Could Billy be wanting to go first to get the better deal? The closer one gets to the trial date the harder they work for a deal "IF" a deal is even being considered to any of them. Something has him wanting to roll the dice.

Maybe, but doesn't the Prosecution decide who goes first? And apparently it isn't Billy. JMO

Could he want to make a deal to testify? Is FW still paying for only his attorney at this point?
He's signaling something since he's antsy. But, maybe it's just that, antsy and nothing more.

I was curious about the legality of filing pro se while represented by an Attorney. In some states I found a clear code around it. In OH the only thing I found so far is citation reference in other cases such as the example below.

{¶8} Wyley's assignment of error lacks merit for several reasons. First, we note that a defendant has the right to counsel or the right to act pro se; however, a defendant does not have the right to both, simultaneously, which is known as "hybrid representation." State v. Mongo, 8th Dist. Cuyahoga No. 100926, 2015-Ohio-1139, ¶ 13, citing State v. Martin, 103 Ohio St.3d 385, 2004-Ohio-5471, 816 N.E.2d 227, paragraph one of the syllabus; State v. Thompson, 33 Ohio St.3d 1, 6-7, 514 N.E.2d 407 (1987). The right to counsel and the right to act pro se "are independent of each other and may not be asserted simultaneously." Martin at paragraph one of the syllabus.

Could Billy be attempting to set the stage for an “ineffective counsel” argument? Stating his attorneys are not listening to him or his wishes? Just a curiousity...
The attorneys sure have their hands full in my opinion.

The case cited above State v Martin is an interesting read on the topic.

I really don't think he'll ever plead guilty. I don't think his mother would allow it because it would make her look bad. IMO, he will fight this all the way to the end.

I personally feel he's just being a crybaby. He's used to getting whatever he wants, whenever he wants it. He isn't getting what he wants. So, now he's throwing a tantrum. His legal team can't get him what he demands, so he'll just try to bully his way through the issue with the court system on his own. Many, many times in the past he's been able to get charges against him dropped or only get a slap on the wrist. Remember when he got arrested for these eight murders? He said, "Can't I just pay a fine or something?"

He's never had to pay any serious consequences for his illegal actions in the past. However, he's now been without his freedom for 23 months. This time around he's being held responsible for his illegal actions, and he can't handle it. He's PO'd because his physical stature and/or his mom's money aren't getting him immediate results this time, and now he's pouting. All my opinion.

You just can't make this stuff up. 2 years in jail, I do not blame him. I would want my trial after 2 years. Just saying....

I think the Wagners realize that they all would have been found not guilty if they had done what Fred did. She did not waive her right to speedy trial and it helped her, they ran out of time. I think Fred is 100% behind this.

That you can’t.... Honestly, it appears quite strange.
I don’t think this was a spur of the moment I am ticked so I sit down with my pen and pad and write a letter to the court and out it goes before I can think twice about it. I agree with poster Itype Billy is probably feeling the way described, but this feels a bit more than a quick temper tantrum.
If someone helped him with this it had to take a little time to get it written, signed, and mailed. Especially true if that someone is on the outside. It feels a bit more strategic.

I would not be surprised if FW is getting advice from Owen and passing it along to Billy through his sister. Heck, they probably don't care who watches their virtual visits. Also, the form could have been mailed to him to sign. It isn't going to work, IMO. It's almost laughable.

Also, I wonder if it is even possible to waive your right to a speedy trial, considering his charges and DP specifications? And if so, really???

Could this be a delay? He wants to change his legal team. And he could be saying he wants, to represent him self. Only to ask for a new legal team.


I said since day one. All four should of demanded a speedy trail. And their is know way the prosecution, could have handled, 4 death penalty at once.
