I asked one of WS's verified attorneys about this yesterday. PrairieWind replied that gag orders overall are on somewhat shaky legal ground. They also said that the defense attorneys for all the defendants are talking to each other and developing strategies for how all the hearings and trials will proceed. They agreed, the judge probably went lenient for that reason and also to "give them more rope" to reveal information that can be used against them in court. Also, the defense attorneys are probably livid about the defendants talking to each other.

Just passing this along. You're right, the judge may restrict AW from calling certain people. Perhaps he will restrict phone calls only to the defense attorneys.

ETA: To clarify, perhaps the judge will only allow AW to call her defense attorneys.

Good information. Yes if her phone privileges are suspended she could only call her attorneys. But it's such a simple solution to simply not allow her to call Rita's landline and Ritas's cell phone. To ban her entirely from calling those 2 numbers.

Could Angie call her brother's cell instead while he's at Rita's house and then he gives the phone to mom? Yes! But that would all be recorded and reveal what's going on and is against the Judge's order. There can be no phone calls from Angie to Rita's house regardless of the phone used.

So glad you consulted Attorney Prairie Wind. I didn't know that all the defense attorneys would be collaborating behind the scenes and influencing the hearings. Interesting! I knew the defense attorneys would be mad!

They could have just not filed the Motion to Revoke Privileges and kept listening and transcribing their conversations. Or did they get all they needed? Code/buzz words, defense strategies.

Yes, I assume "give them more rope" means hoping they'll reveal something by talking again. Probably not likely after this, but who knows what the defendants are thinking? They're different, that's for sure. JMO, AC filed the motion because she's really concerned about them violating the judge's orders and the message that sends to the other defendants and maybe to defense attorneys, too.

Yes. As much as the defense discusses behind the scenes strategies with and without all the other defense attorneys, you can rest assured the prosecution has long range strategy planned out.
Listen, those phone calls between Angela and Rita went on for months and it wasn't until the conversations got longer and longer and started going into their court strategy that Canepa finally stopped it.

Why didn't she stop it sooner? After all, all along they admitted they can't talk to each other but they got bolder and bolder.

In my opinion only, AC did not stop Angie and Rita from talking because she and Junk were waiting to see if they would say anything incriminating. They waited and waited and sure enough they started talking about their criminal cases, Angie practically ordering Rita to keep her mouth shut :confused: against the family.

But then AC needed to get these conversations put into the official court record, as one bright sleuth on here mentioned and I agree with, so she filed the Revoke Bond Motion and now the conversations are official court records.

But also (as you mention) as a Professional Special Prosecutor it's AC's duty to report things that violate :eek: the Judge's orders (no contact order) and the Judge would expect no less.

Is the Defense allowed to have a copy of the GJ witness list? I may be wrong but I thought all GJ proceedings were secret.

Grand jury proceedings are secret. No judge is present; the proceedings are led by a prosecutor;[11] and the defendant has no right to present his case or (in many instances) to be informed of the proceedings at all. While court reporters usually transcribe the proceedings, the records are sealed. The case for such secrecy was unanimously upheld by the Burger Court in Douglas Oil Co. of Cal. v. Petrol Stops Northwest, 441 US 211 (1979).[12][13] The dissenting opinion was joined by Justices Burger and Stewart but concurred with the Court's opinion as to the importance and rationale of grand jury secrecy. I don't think so. I think Judge Deering already ruled against that in a previous pre-trial hearing. I do think he agreed that defendants could have transcripts of their own testimony in GJ hearings, but not for lists of people who testified. He did allow that testimony about the court reporter, etc. and the mysterious man in a blue uniform, but nothing more.

I posted it in reference to comments you had made about the missing and dead girls in Chillicothe. I've seen several posts that aren't directly related to the Rhoden murders. I will however ask for my post to be removed since I can't delete it.

Is there a thread for her yet? If not, could you start one? The story deserves attention. Thank you for sharing it.

No, it's ok. I had to read it again a second time before I understood what you were referring to. Those were terrible crimes. I hope they solve all of them some day. I know they feel they've solved some and a couple of the perps were sent to jail for a while, but were never actually tried for those murders.

Which ones do they feel they've solved?

Good information. Yes if her phone privileges are suspended she could only call her attorneys. But it's such a simple solution to simply not allow her to call Rita's landline and Ritas's cell phone. To ban her entirely from calling those 2 numbers.

Could Angie call her brother's cell instead while he's at Rita's house and then he gives the phone to mom? Yes! But that would all be recorded and reveal what's going on and is against the Judge's order. There can be no phone calls from Angie to Rita's house regardless of the phone used.

So glad you consulted Attorney Prairie Wind. I didn't know that all the defense attorneys would be collaborating behind the scenes and influencing the hearings. Interesting! I knew the defense attorneys would be mad!

That Rita and Angie will reveal more by talking again?
They could have just not filed the Motion to Revoke Privileges and kept listening and transcribing their conversations. Or did they get all they needed? Code/buzz words, defense strategies.

I agree, Cool Cats. I am wondering how much useful information they gleaned. They knew they were being recorded. On the other hand, this family does not strike me as overly intelligent or methodical (except in their own minds). So, maybe they did get usable information for the trial. It's sure going to be interesting.

Personally, I'm going to wait for RN's last hearing and trial to see what's up instead of trying to make blind guesses. I trust AC to handle this for now, but she may need extra help later.

Mostly, we're just muddying the waters here with too much speculation, to a level that is becoming excessively confusing. JMO, that only helps the killers/defendants and that's not good.

IIRC, from the Berlinger documentary, LE claims some of them were suicides, other overdoses. To them, they are solved, but from some of the information in the documentary, there's reason to believe some of the women were murdered.

Yes absolutely they got usable information for the trial of the kind every prosecution attorney dreams of:

What will the defense's strategies be? If you know the defense theories of how they think the crime was committed, then you can deduce their strategies.

According to Canepa, Angie revealed her attorney's theories, not theory, but theories, to Rita.

Example:

Let's say Angie says to Rita that one theory her attorneys are going to use is that it was the Mexica Sinaloa Cartel who committed the murders. Her attorney's say that the Rhoden's grew marijuana and that the Cartel deals in marijuana --- in that area --- and only a Cartel would kill a whole family, and Kenneth had dollar bills on him, and the murders were too sophisticated for the under-educated Wagner's to pull off etc...

Well the prosecution can be ready with a ton of evidence that shows the Cartel had nothing to do with it. They can have evidence and witness testimony ready to explain:

1.) The statistics of the Cartel shooting entire families in the US.
2.) The statistics of exactly how the Cartel shoots its victims. Like they don't shoot them 4 and 5 times, or get sloppy on a hit and shoot someone 9 times.
3.) Statistics on how often the Cartel leaves children alive and at what ages.
4.) The legal documentation of exactly when and where the Cartel was in Southern Ohio, and what exactly were they doing?
5.) Evidence and witness testimony that shows the Wagner's were skilled with weaopns, silencers, tactical equipment, stalking prey, hunting, mechanics, etc..
6.) That evidence gathered by LE points to amateurs trying to stage a Cartel hit --- LE knows the "crime scenes were tampered with" and everything was done to "hinder the investigation."
7.) And the big thing, they can show that all the Rhoden's cell phones and computer digital footprints show that, no, they had absolutely no contact with anyone in a Mexican Cartel, and several witnesses, who knew them, can testify that none of them heard the Rhoden's mention the Cartel etc....
