez first.....was corrected......did you insure your granddaughter? Yes. Effective the day of her birth.......

Prosecutor called him Mr. Chavez again.....he corrected her again.......asking about the buriel....asking about the ashes. A chaplain from the APD asked him if there was something he could do for him......witness asked about some of the ashes......the chaplain got him the ashes.

Prosecutor done.....SErna up

Serna asking about the funeral service. Witness explaining about the different services.

and a were you aware under the law....Levi Chavez would need to authorize the release of the ashes? No I was not aware.....

Serna: mumble, mumble, mumble......about where the ashes went. Did you see the ashes at the funeral service.....yes but they were carried in. They were under glass...not fully sealed! Serna asking if witness is aware that the funeral home was supposed to be in charge of dividing the ashes......witness asks if you are telling me I have illegal ashes in my living room of my daughter.......Serna says of course I am not.

Serna asks if witness thinks the chaplain just scooped up a handful of ashes and put them in a jar......witness says I hope not!

Now Serna is asking witness about the case in chief that he did not like Levi Chavez at all...........mumble, mumble, mumble.......witness answers....no sir I do not like Levi Chavez

Serna asking about the attorneys that were hired for the guardianship........and now arbitration......about seperating holidays per Levi's request.

Witness puts on glasses to read whatever SErna put in front of him. Serna leaning over podium.

Witness answers Yes that is the original paper.
Guardianship papers covered two purposes.........define witness's rights with child and for health insurance.......the order does not say anything about insurance........joint guardianship........SErna picking at loose ends......this paper does not mention Levi or Tera, and does not say temperary........wow!

Serna moving on to the furniture.....Serna just said the civil suit was on hold right now.....I thought that had been settled.....or was that the lawsuit against the police department that was settled and now they are going after Levi?

I'm here, finally. I am watching Serna cross Mr. Cordova--I'll get caught up with you guys in a little bit. I hope I have not missed a lot of important stuff!

  • #3,347
Serna trying to bring in the civil suit things......color me surprised that it appears the judge set him down. The children came home from a visit......do the Cordova's have the children......the new wife insinuated that the children lived with her and Levi.

Witness going after Mr. Serna about the children and Serna just gave up.....LOL

The judge probably doesn't expect him to be convicted anymore than I do. The PT could have handled this trial so much better, I do hope the Cordova's feel as if just having the trial is a measure of justice, they sure had to fight hard enough to get them to try him.

geevee I am disappointed in the two state attorneys too but I think I got spoiled by watching the Conrad Murray trial (that Prosecutor was the best, someone here said that he has since become a judge) and J Arias's prosecutor who was like a bull dog.

I don't know what the state prosecutor's track record is like but I hold out that closing arguments will tie everything in this case together for the jury.

geevee I hope you are wrong but like you said just getting this case to see daylight should be a triumph for the Cordova family. I hope Levi gets what he deserves.

Judge talking to the jury......one day for all the closing arguments.....not going to break them up into two seperate days.....jury instructions about 20 minutes to read. 8:45 tomorrow morning.........

talking about how the 12 permanent jurors will be decided.........recessed for today

You explained that very well and you are right. That is why I am preparing myself for a not guilty too deep down so I don't let this case affect me deeply.

I'll read the posts from you all later.
Boy, it's good to be in this old chair. We are having horrible storms again and I had to drive in rain so hard I could not see anything in front of me for about 25 miles. My dogs haven't been out since 5:30 this morning.
I hope nothing or no one exploded in the courtroom today. I am so happy I got to see a little of Mr. Cordova's rebuttal testimony. I have so much respect for that man.
I hope everybody on here is well!!

Fifteen minute break then judge will hear from both sides about jury instructions

That would explain why we are still live in the courtroom.....it does not explain that walk by the male prosecutor up to the camera or the little smirk he had when about a foot from the camera tho!

Thank you!

Hearing the complete closing arguments on Friday will give the jurors the weekend to think over everything. I don't know how long each side has been granted for their closing--has it been said? So they may be able to start deliberations tomorrow afternoon. With this judge, they may just do closing arguments, and he send everybody home for the weekend, and begin deliberations on Monday morning.

I am glad you are okay and hope the storms don't cause any problems. Our dog doesn't like to go out in the rain unless she is desperate.

The only explosion you missed were of Serna throwing fits about testimony and evidence the PT was trying to bring in. Plus he was complaining about the juror instructions and this is what we are waiting on the judge for.

Thank you!

:floorlaugh:and now I am looking at a black screen! But they left the audio on so I could hear what sounded like a roll of duct tape being used for something.

That smirk bothers me too. Doesn't he know this trial is being televised and how the smirk may be thought of as cockiness. I cringed when Levi accused the PT of laughing. I only hope the jury heard Levi call Keener an a$$hole but I think they had been excused by the time he stepped down from the witness stand.

Serna...a prosecutor cannot advance arguments that are not supported by evidence! A lab report about DNA....Two swabs taken......the DNA off the gun!...The handgrip and somewhere else on the gun. He is reading from a report in his hand. Presense of blood is only on the handle and not on the muzzle. DNA of two or more individuals.....Levi and Tera.

Serna is arguing over what the prosecutor can argue in closing arguments.....(that's a lot of arguments). Serna is alright with prosecutor arguing that but wants special instructions to cover it in jury instructions.......LOL
