Having a history of abuse doesn't automatically make you partial or unfair any more than not having a history of it does. The defense may have a right to remove jurors during jury selection but it doesn't mean any juror they want to remove is necessarily biased against them.

On Friday, Maxwell’s lawyer Bobbi Sternheim brought a new, soon-to-be-aired “in-depth interview” with David to the court’s attention.

“We write to make the Court aware of new information concerning Juror 50 that may impact Ghislaine Maxwell’s pending motion for a new trial. Paramount Plus will be airing an additional interview with Juror 50 in an original series titled ‘Ghislaine – Partner in Crime,'” Sternheim wrote. “The trailer announces a ‘bombshell revelation‘ from Juror 50 in his ‘only in-depth interview.'”

Sternheim asked the judge not to rule on Maxwell’s pending motion for a new trial until it airs.

We have been unable to access the series in order to review the content of Juror’s 50 statements nor have we learned whether the interview was recorded before he testified at the March 8 hearing,” Sternheim said. “The series was scheduled to air on March 29, but we have learned that Paramount is holding off airing the series pending the Court’s ruling concerning Juror 50. We bring to the Court’s attention this previously undisclosed interview and request a stay of any ruling pending review of the interview by the Court and counsel.”

The Defendant’s motion for a new trial pursuant to Rule 33 is therefore DENIED…
The Court finds Juror 50 testified credibly at the hearing…

The Court further finds that Juror 50 was not biased and would not have been stricken for cause even if he had answered each question on the questionnaire accurately.…

“Survivors of rape have and can serve impartially in trials charging the crime of rape.”

The Court will rule on the Defendant’s remaining post-verdict motions in due course. Sentencing remains scheduled for June 28, 2022.

@KlasfeldReports
·
BIG docket entry in Ghislaine Maxwell case: "NOTICE OF CASE REASSIGNMENT as to Ghislaine Maxwell, to Judge Vernon S. Broderick. Judge Alison J. Nathan no longer assigned to the case. (bw)" Nathan was recently promoted to the Second Circuit, and now the case has a new judge
So which Judge will decide the sentence?

I usually can write at length. For this, though, I only have one word: AWESOME.
My opinion only.

I find this a very interesting quote from that article. Note: "...[he] does not consider himself a victim". In that sense, the question wasn't answered incorrectly. Great argument.

Asked for comment, David’s lawyer, Todd Spodek, said in an email: “Juror 50 does not consider himself a victim and does not let his past define him. He listened to the evidence and was fair and impartial. This is what justice requires, not more.”

It looks like the judge, in her ruling today, covered all these bases, so the contents of GM's new motion for a new trial re Juror 50 are moot.

So which Judge will decide the sentence?
Time to check whether the new judge tends to the harsh end of the sentence grid.

There has been such rigorous and precise pushback against GM from the judge all along, and very well-reasoned, it's hard to see how there'll be leniency in the sentence. But maybe I have no basis for a guess?

Oh, wait, Judge Vernon Broderick is known for being tough on crime....

"
The judge
If Collins hoped to get off easy, he may have lost the luck of the draw when the case got assigned to Broderick.

At 56, Broderick has earned a reputation as a smart but fair judge with a genial, if sometimes disorganized, courtroom manner. But what bodes ill for Collins is the judge's background.

The son of a doctor and a nurse and the product of a family with roots in Jamaica and the Dominican Republic, Broderick grew up in New York and got his undergraduate degree from Yale University and his law degree from Harvard University. He then spent eight years as an assistant U.S. attorney in the Southern District of New York, long regarded as the nation's premier proving ground for prosecutors chasing white-collar crime – and for future tough-on-crime judges.

Ahead of Chris Collins' Friday sentencing, experts say prison time awaits

The sentence was 26 months and a hefty fine. Insider trading. Prosecutors wanted 5 years, but Martha Stewart got 5 months....

Isn't it strange that a Judge was changed before deciding the sentence?

I have never heard about such situation before.

OK, she was given another post, but surely should finish all her other duties pending.

After all this Judge managed the trial, and it is her duty to decide a sentence, not somebody else who came "out of the blue".
Does it happen often?
MOO
