The Colorado Police went to a Wisconsin prison to visit a guy who killed his 2 daughters and wife because he pled guilty and everyone wanted to understand why and how. (Chris Watt)

George Wagner to return to court for a delayed motions hearing

Ok, this article is confusing. It says George is having the hearing today, but pretty sure its Billy

Is Law and Crime covering this today?

Billy in court today. A bit conflicting because the Warrant says picking him up at Noon, but his official time is 11:00am. They start late anyway.

So I rack my brain over the psychology of these types of Cases and many things about the Wagners has baffled me.

Why did the Wagners just suddenly sell a farm they loved? Out of the blue they went from heavily updating their farm to abruptly selling out all their animals then selling the farm.

This farm was a big thing to them but there was something bigger:

BCI.

I think what happened in the psychology of the Wagners is that they underestimated LE. I believe the Wagners saw Pike County as some Key Stone Cop type of place without the resources to go after such a large murder investigation.

When BCI set up their huge command trailer in Waverly, then vowed not to leave till it was solved, I think this threw the Wagners for a loop.

I think they couldn't wait to get far away from BCI and thus they did everything they could to get out of town and this included selling out all their livestock and putting their house up for sale.

I think this shock over BCI is the reason they wanted revenge so badly, the reason they wanted to beat up Scheiderer etc...

How dare he come around asking questions! Who does he think he is? He's not working for Pike County etc....

BCI is what the Wagners did not anticipate, they were too busy plotting in their own little world to take time to understand the Ohio BCI.... 2 Cent rumblings.

Shame I can only hit like once!

Bless her hear, Ms Geneva is there. I had a feeling she would come for Billy's hearing. She has given him very bad looks in the court room before. She knows something about him and his role in killing her family.

Argument over the Death Penalty language and how it was written in Jakes plea agreement. Third part beneficiary rights around if something goes amiss.

AC says their rights don't apply until they're vested. Must have a contract of their own.

Assume this is about contract argument related to Jake's testimony.

Defense: Defendant's agreement applies to Jake and co-defendants. They're arguing that state is not being clear to rights of other defendants. Nowhere in agreement says the DP will be reinstated if he doesn't testify right. They're arguing wording, saying it needs to be clear. Would add time to trial if this conflict happens.

Plea references plea agreement. Plea agreement applies to Jake. When they say as per plea agreement - the other defendants rights applied. He's saying Jake has already testified truthfully, so the DP should be considered off the table for the others.

AC says they can change the terms with Jake, but the other defendants don't have the right to demand changes.

Defense says it's an "attendant benefit". He says right now Billy is a vested attendant beneficiary. He says it needs to be enforced (for other defendants) before any trial.


Nov 17 1:30 for another pretrial hearing.

Give him his own plea deal. Multiple LWOP, no chance for bail or appeal, no early release.
He would have to cop out to other crimes committed, and testify. All of these 4 will want to go to a far away prison.
Far from everybody. Mention to him that the choice of prison will still be up to the court if he misbehaves.
