It kind of sounds that the sentence will be kind of like probation.

I might be misunderstanding it but that's me reading between the lines.

Yes ... or like a good behaviour bond. If he is not re-arrested for a crime, he won't be subject to imprisonment.

By default, the appeal will go to Justice Sonia Sotomayor, who handles emergency matters arising from New York. She could act on the application alone or refer it to the full court for a vote.

The question of votes comes amid news, first reported by ABC News, that on Tuesday, Trump called U.S. Supreme Court Justice Samuel Alito, one of the most far-right jurists on the top court, purportedly to discuss a job reference.

“We did not discuss the emergency application he filed [Wednesday], and indeed, I was not even aware at the time of our conversation that such an application would be filed,” Alito said, ABC reported. “We also did not discuss any other matter that is pending or might in the future come before the Supreme Court or any past Supreme Court decisions involving the President-elect.”

While the Supreme Court is under no obligation to respond before Trump’s sentencing Friday, it likely will.

“The Court will probably issue its order this evening,” notes The Economist’s Supreme Court reporter Steven Mazie.

Who actually took his call while Trump's case is pending before the Court?

If you believe they didn't discuss the issue pending before the court
I have some attractive swampland to sell you

The ethics involved in such a call left me speechless
It seems remarkably inappropriate!!!!!!

Even if they didn't discuss the,case,before the court, any discussion
Between Trump and a supreme court judge is inappropriate!!!!

I think they will, but what if they didn't? We can't have the "will of the people" sent to prison. LOL Not that he would be sent to prison, but just thinking aloud.

I wonder if SCOTUS will "postpone" the sentencing until after his term is up. That might be the thing to do -- don't just toss it out, since he was already convicted but put it on hold. I don't think that would be a constitutional crisis.

Merchan has already said he won't be sentenced to incarceration. Just something like a good behaviour bond. 'Don't get re-arrested and you won't be incarcerated'.

There is no reason to delay, as Alvin Bragg clearly noted in his Supreme Court response (which is in the article I just posted).

If you attempt to get into Trump's mind, it doesn't matter that
He won't receive any real sentence ----- For Trump just the idea that
He has to go before the judge for a meaningless sentence, to him,
Means the judge wins and he loses and he cannot tolerate any type of loss

Good news: of course Alito and Thomas voted to block sentencing.
