I LIKE FACTS!
ME TOO
I LIKE FACTS!
So the saying is everyone is innocent until proving guilty & Rita Newcomb was proven guilty today a man named Judge Randy Deering rubbed in our face on national tv, I am just one person but I will stand for justice, JMO
If you give them enough, theyll hang them selvesYou could be right. I do wonder if the judge is offering her enough "rope" to hang herself and the others too!
My guess is that he won't run a tighter ship. The good news is that every phone call that at least some of the W4 makes is being recorded.
It has to help the prosecution to hear the theories that AW lawyers gave her and the keywords that she gave her mom.
My concern is what evidence that Judge will allow in and why all defendants aren't asking for a change of venue.
Part 0ne
Part Two
Agree, I don't think he will run a tighter ship in the future.
I also don't think it will matter much what the defendants show to the jurors because the their goal is to get a mistrial. Once that happens, they walk free. Pike County doesn't have the money to start this process all over again and the state is too cheap to front the cost. Welcome to Ohio.
AW and RN are doing this to compromise her case and those of the others. Likely their attorneys have hatched this scheme and they're playing along.
Yes, but he said the same thing the last time he warned her. JMO, she and AW will do it again. It's sowing disorder and eventually chaos into all the trials. What is bungled in one trial spreads to the others. We know they've already been illegally sharing information about at least 2 or 3 of the 4 murder suspects. They were plotting ways to mess up the trials, coordinate false testimony and send each other messages when testifying with coded words.
That's the kind of thing that results in a mistrial, and we know the state and county won't pay for a whole new set of 4 capital trials. Maybe it's a feature, not a bug.
Asking because I'm not aware.
How does the defendant's bad behavior contribute to a mistrial. I just don't know. Thank you for your input.
A jury should only hear evidence that is admissible under the applicable rules of evidence. If inadmissible evidence is mistakenly shown to jurors, or attorneys make improper statements to the jury in their arguments or examination of witnesses, a judge may decide that the case has been so tainted as to require a mistrial declaration.
IANAL, but it could come from RN and AW revealing information about or plotting to mess up the trials of AW and the other defendants. They can do this by revealing information that is prejudicial against other defendants, resulting in potential jurors receiving evidence they shouldn't have.
5 Common Reasons for Mistrials
JMO, the judge allowing a defendant to discuss the evidence and trials of other defendants could also be very problematic, not to mention collaborating on ways to interfere with the trials by giving false testimony, etc.
ETA: JMO - Revealing inadmissible evidence to the jury can apply before the trial if that information is made public in any way to the potential jury pool.
Allowing RN to continue to remain unsupervised at home remains a big risk. I don't know how the judge is going to control the phone calls between her and AW in real time. Anyone familiar with jails know how they can do this? Do inmates have to reveal who they're calling before they're allowed to place a call?
Thank you
Judge to decide whether to send grandma back to jail in Pike Co. massacre
[from this article] "Angela is believed to be the mastermind of the conspiracy."
I've always thought this, but have never seen it in print before; JMO, because I can't explain any concrete reason why I think the murders were AW's idea and under her organization.
I wondered from the first pretrial how soon and who would be the first to insist on a change of venue. At the time it seemed that the defense would want the trials anywhere but there. It seems like that didn't happen and I've been surprised but still waiting for it. Now, I'm not so sure. I really hope this judge isn't weak, spineless, and easily controlled as it seems after yesterday. If he is, I see why no one in the defense side wants to move.
I told myself that JD has done this job a long time. He knows more than I do. I hope this is wisdom that I just can't see yet. I hope. Poor Geneva. The entire family must be very frustrated. It seems like the only one to stand firm and loudly for the victims was Sheriff Reader. Because he's the only one that has, he's the only one that has my trust. Not that it means anything. I think the Wagner's and the filth that floats around them have just been toxic and poisonous to the whole town.
IIRC, AW’s lawyer did present to the judge at one of the earlier (Jan or Feb) pretrials that he would request a change of venue but by OH law they have to try to seat an impartial jury before change of venue can proceed.
Prosecutors said Newcomb has had repeated telephone conversations with her daughter, Angela Wagner, who’s charged along with her husband, Billy Wagner, and sons in the capital murders. Angela is believed to be the mastermind of the conspiracy.
Asst. Attorney General Angie Canepa outlined during the hearing the reasons why Newcomb’s bail should be revoked. She said Newcomb and Wagner danced around talking to one another for months and admitted they weren’t allowed to talk to one another on recorded jail calls. But in June, the conversations turned to discussions about their criminal cases and Angela gave her mother instructions.
“She tells her not to testify against them, that she doesn’t have to if she doesn’t want to,” Canepa said as she summarized the calls.
Canepa said the documents were the focus of some of the conversations along with trying to obtain information for Newcomb’s defense attorney.
"They’re talking about the date on the bottom of the paper, which is the date of April 2016 when the documents were printed out and how she copied it over,” Canepa said.
Canepa said Newcomb’s son, Chris, who is Angela's half-brother, facilitated conversations between Jake and his mother. Canepa said Chris had Angela and Jake on speaker phone together so they could communicate.
