I don't understand why this was dismissed.... burying a newborn baby isn't tampering with evidence?

You would think. Maybe some sort of technicality.

This is the email attachment that Kim Richardson received from the doctors office.

It says “pt pregnant” with a “Discontinue Date” for the birth control pills.

An Ohio woman is in her second week of trial for allegedly killing and burying her newborn daughter — and prosecutors and defense attorneys are sparring over whether the baby was alive or dead after birth.

Brooke Skylar Richardson is accused of killing and burying her newborn daughter in her backyard in July 2017. Prosecutors allege she did not want to be an 18-year-old single mom. Richardson’s attorneys argued that the baby was stillborn and didn’t meet the legal criteria to be considered a child.

But on Monday morning, jurors heard Richardson’s own words during a police interview she gave in 2017.

Richardson, now 20, is facing trial for aggravated murder, involuntary manslaughter, gross abuse of a corpse, tampering with evidence and child endangerment.

She has pleaded not guilty.

ETA: Judge Oda dismissed tampering with evidence charge -- said prosecution did not meet burden of proof. All other charges remain. BBM

I'm surprised here.

Wondering if this because Coroner did not focus on why COD could not be determined -- i.e., because body so decomposed after BSR concealed remains for more than two months after burying naked infant.

Whether or not you believe her, she did answer this question. She didn't know she was about to give birth when she went into the bathroom. She didn't have a plan. She thought she had weeks more to figure out what to do. The only choice we know with certainty she made that night was not to ask for help after she delivered her baby.
I'll just have to disagree with your view at this time. She had plenty of time to think about what she was prepared to do with a very much live baby. JMO

I believe that the relationship between mother/daughter we are seeing here is very similar to where the relationship between Patsy Ramsey & Jon Benet was heading before being suddenly cut short in 1996.

In an alternate timeline of events, I believe this is what it would have looked like. Similarly, while these 2 were likely not involved in the Ohio Child Pageants in the early 2000’s, I’d imagine that their relationship was similar to Patsy/JonBenet at similar age milestones.

This case even has the avoidant Dad involved ( John Ramsey with work ) and potentially the afterthought brother in Jackson.

IMO the lack of plan shows that she was most likely in denial and not ready to deal with the situation and what ever happened on the night in question was pure happenstance. If she was planning all along to kill the baby she sure was lucky to go into labour under cover of darkness and not while she was out shopping with her mum or hanging out with her boyfriend.

She was. I wondered about that. And yet many have and still killed the child. Dumped them in a public toilet.

I'm astounded how it's possible. But it is a hallmark of neonaticides that they manage to stay quiet and have the baby in secret.

Yeah there's no way in hell she suddenly wanted her baby and sadly and gently laid her to rest with flowers and a name. She was happy. She got rid of the problem, IMO. The excess baggage.

Notice how she is scared of the “boy doctor.” This is an eighteen year old calling a male physician a “boy doctor.” She is manipulating with her baby girl talk.

I was unsure about Mom knowing, but she is totally besotted and believing of this child of hers. Definitely in denial but she is totally loving and supportive.
This "little baby girl" voice has been irritating me all through listening to the interviews. She regressing back to being about 6 years old.

A few years ago, just weeks before her 16th birthday, Skylar nearly passed out at a cheerleading competition.

This information was part of a 6-inch medical file on Skylar’s eating disorders the Richardsons showed The Enquirer. And it was part of the reason her family says no one said anything to Skylar when she gained weight in the spring of 2017.

“If she had come to me and said she was pregnant, I would have said, ‘OK, not exactly in the cards, but we will deal with it.’ That would have been easier to deal with than this eating disorder,” Kim said. “I can’t describe it; when your child won’t eat a piece of gum or she is worried about toothpaste and you can’t do anything about it.”

Skylar sees three different counselors and still struggles with eating disorders. She is 5-foot-1, and her weight has fluctuated from 90 to 140 pounds. Her family says she currently weighs 96 pounds, but doctors want her at 100.

5'1 and 90 pounds is a perfectly normal weight. My mom is 5'1 and has rarely been able to reach 90.

I believe this electronic communication to patient is accurate reflection of purpose of patient appointment:

State Exhibit #129 is clipped but emboldened typeface page heading appears to state Discontinued.

If she gave birth in the bedroom, why lie about it? Perhaps to excuse the damage to the baby’s skull by “hitting the toilet” or falling in the toilet bowl.

Or being dead from drowning.
