No Murder Charges in Sutton Place Party Killing, Prosecutors Say

Rackover was previously arraigned in criminal court in November and held on a $3 million bond or $300,000 cash bail, but it was reduced to a $1 million bond Tuesday after his attorney Maurice Sercarz argued it was more than his client’s family could afford.

When the judge asked for a clarification on the defendant’s relationship with Jeffrey Rackover — an affluent jeweler whose clients include Jennifer Lopez and Donald and Melania Trump — Sercarz said the senior Rackover was not his client’s biological parent but thought of him as “the son he never had.”

Nevertheless, the elder Rackover did not appear in court and, according to Sercarz, will not be posting bail money, which will instead be raised by Rackover’s mother who intends to mortgage her Florida home.

Sercarz asked for “a modest bond for modest middle class people.”

Could it be that Jeffrey Rackover became interested in Joey? He recently got a Porsche SUV. James said he watched football on Sunday with his "Dad". That puts Rackover Sr into the equation imo. Entirely possible - not only did they have high end brand new cars - the Hamptons is another common theme. It could all be coincidence and typical of that crowd but 15 stab wounds seems a little more than a drunken brawl. And what is in it for the other two to stay quiet? I read that they could face up to 7 years - that is a joke. Major fail here.

According to Gemma’s account, he and his roommate, 28-year-old Lawrence Dilione were at the 1OAK nightclub and retreated to the E. 59th St. apartment of James Rackover after deciding to avoid a club, Gilded Lily, where a fight was taking place.

Gemma, Dilione and five others piled into a pair of cabs and headed to the winding down party at about 4 a.m.

Gemma told cops the party was peaceful and that he did not see anyone when he woke up and left the dark apartment after about two hours of snoozing and making his way to the PATH train and home to Jersey City.

The group boozed until about 6 a.m., when Gemma said he passed out on the couch after borrowing sweatpants and a T-shirt from Rackover.

“He said he was uncomfortable in his jeans to sleep in." At his arraignment last week, prosecutors pointed to the outfit switch as a sign of Gemma's possible participation in a cover-up.

This was an apartment building. I at one time lived in a really large condominium with the highest quality building materials, but you could still hear many things through the walls especially the ceilings and floors. If there was a brawl and someone was being stabbed, it is strange no sounds of commotion or fighting were reported. If everyone was so high and drunk, passed out, door unlocked, is it possible some sicko could have snuck in or could it be possible they all blacked out and woke up like the movie, Morning After, having no recollection of the event or slight and in fear got rid of the body. Something odd happened and with no one speaking up with the potential of losing their freedom for many years, something is way off.

If he took the PATH, there should be video of him at the station that can pinpoint the time he left the apartment and show if he was carrying anything.

MG is the son of a former Oceanport mayor. MG's residence is listed as a home on Seneca Place, which is owned by his dad. The Seneca Place home is about a mile from where JC's body was found.

Comunale died from multiple stab wounds to the torso.

"We took Joey's body to Oceanport, New Jersey and we buried it in a vacant lot," Dilione told a detective, according to the complaint against him. Dilione showed the detective a location on a map where police later found Comunale's body. The site is about a mile from a home Dilione's family owns in Oceanport.

So the 3 female guests may or may not have confirmed MG's assertion that he changed into JR's sweats & tee in order to comfortably catch some sleep on the couch at about 6 AM since the 3 females were still at the apt.

Joey, LD and the 3 female guests left the apartment at some point after 6AM (Anyone know what time?), and Joey and LD were caught on video returning to the bldg at about 7:00-7:30 AM, but MG did not see anyone in the dark apt when he left about 8:00 AM. Were Joey, JR and DL all fast asleep? Where?

OK, MG left the apt without changing back into his own weekend evening party-in-Manhattan clothing, but further left that clothing behind.

Why? Personally, I find that hard to believe. If at 29 yo, he wanted to be comfy on the couch and sleep in something comfortable, wouldn't he be likely to grab his own clothing on the way out?

MG and LD are roommates in Jersey City. Have their own apartment. Both are from Oceanport with families still residing there.

Based on MG's account of the night when did they meet up with the victim? He was in the cabs from 1OAK ? thought he was at the Gilded Lily.

In my opinion it doesn't sound like he was a stranger they just met that night.

Still drunk/ hungover I've left my stuff from the night before at a close friends place before and vice versa. I don't think changing to pass out is that weird. IF they were doing coke all night for example not uncommon to finally crash and take a nap when the sun is coming up. Just my opinion. If he left at say 8am from the couch, does that mean the other three guys were asleep in a bedroom/ behind a closed door? Like he couldn't see them? Figured they were passed out too and he bounced?

At 8:00 a.m., that apartment wasn't dark, and from the looks of it, had plenty of windows.

6:00 a.m., yes, but not 8:00 a.m.

new here - been reading the threads but never posted. a few things that I noticed when looking at this case and the defendants...
RE: JR
- in JRs public criminal documents from FL, one of his later criminal cases from there notes that he is allowed to travel to New York with his "father"
- also in JR criminal docs, his codefendants are listed, specifically for the burgalary charge. a web search on one named codef reveals that this person (not JR, but rather a young man who he apparently had been in some trouble with) had some more recent and rather serious charges, related to drugs (i.e. Manufacturing)
RE: LD
- lots of pics of LD on social media, a web search of his name can get you some of his relatives names who have lots of pictures and mentions of LD over the years. dig a little deeper, and there is even a widely publicized case (RE:drugs) that same relatives were defs in a cpl years back

- same kinda search finds pics of MG - by way of friends/fam social media. as recent as Thxgiving (in a picture with a person who looks to me very much like LD!) not sure the rules on sharing pics and such tho, so if anyone wants to pls advise & maybe more can be shared?

Neither do I. At this point I'm confused as to why one of the three decided to lead them to his body. To me 15 stab wounds sounds like an out of control, drug fueled jealous rage. Well, at least an out of control drug fueled rage. But if not jealousy then what? And why are they all protecting each other ? It's like some secret society or something.

Seriously. Great point. I lived in a "luxury apartment building" at one time and no matter how big your unit is you can still hear some noises. I would imagine someone being brutally stabbed would lead to screaming and noise beyond belief! Plus it is a Sunday. Other residents would be around.
