We'll have to wait and see what JW might have been able to work out in the terms of the plea agreement. If he gave up enough, might it be possible that he was able to secure for all 4 LWOP, not in gen pop?
The Judge can give a recommendation to the DOC (Department of Corrections)
about the security level he envisions, but the final decisions of the Wagners' imprisonment will only be up to the DOC.
The DOC will send the 4 Wagners (just a matter of time) to one of 3 Ohio Correctional Reception Centers where over a couple weeks time they will be completely evaluated as to the proper security level placement. Level 1 through 5. 5 is maximum security.
The only way to guarantee the Wagners don't get attacked is to keep them in protective custody away from other inmates. This type of segregation is different from the disciplinary segregation or "the hole" as it is sometimes called.
This is because even though they are isolated they still get privileges that those in "the hole" lose. They keep their privileges because they are there only for protection as opposed to rule infractions.
So the DOC will decide their level 1-5 and then decide if they are going to put them in general population or go straight to protective custody.
If in general population they had problems, they can at any time be put into protective custody. Any inmate who doesn't feel safe can request protective
custody.
