A 29 year old, drunk and/or hung over with lack of sleep at 4:00 a.m. or 6:00 a.m. is not going to try to get comfy on a couch, He said he passed out. So he asked JR for pajamas before he "passed out" because he couldn't fall asleep in his jeans?-

Sorry, I don't buy it.

I don't buy it either. And leaving his uncomfortable to nap on the couch clothing behind, is hard to believe

But they were charged with murder...

ephiphany said:
Looks like no murder charges:
James Rackover, of Manhattan, and Lawrence Dilione, of Jersey City, New Jersey, both pleaded not guilty Tuesday to concealment of a human body, hindering prosecution and tampering with evidence.

but there is... at same link - in red brings you to another link from the original article:
http://www.nbcnewyork.com/news/loca...ra-Grad-NYC-Apartment-Stabbing-401637075.html

Authorities charged two men with murder in the case of a missing Hofstra graduate from Stamford, Connecticut, who was stabbed 15 times in the chest in a luxury Manhattan apartment and then buried in a shallow grave in New Jersey.
James Rackover and Lawrence Dilione both face charges of second-degree murder, concealment of a corpse and tampering with evidence. Dilione was also charged with hindering prosecution.
[....] Boyce described the blood spatter in the apartment as "quite noticeable."

So next court date??

TIA!

Edited to add: MG has court appearance on Jan. 13th; that's all I have...

There were no murder charges.

Initially, both JR and LD were Arrested on second degree murder charges and at the first arraignment, some of the media went ahead with that, but the Manhattan DA did not include the murder charges:

<snip> Rackover and Dilione were arrested on charges that initially included second-degree murder, two days after Comunale was reported missing.

They were later arraigned only on concealing a corpse, tampering with evidence and hindering prosecution by Manhattan District Attorney Cy Vance Jr.’s office.

new here - been reading the threads but never posted. a few things that I noticed when looking at this case and the defendants...
RE: JR
- in JRs public criminal documents from FL, one of his later criminal cases from there notes that he is allowed to travel to New York with his "father"
- also in JR criminal docs, his codefendants are listed, specifically for the burgalary charge. a web search on one named codef reveals that this person (not JR, but rather a young man who he apparently had been in some trouble with) had some more recent and rather serious charges, related to drugs (i.e. Manufacturing)
RE: LD
- lots of pics of LD on social media, a web search of his name can get you some of his relatives names who have lots of pictures and mentions of LD over the years. dig a little deeper, and there is even a widely publicized case (RE:drugs) that same relatives were defs in a cpl years back
RE: MG
- same kinda search finds pics of MG - by way of friends/fam social media. as recent as Thxgiving (in a picture with a person who looks to me very much like LD!) not sure the rules on sharing pics and such tho, so if anyone wants to pls advise & maybe more can be shared?

Hi and WELCOME!
LD and MG are roommates, so, there are pics of them together.
As far as family/friends of the 3 named suspects, we cannot post info about them, per TOS, unless they are named as POI's.

Glad to have you here!

More on NYPD's statement on that:

The NYPD stood by the decision to arrest Rackover and Dilione on murder charges.

“Based on our investigation, we felt we had probable cause to make the arrest on the murder charges. But we understand the DA may require additional information. And that’s fine,” NYPD spokesman Stephen Davis told The News. “We will continue to work with the DA’s office on the case.”

I can sorta buy it. These guys were into their appearance and maybe falling asleep in your clubbing clothes wouldn't be appealing. I don't think, though, MG would leave behind his clothes, though. You wouldn't travel back to NJ without your nice clothes! Just my opinion, of course.

Even if I do think it's plausible he asked for sweats to wear, I don't think that is what happened that night. I think he changed clothes because his clothes were soiled from the violence.

jmopinion at the moment.

New details emerge in Midtown murder case of Joseph Comunale as two defendants plead not guilty

<snip> Gemma told cops the party was peaceful and that he did not see anyone when he woke up and left the dark apartment after about two hours of snoozing and making his way to the PATH train and home to Jersey City.

<snip> The group boozed until about 6 a.m., when Gemma said he passed out on the couch after borrowing sweatpants and a T-shirt from Rackover... Assistant District Attorney Antoinette Carter said that Gemma, a marketing professional, had “changed his clothing” and that it “had something to do with... the concealment of certain items.”

Gemma is either a really heavy sleeper or complete liar.

Entirely possible - not only did they have high end brand new cars - the Hamptons is another common theme. It could all be coincidence and typical of that crowd but 15 stab wounds seems a little more than a drunken brawl. And what is in it for the other two to stay quiet? I read that they could face up to 7 years - that is a joke. Major fail here.
Possible but NOT probable.

At 8:00 a.m., that apartment wasn't dark, and from the looks of it, had plenty of windows.

6:00 a.m., yes, but not 8:00 a.m.

Almost forgot about this - it was reported:

'Jeffrey went to sleep on Saturday night, then at 10am he went down to Jimmy's apartment to walk the dog. The place looked fine,' he explained.

So Jeffrey was down in the apartment as of 10am Sunday and said he saw nothing out of the ordinary.

What I think is happening is good lawyering. The lawyers are advising their clients to keep their mouths shut. If they all are quiet, it might be a good tactic. They are probably saying - don't make the cops' job easier, but make LE gather the evidence against you. If there isn't evidence, then there isn't a case....unless someone talks.

I'm still holding out that one of them will talk. And, if LE finds the murder weapon, the DNA can do the talking.

jmopinion....patiently hopeful for murder charges and convictions

I wonder...If these 3 all had public defenders and everything else remained the same, would the Manhattan DA have Not proceeded with second degree murder charge/s against JR and /or LD?

I lean towards they would have proceeded

I think so too. And, I have to admit, that if this were a case of public defenders, there might be family and friends giving interviews.

The only real interviews have been the "adopted" father's friend, who I think was totally talking to the press to put distance between the Jeffrey and James (which I don't blame them for doing!!). And, Joey's dad gave an interview, which was also wise because it gave a face and personality to the victim. We all like Joey, and that was a smart move.

But other than that....silence. I think it's smart on everyone's part to be quiet, even if I want more news!!

I suppose we'll eventually learn if there is any truth to this unnamed NYPD source quote:

<snip> “They believe that because he changed his clothes, he must somehow be involved,” Bederow said.” But there’s no evidence to that, this indictment is based on nothing more than the idea that he changed his clothes.”

Gemma’s clothes were believed to have been found in the garbage “with blood on them,” a police source said.

There's been so many cases where LE wait a long time before laying charges. I think it can be to their advantage to have a sense of uncertainty around the case, it puts more pressure on everyone including any potential witnesses who think they can remain uninvolved, plus once they lay charges the clock starts ticking on proceeding towards trial.

For example, JR initially tried to use Jeffrey as an alibi, Jeffrey was apparently in the apartment that morning, Jeffrey's car was used, how did JR get the keys? Every little detail will be revisited numerous times.

Yes. I agree.

I'd rather have a tight case against the perp(s) with evidence that will hold up in court than a speedy charge that wasn't fully investigated.

There are other charges in the meantime to pursue. The body was found where one of the perps said it would be found, after all!

Another reason for LE delaying charges is then they don't have to reveal all their evidence, and then people can't make up stories to fit the known facts.

Right! I hadn't thought of that.

I was just looking at Joeys instagram (@joey_c9). So many great friends he left behind; he seems to have been very well liked. The pics posted there since his death are really tear jerking.

Here's hoping justice is served properly in this case!
