Wagner’s attorneys are arguing the death penalty should be off the table because he didn’t shoot anyone.

The prosecution then said Jake did implicate George as being involved in the planning and execution of the shootings on the night in April 2016.

“It’s our argument that George never had the specific intent to kill,” his attorneys said.
I will never believe George did not shoot anyone.

If "George never had the specific intent to kill," what was his specific intent at the murder scenes? Move bodies around? Drive the vehicle? Add moral support?

IMO, none of the four are going anywhere but prison. Billy did shoot someone and George aided and abetted. The rest is just noise. Noise like we've witnessed in this Country over the last few years. We saw how easily manipulated some people are but I'm not one of them. Personally I've never like the death penalty but in this case.... bring it.

Prosecutor Canepa stated it again today - in State vs Dean, the Ohio Supreme Court ruled that the death penalty applies even in cases of complicity. It's a legal sentence. The US Supreme Court has ruled the DP is not cruel or unusual punishment. No one is being unfair to George.

There were 3 different types of weapons used - that's 3 shooters. Each shooter brought plenty of their own ammunition, their weapons were in good repair. There was no need for one of the shooters to throw down their own weapon and take George's.

So the defense is that he is accused of being complicit but he was without the intent. Let's examine the definition of those 2 words.

"All of these Wagners are complicit in some criminal conspiracy"

intent
  1. resolved or determined to do (something).
"The Wagner Crime Family was intent on achieving murder."

Nope. Not gonna work for the defense.

Hadn't heard that. Not saying it isn't true. Will have to check. If so, his client was sentenced to DP. It would be rather ironic that AC quoted case law from one of Nash's losses.

I didn't see his attorney's name so far on the SCOTUS case, but it may be there. Kind of busy now, but here's a link

  • His attorney wants to get rid of the charges that carry the DP
So that can only mean George 4
  • Is not remorseful, nor does he regret his decisions in helping murder 8 innocent people
  • Wants a much lighter sentence or
  • Wants complete acquittal or
  • Wants a mistrial

His attorney said George says he is innocent, meaning of everything.

It's been 3 years and George still won't admit guilt to anything, even with the "I didn't shoot nobody" proffer.

So he isn't going to plea now. He is banking on full acquittal at trial.

Good, let him go to trial and be convicted of all charges which is what is going to happen.

Problem is, George can't claim innocence. There's too much evidence (including audio and video recordings) of him helping plan and carry out the murders. There's audio of him making threats against the LE and AG who later arrested him and his family.

One also has to wonder, if George is so innocent, if he didn't shoot anyone, why are his attorneys working so hard to have shoeprint and ballistic evidence thrown out? Most likely its because that evidence will show that Jake is trying to cover for George by saying he didn't shoot anyone.

That's the plan, JMO. Lie to get George and Billy out of jail.

I heard AC say that Jakes proffer had discrepancies in it so he probably is covering for George.

Sounds like a good summary, Niner. Thanks. They also have some evidence and motion deadlines for January 7.

AC argued that all defendants have been treated equal. All were offered plea deals. Defense was notified of the charges and provided evidence to back them up. Defense attorney Nash said George understands the complicity charge, but insists George "never intended to kill anyone". Really? What did he think was going to happen? :rolleyes: AC said he's supposed to save that argument for the trial.

AC also accused George's defense attorney of trying to air his case in the news media.

AC alluded to the fact that Jake also faces the DP if he doesn't testify truthfully. She seemed to be emphasizing that Jake will be in a difficult position if he testifies at George's trial. State claims he contradicted himself during his 12 hour confession/proffer WRT George's participation. If he's telling a false story to protect George, but the evidence shows George is guilty of shooting a victim, then Jake risks getting the DP again.

Another interesting moment occurred when George's defense attorney accused the state of "making a deal with the devil" in making a plea agreement with Jake.

In her rebuttal later, AC said there are 4 devils in this case - the Wagners, who killed 8 members of the Rhoden family and Hannah Gilley. It was great.

"So at the start of the hearing, Parker started to read aloud in court 10 excerpts of Jake Wagner's 12-hour confession. Canepa objected and fired back, saying it was clear the attorneys wanted to try the case before it ever got to trial.

The judge did not allow the excerpts to be read.

During his argument, Parker said that prosecutors "made a deal with the devil" in taking the death penalty off the table for Jake Wagner, who had admitted to personally killing five of the eight victims.

Canepa responded: "Unfortunately, there is more than one devil in this case, and that is all four defendants charged in this matter.”

Considering Billy and George, its interesting how George 4's attorneys jockeyed to have his trial before Billy's. It would be interesting if there was something on the state's tape regarding these plans when the Wags were up in AK.

Neither of those two has any remorse. None at all. If they had it to do all over again, they would still kill everyone and leave those babies there.

No one would be safe if those two were ever let out of prison. JMO

I have to go and listen again @Betty P because I never heard any of that. Sound was good and loud but I do struggle with ACs accent in understanding. I heard Parker going on about the 10pieces of Jakes proffer etc.

So not only do I need to sort out a updated eye test, I have to admit to suffering from Tinnitus. If I were a horse I'd be in the glue factory by now!

I think it was fairly early in the hearing, after AC had called for a conference at the bench with the Judge. They were trying to set rules on what the defense could read out loud in court from Jake's proffer. They reached agreement, then Parker went back to the podium and continued with his statement. He made the remark about the prosecution making a "deal with the devil" as quoted in the link above. When he finished and AC made her argument, she made her statement about there being more devils - the 4 Wagners.
